Inside Kavanaugh's hearing prep: Mock hearings and faux protesters



The White House is making last-minute preparations for Supreme Court nominee Brett Kavanaugh’s Senate confirmation hearings next week, holding final prep sessions and setting up a pair of rapid-response war rooms.

Kavanaugh, a Washington veteran who worked for President George W. Bush and helped write the Starr Report, has called on his vast network to help him get ready for the hearings. His former clerks, lawyers from the conservative Federalist Society and even Republican senators have participated in nearly a dozen practice sessions designed to mimic the conditions of the often grueling hearings, according to a White House official.


On Monday, Kavanaugh participated in his last full moot court session, which lasted nearly the entire day. Sitting in a large office in the Eisenhower Executive Office Building, he took questions from aides who played key members of the committee, mimicking their style of questioning. The mock hearing room has been outfitted with a dais, nametags, microphones and a clock with red and green lights meant to keep his answers within the allotted time limit.

The sessions, which are often referred to as “murder boards,” have also featured faux protesters to make sure Kavanaugh stays cool in the event of a midhearing outburst.

Republican Sens. Lindsey Graham of South Carolinia, Rob Portman of Ohio and Dan Sullivan of Alaska have all helped Kavanaugh practice and critique his performance, according to people familiar with the sessions. Another source said that Sen. Orrin Hatch of Utah — a former Judiciary Committee chairman — played the role of chairman in a mock hearing, which included GOP senators standing in for Judiciary members and zeroing in on topics that Democrats are expected to grill Kavanaugh about.

It’s not uncommon for senators to help Supreme Court nominees of their own party prepare for confirmation hearings. Graham, for example, has participated in practice sessions for John Roberts, Samuel Alito and Neil Gorsuch, Trump’s first nominee for the high court, while Sullivan also helped with Gorsuch’s preparations.

The White House is organizing a war room in the Senate near the committee room that will be staffed by administration officials, Senate leadership aides and Judiciary Committee staff. A second war room is being set up in Vice President Mike Pence’s Senate office. Staffers will be ready “in case there’s a surprise,” the White House official said.

Kavanaugh’s prep work for the confirmation hearings began in earnest soon after President Donald Trump nominated him in July. Staff from the Justice Department’s Office of Legal Policy and the White House counsel’s office, along with Kavanaugh’s former clerks, prepared dozens of binders packed with information and suggested answers about everything from the establishment clause to environmental law. Kavanaugh took one or two binders home each night, the official said.

The prep work largely mirrored the process Gorsuch underwent before his largely noncontroversial confirmation hearings last year. Gorsuch was confirmed in a 54-45 vote, and Trump has subsequently described the confirmation as one of the high points of his presidency.

WASHINGTON – For eight weeks since President Donald Trump nominated him for the swing seat on the Supreme Court, Brett Kavanaugh's judicial record and legal philosophy has gotten lost amid disputes over his partisan past and withheld documents.


But when the Senate Judiciary Committee holds four days of hearings this week, those controversies probably will take a back seat to issues affecting millions of Americans: Abortion. Guns. Health care. And, inevitably, the president himself.

Kavanaugh, 53, will be questioned for 17 hours or more about the conservative views he espoused in more than 300 opinions and dissents over 12 years on the U.S. Court of Appeals for the District of Columbia Circuit – a traditional steppingstone to the Supreme Court.

For half that time, Republicans who have fawned over Kavanaugh since his nomination July 9 will call attention to his pedigree and character: Yale University and Yale Law School, three prestigious federal court clerkships, nearly a decade of public service and a reputation for open-mindedness and collegiality.

For the other half, Democrats whose opposition is all but assured will highlight the Washington native's rulings and writings on controversial issues and seek assurances on how he would rule in future cases – questions Kavanaugh will parry without making any promises.

“There will be sparks at this hearing. Sparks will fly," said Sen. Richard Blumenthal, D-Conn. "And there will be a lot of heat.”

There already has been a lot of money spent on both sides of the Kavanaugh nomination, nearly all of it in the few states from Maine to Alaska where senators' votes are in play. Conservative groups including the National Rifle Association have spent more than $4 million on television ads alone, outpacing liberal groups concerned about abortion rights, health care and the financing of election campaigns.

Obstruction: Democrats Begin Kavanaugh Confirmation Hearing with 62 Interruptions



Senate Democrats threw a tantrum on Tuesday during the opening of the confirmation hearing for Supreme Court Justice nominee Brett Kavanaugh.
Abandoning decorum, Senate Democrats interrupted the proceedings 62 times, without waiting for proper recognition from the chair, and many of them spoke out of turn.


Sen. Richard Blumenthal led Senate Democrats by interrupting the proceedings 21 times, and Corey Booker interrupted 13 times while his staff sent out fundraising letters based on his performance.

Republican senators condemned the interruptions as Democrats trying to enact “mob rule” over the serious nature of the confirmation hearing.

Besides the 70 interruptions (also the number of arrests made) and violations of due process the "resistors" engaged in during that hearing, one shouldn't overlook their meltdown outside the steps of the Supreme Court minutes after Kavanaugh's nomination was announced. In many cases, their picket signs had a blank space where his name was penciled in, as they were basically preparing to oppose any candidate the White House announced. Shameless and opportunistic to the last breath, that's the Left.

This week, Democrats pulled out all the stops in their attempts to stop President Trump’s pick, Judge Brett Kavanaugh, from gaining a seat on the Supreme Court. Now, Democrats have no power to stop Kavanaugh’s ascension; thanks to former Sen. Harry Reid, D-Nev., Democrats invoked the so-called nuclear option in order to reduce the burden for approving judicial nominees down to a simple majority. This has left Democrats and their allies with two options and two options only: screaming and whining.

First, the screaming.

Democratic Sens. Kamala Harris, D-Calif., and Cory Booker, D-N.J., both of whom have already announced they will not support Kavanaugh’s nomination, attempted to shut down the Senate Judiciary Committee Kavanaugh hearing. Harris immediately called for an adjournment so that she could supposedly review more of Kavanaugh’s documents. Then Booker jumped in. By the end of the first 40 minutes of the hearing, Harris had interrupted eight times; Booker 10 times; Sen. Richard Blumenthal, D-Conn., 13 times; Sen. Mazie Hirono, D-Hawaii, six times; Sen. Amy Klobuchar, D-Minn., three times; Sen. Sheldon Whitehouse, D-R.I., twice; Sen. Patrick Leahy, D-Vt., once; and Sen. Chris Coons, D-Del., once. Apparently, all were acting at the behest of Senate Minority Leader Chuck Schumer, D-N.Y., who was attempting to run out the shot clock … or something.

That was just the beginning. Women’s March activist and terrorist sympathizer Linda Sarsour showed up to scream at Republicans; she was arrested. Several more feminist protesters showed up dressed as cast members of “The Handmaid’s Tale”; other feminists simply screamed at the top of their lungs during the hearing, forcing their ejection. Planned Parenthood Action tweeted, “This is what the resistance looks like, and we’re going to fight like hell to #StopKavanuagh.”

The screaming, needless to say, did not work.

And so, the Democrats deployed the next prong of their attack: whining. First, a bevy of leftist commentators on Twitter deployed to inform Americans that Zina Bash, a former Kavanaugh law clerk, was secretly utilizing a white supremacy signal while sitting behind Kavanaugh. Amy Siskind of The Weekly List tweeted, “What fresh hell is this!!!??? Kavanaugh’s assistant Zina Bash giving the white power sign right behind him during the hearing? This alone should be disqualify!!!” Eugene Gu, a Twitter celebrity doctor, called the supposed sign a “national outrage and a disgrace to the rule of law.” Video of Bash earned millions of views on Twitter within a few hours.

There’s only one problem: Bash is half-Mexican and half-Jewish, and her paternal grandparents were Holocaust survivors. Oops.

But more whining was in order. Fred Guttenberg, the father of a Parkland shooting victim, stated that he tried to introduce himself to Kavanaugh but Kavanaugh wouldn’t shake his hand. Again, there was only one problem: That never happened. White House deputy press secretary Raj Shah explained: “As Judge Kavanaugh left for his lunch break, an unidentified individual approached him. Before the Judge was able to shake his hand, security had intervened.”

Here’s the truth: Judicial hearings are largely useless at this point. Thanks to the destruction of Reagan nominee Judge Robert Bork in 1987, judicial nominees know not to answer direct questions about judicial rulings and philosophy, and senators know to only ask questions most likely to land them on television. With that in mind, Senate Majority Leader Mitch McConnell, R-Ky., should simply bring up Kavanaugh for a vote and end this circus.

But he won’t. The circus will continue. Our politics will continue to degrade. Anybody who thinks President Trump is the sole performer under the big top should realize that the circus has three rings, and Democrats occupy at least one of them.

I don't recall seeing any protests when Obama appointed far-left SCOTUS judges like Sotomayor. Sure, they trashed her on conservative radio and news outlets, but you didn't see an avalanche of unemployed, shower-impaired, green & blue-haired autists with picket signs outside the Supreme Court the day of the nomination or inside the committee hearings. There's something fundamentally anti-American about muzzling due process and stifling free speech, and these unauthorized protests are just that. That's why the Right would come off as hypocritical if they had Duck Dynasty-style survivalists bursting into the chambers and waving their flags in the air to demonstrate against liberal appointees, while the Left has no such scruples since in their narrow universe anything that doesn't fit their agenda is fair game, fuck the rules.

Should I trot out some Republican examples? Or would that just be wasting my time. It was wrong that they were disrupting the hearing, doesn't matter if similar behavior was done by the opposing party. But to pretend the left is somehow worse than the right... come on..

Actually that would be funny. Can you show me the last time the right disrupted a hearing and had a bunch of their protesters arrested? :D

I stand corrected, I found rallies and assorted other venues but not specifically a hearing on a Supreme Court nominee. This appears to be a first.
