Yes, the crux of this win is that the FDA seized it improperly and doesn't have the right to retain it. But they still haven't ruled whether it can be offered for sale. The FDA hasn't commented, but the Hi-Tech statement was just a long winded "we got our stuff back".
DMAA is still a grey area where you can own it, but the FDA still contends that it is unsafe, and won't allow it for sale in products.
