Title: Palin about to get yanked back to Alaska to face the Subpoenas?? LOL
Post by: Busted on October 04, 2008, 01:20:26 AM
After Ignoring Legal Subpoenas, and trying to shield her emails by calling executive privlidge seems the Alaska Courts are fed up with Palins "Cheney-esk" Behavior...

Judge Peter Michalski threw out the lawsuit filed by five Republican state legislators who said the investigation had been tainted by partisan politics and was being manipulated to damage Palin shortly before the Nov. 4 presidential election. "It is legitimately within the scope of the legislature's investigatory power to inquire into the circumstances surrounding the termination (of) a public officer the legislature had previously confirmed," the judge wrote in his decision.

In the ruling, released minutes before Palin and Sen. Joe Biden faced off in a debate in St. Louis, Michalski agreed with defense attorney Peter Maassen, who argued that the Legislature has the authority to investigate the governor as it sees fit.

"He agreed with us on pretty much everything," Maassen said of the judge's ruling. "The separation of power principles that governed this case seemed pretty clear."

Maassen represents the Legislative Council, 10 Republicans and 4 Democrats who authorized the investigation, and others involved in the probe.

Johanathan Turley Constitutional Law Professor George Washington Law School:

"Governor Palin is refusing to comply to a subpoenas issues by her state legislature, a court just shortly before the debate said is a valid exercise of the legislative branch in her state, she has simply refused to comply and neither has her husband who holds no public office.  I know of no case in the history of this republic where a Presidential or Vice Presidential candidate has sought the office while refusing to reply to a constitutional issued subpoena, its a very frightful thing, Governor Palin will have to deal with this and a Judge has no ruled that is a legal subpoena and must comply."

ABOUT FUCKING TIME... COACH??? ANY OTHER RIGHT WINGERS GOING TO STICK UP FOR HER NOW???

She fired someone for personal reasons... Because he wouldnt fire her ex brother in law who was a state trooper.  He cant just fire a state trooper becasue the Governor said to with out a legal reason to. Thats abuse of power and is a crime.  That is enough to get impeached and removed from her office.  And when you have 10 republicans and 4 democrats voting 14/0 you have a serious problem.  Commission Montagen was one of the most respected men in Gov in Alaska for 35 years.  THis bitch comes in and fires him because he wouldnst fire him? Then her and her husband ignore subpoenas?  If you or I did that wed be in Jail.... Now that a Judge ruled it is a Legal Subpoena and the legislative branch has the constitutional right, shes gonna have to get back.

Yep, they didnt haul bill Clinton in for geting his dick sucked did they?  If a SITTING president has to comply with subpoenas, she will too. McCains lawyers tried blocking it, but the judge shut them down 2 days ago.

That former commisioner stated that Palin never ordered him to fire that trooper, Mike Wooten. He simply believes that's why Palin canned him.

Then, there are the e-mails in which the reason for his dismissal are clearly worded.

I supposed the getting drunk on duty, illegally shooting moose, and tasing a 10-year-old should be left out of the picture.  ::)

And, notwithstanding that your charges of Palin's sister being a "whore" appear grossly unsubstantiated, how "juvenile" would you get, if a man was abusing your sister?

They have evidence of over 20 calls from her office, her, staff all pressuring him.  They even have one of the conversations Voice recorded. One of her staff members testified he never made any calls and then they pressed play of his conversation... PWNED...

First she said she fired him becasue he wasnt stopping alcohol bootlegging and the drinking problem, but the problem with that 2 weeks before she promoted him to a Director Position (forgot the exact name)over seeing that problem he has been doing so well about. so thats a LIE.

Then she recently said she fired him becasue he took a trip to Washington with out her permission.  But, every commissioner takes trips to DC several times a year, AND her chief of staff signed off on it... so PWNED once again...

Now the Drunk on Duty, Illegally shooting moose and tazing a 10 year old, she brought these claims to the commissioner and he said "bring me evidence, i cant fire someone just because you make claims, and if these claims are facts, why were they never reported? Why is she making these claims YEARS later?"

Pressure to do what? Monegan stated that Palin never ordered him to fire Wooten. He merely stated that he believes that's why he got canned, which sounds more like a disgruntled former employee. Calls wondering why Wooten wasn't fired and an order to "Fire him or you're fired!" are two different items.

As for the taped conversation, the man in question, Frank Bailey, made that call OF HIS OWN ACCORD, not on behalf of the Palins, as Bailey stated himself.

As for Wooten himself, he ADMITTED that he tased the step-son, claiming that the boy asked for it and that the taser gun has a training cartridge (which he used for less than a second). Wooten also admitted for shooting a moose illegaly. He denies the drunk driving and the alleged death threats to Palin's father.

The Washington Post Misreports "Troopergate" Again
In his latest story on the so-called "Troopergate" scandal (background here), the Washington Post's James V. Grimaldi reports a false statement made by state trooper Mike Wooten, Sarah Palin's ex-brother-in-law, as if it were a fact. Grimaldi writes that Wooten "contradicted Palin's statement that she overheard him in 2005 threaten her father during an argument with Palin's younger sister, Molly McCann, Wooten's wife at the time. Wooten noted that an internal investigation failed to sustain the death-threat allegation."

But according to the Anchorage Daily News, the internal investigation did sustain the death-threat allegation:

Troopers eventually investigated 13 issues and found four in which Wooten violated policy or broke the law or both:

• Wooten used a Taser on his [10 year-old] stepson.

• He illegally shot a moose.

• He drank beer in his patrol car on one occasion.

• He told others his father-in-law would "eat a f'ing lead bullet" if he helped his daughter get an attorney for the divorce.

Wooten released to the ADN all 482 pages of documents compiled from this investigation. Here is the section of the state troopers' "memorandum of findings" in which the death threat charge is found to be "sustained":

Molly McCann, Sarah Palin and Track Palin allege that on February 17, 2005, Investigator Wooten made a comment to Molly McCann that he would shoot her father if he hired a Iawyer for her. McCann advised that Investigator Wooten made this comment to her, and that Sarah and Track Palin who were listening over an open telephone line overheard it. Investigator Wooten was questioned about the comment and denied ever making the statement. Although McCann, Sarah Palin and Track Palin all recalled hearing the statement, a statement 'or implied threat to a non-present third party is not a crime. Although McCann and Sarah Palin felt that their father's life was in danger by the statement, neither mentioned the threat to their father for several weeks. Nevertheless, a statement of this sort by a trooper reflects badly on AST.
OPM 101.070 (A) Unbecoming Conduct Sustained
OPM 101,070 (B) Personal Conduct Sustained
OPM 101.Q70 (C) Conformance to Laws Not Sustained

The state troopers interviewed Palin, her son, and her sister separately and came to the conclusion that the death threat charge was "sustained". The Anchorage Daily News's Lisa Demer reported:

Wooten told troopers he never said anything like that about his father-in-law.

The investigation concluded he did. It wasn't a crime, because he didn't threaten [Gov. Palin's father] Heath directly. But it did violate trooper policy, the investigation found.

So why did the Washington Post's Grimaldi report that "Wooten noted that an internal investigation failed to sustain the death-threat allegation"? Shouldn't Grimaldi - a Pulitzer winning reporter - independently evaluate the accuracy of Wooten's statements?

This isn't the first time that Grimaldi has reported untrue statements under the cover of quoting Palin's opponents. On August 30, he and and a co-author wrote that Wooten's union boss, John Cyr, "said Wooten has 'a spotless record' and no allegations in his file other than those filed by the governor's family." But according to the Anchorage Daily News, "Beyond the investigation sparked by the family, trooper commanders saw cause to discipline or give written instructions to correct Wooten seven times since he joined the force."

Calls wondering why Wooten wasn't fired and an order to "Fire him or you're fired!" are two different items.  Well getting pressure for over a year from Palin, her HUSBAND, and her staff, they were calling HIS STAFF asking why Wooten was still an employee and the governor thinks he is not a good rep of Alaska Troopers... Shes going down for it... Just face it... YOU cant fire a LEGISLATIVE PASSED employee for personal reasons... She gave 3 different reasons why she fired him and all 3 turned out to be lies. She is trying to cry Exec Priveledge so her incriminating emails between employees are not found... (the word is 3 of her employees that did give statements hinted that)

As for the taped conversation, the man in question, Frank Bailey, made that call OF HIS OWN ACCORD, not on behalf of the Palins, as Bailey stated himself.  Did you hear it? He called from a State paid phone line to another state employee on their office line... he referred to the Gov and her husband several times... Did you hear it? It was on national news...

Palin promised to cooperate with the investigation since she had nothing to hide, as soon as mcCain named her, and subpoenas came out, she wont cooperate now... this is a REFORMER wanting to get rid of dishonesty and corruption? LMAO

\-Palin, First Dude and her staff contacted him over 20 times about Wooten.
-She started calling him about Wooten as soon as she got into office in 97

Palin wont cooperate now since "democrats are playing politics" even tho its 10 republicans and 4 democrats in the senate that are investigating her...
