Unless they're charged with a drug or tax evasion crime, I don't think asset seizure can come into play here. They could arrange to have their lawyer sell the house to pay their legal fees, though (and because they couldn't keep up with any mortgage payments they may have from jail). It wouldn't be an auction, though.

Last I checked, both Kelly and Craig owned their property, their houses, etc. They both have power of attorneys looking into everything for them, and makng sure they still get whatever was promised for them regarding their contracts, the rental properties, and anything else.
Of course, they will need money to pay for the cost of the trails, thus things may need to be put on the market eventually, as the houses they purchased have significantly gone up in value.
There is no government auction.

Though, I wonder if Pinnacle missed the mark in capitalizing on a theme sponsorship...
They could have gotten permission to do a special booth with an "Old ghost town jail" setting.. from FEDS. C&K could be in leg irons, dressed up in that same prairie gear that David Paul shot them in.. and create a kind of mis-en-scene for their fans.
