The girl was a dumb dumb for putting herself in the position she did and by continuing to make it worse and worse. That said, however, the cop had no business punching her in the head like she was some 250 lb guy on bath salts refusing to comply and being aggressive. Just my 2 cents.

as a french cop it seems completely absurd to me to "breathalyze" a people sitting on the beach. It's even more absurd to punch a 100lbs girl who can be handcuffed by an average man. I'll be fired for something like that. I remember when i was in L.A in a private residence, a guy was drinking a beer at the pool, security came from nowhere, took pic of the bottle of beer, and gave him a 300 dollars fine.

Cool, people who insist on drinking from glass around a public pool are selfish pricks. Glad to see the complex enforcing what was likely a rule posted at the entrance and around the pool.

Cops were in the wrong, imo. Maybe not legally, but she was coherent, made good points, passed the tests perfectly fine, etc. and didn't do anything until the main cop started messing with her then she kind of panicked. They should have just had them close up the alcohol and see if it was the aunts and go from there.

Did not need to escalate like that at all. Was expecting her to be a complete jerk/disobedient but did not start out that way.

If caught, the individual can be charged with a disorderly person's offense. Doesn't matter if it is closed or not. Doesn't matter if she has 1 or 4 kids. The video shows a bottle of an alcoholic beverage on the blanket she was sitting on. She was NOT tricked into giving a breath sample.

I gather that she passed the breathalizer test. At that point the officer asks about an adult as she is not supposed to be in possession of the alcohol and he asks for identification, possibly to write a ticket for the offense. At that point had the chick complied we wouldn't be talking about it. She didn't and started becoming agitated and non compliant. Totally agree hitting her in the head twice was unnecessary and ill advised. So was her resisting. From recent articles the officer appears to be a temporary officer hired for that function at the beach.  I don't think there is an option for suspending a temp officer, likely he won't be hired again for the next function and if he was hoping to get hired full time, probably won't. As far as your cop friends asking that question, it probably means they didn't have all the information and those cops were hired and tasked with doing exactly this, enforcing underage drinking laws on the beach so the full time officers could focus on the bigger issues

From the video we saw and the cop asking questions, she did not say it was her Twisted Tea's. She was with a group of people there, including her aunt, who is over 21, and a toddler.  Basically you are saying that if you are sitting down on the beach, a cop can arrest you because someone has some alcohol there.  It will come out that it was her aunt's and not hers and the cop didnt care nor cared to ask more info.  The cop did NOT tell her she can refuse to take the breathalizer test because if it wasnt her bottles, there was no crime. He said 'Do me a favor'.... really.  The cop clearly said he was going to 'take her down'.  Really.  And I think you are right, this was the first weekend for this 'summer cops'. Bottom line, this cop was wrong, they will get sued, and the taxpayers will pay out a lot of money for this.  He was harassing her, she passed the test with NO alcohol whatsoever, twice is seems like.  Once was enough. Clear case of harassment, and lack of training by the police department on this guy. But the final straw was the punches.  He clear was a bad summer cop on a power kick, and with the people on the beach saying the same thing, he is done for.

You know, take care of the problems on the beaches by the people freaking smoking, having guns, being dangerous - not a mom sitting there watching her toddler.
