After long refusing to commit to accepting the results of her race if she lost, Republican Kari Lake on Friday filed the legal challenge she's been threatening in the aftermath of losing the Arizona governor's race.

Lake claimed on Twitter that a UPS delivery driver “just told us he is ‘devastated’ that they ‘stole another election’ and asked how he could help.”

“The Fake News may spin it… Officials behind the Sham Election may lie… But Arizonans get it,” she added. “They know our Elections are a joke.”

Former news anchor Lake pushed Trump’s 2020 election lies before the 2022 midterms and has followed much of his same playbook, baselessly alleging voter fraud, since her defeat to Democrat Katie Hobbs. Trump heavily backed Lake in the election.

Maricopa County and Hobbs, in both her capacities as secretary of state and as a gubernatorial candidate, asked a state judge to dismiss Lake’s election challenge.

Oral arguments on the motion are set for Monday, and a two-day trial is scheduled for later this week if the case moves forward.

Lake at Sunday’s event said she wasn’t sure how the judge would rule on the dismissal motion, asking the crowd to pray for him.

“We’ve seen judges dismiss cases, I don’t want you to get discouraged,” Lake told the crowd. “It could happen. We’re going to kick this right up to the Supreme Court, and I will not stop fighting.”

Among other allegations, Lake on Sunday claimed 300,000 ballots in Maricopa County were tabulated without proper chain of custody paperwork, as she has alleged in court, calling county election officials “magicians” who made ballots randomly appear.

“This allegation is false, and will be easily disproven by the County if necessary,” Maricopa County said in court filings, suggesting Lake “does not understand” that the various types of chain of custody paperwork and the proper documentation exists for the ballots in question.

Unsuccessful Arizona Republican secretary of state candidate Mark Finchem contested his loss based on some of the same allegations, but a judge dismissed his case on Friday.

Lake on Sunday dug in to her battle over Hobbs’s victory, with Lake saying her pronouns were “I won.”

She proceeded to describe Maricopa County’s election system as a “house of cards.”

“I think they’re all wondering what I’m going to do,” Lake told the crowd. “I’ll tell you what, I’m not going to just knock that house of cards over. We’re going to burn it to the ground.”

No dipshit, what it means is that there is an actual judge what will allow the proceedings to on after actually looking at the evidence unlike the the others. That means when this goes to trial Hobbs will be put up for cross examination with no doubt being asked how she was able to oversee not just her election but the entire election…..should I pull out a chalk board and draw little stick figures to explain this more?

An Arizona judge has dismissed most of Kari Lake’s election lawsuit contesting the victory of her opponent, Gov.-elect Katie Hobbs (D), after Lake for weeks seized on unproven voter fraud allegations.

Lake had asked the judge to set aside Hobbs’s certified victory based on 10 counts, alleging election officials in Maricopa County — which comprises most of the state’s population — committed misconduct and tabulated hundreds of thousands of illegal ballots.

Maricopa County Superior Court Judge Peter Thompson on Monday evening dismissed eight of the 10 counts, ruling that they did not fall under the proper criteria to bring election challenges under Arizona law, even if true, so they did not merit further consideration.

But Thompson allowed a trial to move forward on two other counts that he said, if proven, could state a claim under the statute governing election challenges: alleged intentional interference by election officials affecting Maricopa County ballot printers and chain of custody violations.

Lake, an ally of former President Trump who promoted unfounded claims of voter fraud in the 2020 election and declined to commit to accepting this year’s results prior to Election Day, must now prove those two allegations in a trial scheduled for later this week.

Lake framed Monday’s ruling as a win for her campaign, writing on Twitter, “Our Election Case is going to trial. Katie Hobbs attempt to have our case thrown out FAILED. She will have to take the stand & testify. Buckle up, America. This is far from over.”

Since the midterms, Lake has railed against Maricopa County officials and Hobbs, calling the election “botched” and a “sham” as she vowed to appeal her case to the Supreme Court if necessary.

Maricopa County as well as Hobbs, in both her capacities as secretary of state and a gubernatorial candidate, dispute Lake’s claims and had asked the judge to dismiss all 10 counts.

Hobbs and the county in asking for the complete dismissal argued that many of Lake’s allegations were based on procedures put in place well before last month’s election, saying those claims had to be brought before Election Day.

They also contend that the Lake campaign’s arguments are also unfounded and would fail on their merits in trial.

“If there’s anything rotten in Arizona, it is what this contest represents,” an attorney for Hobbs said at the hearing. “For the past several years, our democracy and its basic guiding principles have been under sustained assault from candidates who just cannot or will not accept the fact that they lost. The judiciary has served as a bulwark against these efforts to undo our democratic system from within.”

Maricopa County, which spans the Phoenix area, has become an epicenter of voter disenfranchisement allegations after some of the county’s Election Day vote centers experienced printer malfunctions.

“This case is also about a secret censorship operation set up by the government that would make Orwell blush,” Lake’s attorney said during a Monday hearing, referring to George Orwell, who wrote the “1984” dystopian novel.

Lake is one of multiple GOP nominees to challenge the results of their election.

Judges have dismissed separate election contests filed by a state senator who contested Hobbs’s gubernatorial win, and another filed by defeated Arizona secretary of state candidate Mark Finchem (R), who challenged his Democratic rival’s victory.

Arizona Republican attorney general candidate Abe Hamadeh, who trails his Democratic opponent by just 511 votes out of 2.5 million ballots ahead of an automatic recount, has also contested his race’s results.

A state judge in Arizona’s Mohave County similarly heard arguments about a dismissal motion in that case on Monday, but Hamadeh’s contest, which was joined by the Republican National Committee, remains ongoing.

Kari Lake told fans Tuesday she was excited to prove elections are "truly corrupt" at an upcoming two-day trial ordered in her lawsuit challenging election results that show she lost to Democratic rival Katie Hobbs.

Maricopa County Superior Court Judge Peter Thompson tossed eight of 10 counts in Lake's lawsuit Monday but allowed two to proceed, giving Lake a chance to prove her theory of intentional election misconduct in a two-day trial.

"Christmas came early yesterday," Lake told people attending a Turning Point USA rally in Phoenix. "This is so historic."

Lake added that Hobbs can't "duck out" of testifying and that Hobbs "will have to take the stand." But her legal team on Tuesday withdrew its subpoena to force Hobbs' testimony in the case.

Hobbs will not be testifying, the Secretary of State's Office confirmed.

Kari Lake’s trial is over. The Big Reveal about Arizona’s election is, well …. revealed.

Turns out there was no bombshell evidence proving that some nefarious soul over at Maricopa County schemed up a plan to rob Lake of victory.

There wasn’t even a small firecracker. Not even a party popper.

There was just Lake’s attorney, clinging to a theory that somebody shrunk the ballots to cause Election Day mayhem and cost Lake the election.

Actually, according to Maricopa County Superior Court Judge Peter Thompson’s order, it was about bringing evidence that shows someone intentionally caused the county’s ballot-on-demand printers to malfunction – and that, as a result of that, enough “identifiable” votes were lost to change the outcome of the election.

Team Lake didn’t even come close on either count.

Instead, her attorneys offered:

    A whistleblower from Runbeck Elections Services, the county’s election contractor, who didn’t testify but instead avowed to a Lake investigator that she saw fellow employees bring in 50 early ballots of family members and illegally add them to the vote total. Lake lost to Gov.-elect Katie Hobbs by 17,117 votes.

    A partisan pollster calling himself the “People’s Pundit” – a guy whose polling firm, Big Data Poll, scored an F rating from the poll analysis website FiveThirtyEight – who did an exit poll of 813 Maricopa County voters and from that somehow concluded that 15,603 to 29,257 Lake supporters didn’t vote due to Election Day problems. “I believe it was substantial enough to change the leaderboard,” Rich Baris testified.

    Sworn declarations from 200 voters who said they were impacted by Election Day problems. But only three of them, according to the county, didn’t vote and that was their choice. Declining to wait in line or put your ballot in a secure box, to be counted later, is not evidence of disenfranchised voters.

    And finally, a cyber security expert who testified that the county’s printers were set up to spit out 19-inch ballots on 20-inch paper – ballots that then couldn’t be counted. Except, he conceded that they would have been counted. When a ballot can’t be read by a vote center tabulator, he acknowledged it’s sent to a bipartisan board of workers that transfers the voter’s choices onto a fresh ballot so it can be tabulated.

Printer problem was a snafu, not a scheme

Scott Jarrett, the county’s co-elections director, testified on Thursday that temporary technicians dispatched on Election Day to troubleshoot problems in three vote centers accidently set the printers to shrink-to-fit, causing the vote center tabulators to reject them.

What he described was a snafu, not a scheme.

But Lake’s expert, Clay Parikh, said those 19-inch ballots turned up in ballots he inspected earlier this week from all six vote centers and thus it “could not be by accident.”

Ipso facto, a conspiracy-o.

Who knows? Maybe it would have worked in fantasyland. But here in Maricopa County, there are those bipartisan boards that make sure such ballots count. So even if there was a plot (doubtful), it was foiled when those votes were ultimately counted.

Only don’t tell Lake that. Her campaign’s Twitter account has been on fire the last two days, putting its own rather remarkable spin on trial testimony (along with regular pleas for donations). Like this fictionalized blockbuster:

“Elections director Scott Jarrett confirms that the printer setting change that led to the mass disenfranchisement of Arizona voters DID occur the morning of election day,” the Kari Lake War Room tweeted.

Judge should sanction Kari Lake for this


As for the always-aggrieved Lake, forever playing to the court of public opinion, she predictably claimed victory upon leaving the courthouse on Thursday afternoon.

“We proved without a shadow of a doubt that there was malicious intent that caused disruptions so great it changed the results of the election,” she told reporters.

Something was proved without a shadow of doubt, all right. And it should be followed up with sanctions, as a warning to candidates that they’d better come to court armed with something more than sour grapes if they want to overturn the results of an election.

If Lake had proof of a county plot to deny her her due, it certainly wasn’t offered up this week.

Opinion, speculation and outright wishful thinking? Yeah.

But actual evidence in a courtroom? No.

A legal group plans to file bar complaints Thursday against four lawyers representing Kari Lake in voter fraud litigation, NBC News has learned.

Lake, a Donald Trump acolyte who has refused to accept that she lost the governor’s race in Arizona last year, campaigned on the voter fraud claims first popularized by the former president. She filed lawsuits before and after the election advancing the claims, despite having no clear evidence of election fraud.

A federal judge has already sanctioned her lawyers for their efforts, but they could face suspensions or even disbarment.

The 65 Project, a group targeting attorneys who advance spurious election fraud claims in court, said they are filing bar complaints in Minnesota and Maryland against attorneys Jesse Kibort, Joseph Pull and Andrew Parker, who are licensed to practice law in Minnesota, and Kurt Olsen, who is licensed in Maryland. They did not immediately respond to a request for comment.

The four lawyers represented Lake and Mark Finchem, then a Republican candidate for secretary of state in Arizona, in a lawsuit first filed in April challenging the use of electronic voting machines. Lake and Finchem claimed the devices could not be trusted.

“This was [a] pre-planned, orchestrated effort to disrupt Arizona’s election even before it began and claim that there was fraud,” said Michael Teter, the managing director of The 65 Project.

Over the last year, The 65 Project has filed dozens of complaints against attorneys — including one against former Trump attorney Alan Dershowitz, who is also listed as an attorney in the Lake suit. The group is a bipartisan nonprofit organization with ties to prominent Democrats; David Brock, a left-wing operative, is an adviser. Teter said the group was named for the number of lawsuits that were filed seeking to overturn the 2020 election.

He said that he hopes the complaints will result in suspensions or disbarment for Lake's attorneys and that the group’s work will continue to deter future election fraud litigation.

“We saw hundreds of election deniers across the country run and lose, and yet very few of them were bringing lawsuits in the aftermath of their losses," he said. "I think that’s partly attributable to our efforts in 2020."

In December, Lake said she had found it difficult to find legal representatives.

“We had attorneys who did walk away because the left is threatening them with their ability to make a living and practice law,” she said. “And some of our attorneys said, ‘Look, I got mouths to feed, I can’t do this case, I don’t want to be sanctioned.’”

She continued: “I got to a point where I said: ‘I’ll take anybody. We’ll take Better Call Saul to come in here.’”

“The evidence presented to the superior court ultimately supports the court’s conclusion that voters were able to cast their ballots, that votes were counted correctly, and that no other basis justifies setting aside the election results,” Judge Kent Cattani wrote, in affirming that Gov. Katie Hobbs is, in fact, GOV. Katie Hobbs.

I’d like to say that the ruling of the three-judge appellate panel – which followed the ruling of a Maricopa County Superior Court judge, which followed a two-day bench trial – would put an end to the incessant moaning and groaning and stamping of feet and outright slander of a good and decent state.

But, of course, Lake has already vowed to appeal. Of course, she will, if only to keep the rubes sending in those donations to her nonprofit – the one she claims is all about saving Arizona but I suspect is more about building her bank account and keeping herself politically relevant.

And so, Lake lost. Again.

“Voters were able to cast their ballots ... ,” the appellate judges wrote. “Votes were counted correctly.”

After 100 days of stomping her foot and spreading disinformation and running around the country defaming the state’s election workers, I’d like to think the perpetually aggrieved Lake would just stop.
