WASHINGTON (AP) - The Obama administration reversed itself Thursday, acknowledging to Congress that it had, in fact, released more than 2,000 illegal immigrants from immigration jails due to budget constraints during three weeks in February.
 
The director of U.S. Immigrations and Customs Enforcement, John Morton, said his agency had released 2,228 illegal immigrants during that period for what he called "solely budgetary reasons." The figure was significantly higher than the "few hundred" immigrants the Obama administration had publicly acknowledged were released under the budget-savings process. He testified during a hearing by a House appropriations subcommittee.

Morton told lawmakers Thursday that the decision to release the immigrants was not discussed in advance with political appointees, including those in the White House or Homeland Security Secretary Janet Napolitano. He said the pending automatic cuts known as sequestration was "driving in the background."
 


"We were trying to live within the budget that Congress had provided us," Morton told lawmakers. "This was not a White House call. I take full responsibility."
 
The Associated Press, citing internal budget documents, reported exclusively on March 1 that the administration had released more than 2,000 illegal immigrants since Feb. 15 and planned to release 3,000 more in March due to looming budget cuts, but Napolitano said days later that the AP's report was "not really accurate" and that the story had developed "its own mythology."
 
"Several hundred are related to sequester, but it wasn't thousands," Napolitano said March 4 at a Politico-sponsored event.

On March 5, the House Judiciary Committee publicly released an internal ICE document that it said described the agency's plans to release thousands of illegal immigrants before March 31. The document was among those reviewed by the AP for its story days earlier.
 
The immigrants who were released still eventually face deportation and are required to appear for upcoming court hearings. But they are no longer confined in immigration jails, where advocacy experts say they cost about $164 per day per person. Immigrants who are granted supervised release - with conditions that can include mandatory check-ins, home visits and GPS devices - cost the government from 30 cents to $14 a day, according to the National Immigration Forum, a group that advocates on behalf of immigrants.

Morton said Thursday that among the immigrants released were 10 people considered the highest level of offender. Morton said that although that category of offender can include people convicted of aggravated felonies, many of the people released were facing financial crimes. Four of the most serious offenders have been put back in detention. Other people released include immigrants who had faced multiple drunken driving offenses, misdemeanor crimes and traffic offenses, Morton said.
 
After the administration challenged the AP's reporting, ICE said it didn't know how many people had been released for budget reasons but would review its records.

The Obama administration is demanding the nation’s two biggest shipping companies police the contents of Americans’ sealed packages, and a FedEx spokesman is warning that the move “has the potential to threaten the privacy of all customers that send or receive packages.”

FedEx and UPS are in the Justice Department’s cross-hairs for not flagging shipments of illegally prescribed drugs the companies say they had no way of knowing were in their possession.

Criminal charges could be coming against the carriers, even though the government has not alleged any deliberate wrongdoing by the companies.

FedEx spokesman Patrick Fitzgerald said his company has a 40-year history of actively assisting the government crackdown on any criminal conduct, but he told WND this probe was very different from the start.

“What is unusual and really disturbing is it became clear to us along the way that FedEx was being targeted for some level criminal activity as it relates to these medicines that are being shipped from pharmacies, and we find it to be completely absurd because it’s really not our role,” Fitzgerald said. “We have no way of knowing what is legal and not within the packages that we’re picking up and delivering in this situation.”

“At the heart of the investigation are sealed packages that are being sent by, as far as we can tell, licensed pharmacies. These are medicines with legal prescriptions written by licensed physicians. So it’s difficult for us to understand where we would have some role in this. We are a transportation company that picks up and delivers close to 10 million packages every day. They are sealed packages, so we have no way of knowing specifically what’s inside and we have no interest in violating the privacy rights of our customers,” Fitzgerald said.

In addition to the unrealistic expectation that the federal government seems to have for the companies to know what’s in every package, Fitzgerald said protecting the rights of customers is paramount and the issues go hand-in-hand.

“They clearly are attempting to put some responsibility for the legality of the contents of these packages. That’s why for us it goes far beyond even just the online pharmacy situation. This really has a chilling effect. It has the potential to threaten the privacy of all customers that send or receive packages via FedEx because the government is assigning a role on us as law enforcement or taking on their role in a way that is not appropriate,” Fitzgerald said.

FedEx sought to diffuse the standoff by offering to stop doing business with any pharmacies that the government suspected to be involved in illegal activities. The Justice Department declined, citing the potential for the pharmacies to sue over a lack of due process.

“If the government were to come to us and give us the name of a customer that’s engaged in some level of illegal activity, we can immediately stop shipping for that customer. We will not tolerate any illegal activity within our networks,” Fitzgerald said. “What we want here is a solution that will apply for the entire industry and serve the public’s interest. That’s why we find it completely absurd and, to a large degree, stunning that the government is not working with us on that solution as they have with other problems in the past. As long as they’re not doing that, there’s really no solution even if they were to pursue an investigation or criminal charges against a specific company. There needs to be an industry-wide solution that will put a stop to this problem.”

That leaves FedEx and UPS with the task of stopping illegal shipments from sources the government will not divulge.

“The comparison that we’ve made is a no-fly list. It’s as if the government were to go to major commercial airlines and accuse them of some level of criminal activity if they were to allow somebody on the no-fly list onto one of their planes without providing them a no-fly list,” Fitzgerald said. “What we want here is the no-fly list for online pharmacies. If they are aware of some level of illegal activity by some number of pharmacies, simply provide us that list and we will stop providing service. It’s a very simple solution.”

Fitzpatrick said no other private carriers are being targeted by the Justice Department, and he has no evidence to suggest this probe is designed to boost the financially strapped U.S. Postal Service at the expense of private competitors.

UPS is currently negotiating a settlement with the government, but FedEx is fighting this all the way.

“Settlement is not an option for us when there’s no illegal activity on our part,” Fitzpatrick said.

Miracles Take Time

Barack Obama has only been president for six weeks, but there is a surprising amount of ire, anger, even outrage that he hasn’t yet solved the problems of the U.S. economy, that he hasn’t saved us from the increasingly tragic devastation wrought by the clownish ideas of right-wing conservatives and the many long years of radical Republican misrule.

This intense, impatient, often self-righteous, frequently wrongheaded and at times willfully destructive criticism has come in waves, and not just from the right. Mr. Obama is as legitimate a target for criticism as any president. But there is a weird hysterical quality to some of the recent attacks that suggests an underlying fear or barely suppressed rage. It’s a quality that seems not just unhelpful but unhealthy.

Mr. Obama is being hammered — depending on the point of view of the critics — for the continuing collapse of the stock market, for not moving fast enough to revive the suicidal financial industry, for trying to stem the flood tide of home foreclosures, for trying to bring health insurance coverage to some of the millions of Americans who don’t have any, for running up huge budget deficits as he tries to fend off the worst economic emergency since World War II and for not taking time out from all of the above to deal with — get this — earmarks.

Earmarks.

More than 4.4 million jobs have been lost since this monster recession officially got under way in December 2007, and we’ve got people wigging out over earmarks. Folks, get a grip. Some earmarks are good, some are not, but collectively they account for a tiny, tiny portion of the national budget — less than 1 percent.

Freaking out over earmarks is like watching a neighborhood that is being consumed by flames and complaining that there is crabgrass on some of the lawns.


In the midst of the craziness, conservatives are busy trying to blame this epic economic catastrophe — a conflagration of their own making — on the new president. Forget Ronald Reagan and George Herbert Walker Bush and George Herbert Hoover Bush and the Heritage Foundation and the Club for Growth and Phil Gramm and Newt Gingrich and all the rest. The right-wingers would have you believe this is Obama’s downturn.

The bear market would no doubt have magically turned around by now, and those failing geniuses at the helm of our flat-lined megacorporations would no doubt be busy manufacturing new profits and putting people back to work — if only Mr. Obama had solved the banking crisis, had lowered taxes on the rich, had refused to consider running up those giant deficits (a difficult thing to do at the same time that you are saving banks and lowering taxes), and had abandoned any inclination that he might have had to reform health care and make it a little easier for ordinary American kids to get a better education.

As the columnist Charles Krauthammer was kind enough to inform us: “The markets’ recent precipitous decline is a reaction not just to the absence of any plausible bank rescue plan, but also to the suspicion that Obama sees the continuing financial crisis as usefully creating the psychological conditions — the sense of crisis bordering on fear-itself panic — for enacting his ‘big-bang’ agenda to federalize and/or socialize health care, education and energy, the commanding heights of post-industrial society.”

That’s a more genteel version of the sentiment expressed a couple of weeks ago by the perpetually hysterical Alan Keyes, a Republican who was beaten by Mr. Obama in the Illinois Senate race in 2004. “Obama is a radical communist,” said Mr. Keyes, “and I think it is becoming clear. That is what I told people in Illinois, and now everybody realizes it’s true.”

I don’t know whether President Obama’s ultimate rescue plan for the financial industry will work. He is a thoughtful man running a thoughtful administration and the plan, a staggeringly complex and difficult work in progress, hasn’t been revealed yet.

What I know is that the renegade clowns who ruined this economy, the Republican right in alliance with big business and a fair number of feckless Democrats — all working in opposition to the interests of working families — have no credible basis for waging war against serious efforts to get us out of their mess.


Maybe the markets are down because demand has dried up, because many of the nation’s biggest firms have imploded and because Americans are losing their jobs and their homes by the millions. Maybe a dose of reality is in order, as opposed to the childish desire for yet another stock market bubble.

Maybe the nuns in grammar school were right when they counseled that patience is a virtue. The man has been president for six weeks.

Family Research Council (FRC) officials released video of federal investigators questioning convicted domestic terrorist Floyd Lee Corkins II, who explained that he attacked the group’s headquarters because the Southern Poverty Law Center (SPLC) identified them as a “hate group” due to their traditional marriage views.
 
“Southern Poverty Law lists anti-gay groups,” Corkins tells interrogators in the video, which FRC obtained from the FBI. “I found them online, did a little research, went to the website, stuff like that.”
 
The Washington Examiner’s Paul Bedard reported that Corkins, who pleaded guilty to terrorism charges, said in court that he hoped to “kill as many as possible and smear the Chick-Fil-A sandwiches in victims’ faces, and kill the guard.” As Bedard explained, “the shooting occurred after an executive with Chick-Fil-A announced his support for traditional marriage, angering same-sex marriage proponents.”

The Southern Poverty Law Center still lists FRC as an “anti-gay” hate group on the “hate map” Corkins used. “The SPLC’s reckless labeling has led to devastating consequences,” said FRC President Tony Perkins.  “Because of its ‘hate group’ lists, a deadly terrorist had a guidemap to FRC and other organizations.  Our staff is still reeling from the attack, and the chilling effect this could have on organizations that are simply fighting for their values is outragEous.”
