nope, being on top does not mean he was the aggressor, the instigator or started/escalated the confrontation and there was no proof presented in court that he was the aggressor

we DO know that trayvon was running away while Zimmerman was pursuing him while packing a heat.  Violating neighbohood watch rules, meaning he sure wasn't working under that umbrella.  He was just a concerned dude chasing a kid with a gun thru a rainy night.
