For the most part, yes.  A friend of my dad's has been drinking and driving his whole life.  He will be 76 in June.  I would drive in his car ANY time he has drank over many people I know who are driving perfectly sober.  It is possible to drive tired, drive impaired, drive while speaking on a cell phone, etc, especially if you are used to it (conditioned for the task).  Now I'm not saying it's a wise idea or that this applies to the norm, just saying it is possible. 

Why add any possible risk to ending human life that is neccessary? Libertarian surely must have it 's limits?

Make the same statement after someone you love is killed or seriously injured by a person on a cell phone. Statistics overwhelmingly prove your statement way off-base EVEN with hands free devices. According to a Harvard University study, cell phones cause over 200 deaths and half a million injuries each year.

Try watching someone you love be confined to a nursing home bed for four months because some stupid wench had to make a call.

How many accidents did he cause OTHER people to have. Your argument is absolutely asinine. Try doing a google search on “cell phone driving accidents” and prepare to be overwhelmed with evidence that proves your wrong on this.
