Bail denied for bodybuilders in Las Vegas slaying

LAS VEGAS -- Professional bodybuilders Craig Titus and Kelly Ryan will remain in a Nevada jail at least until the end of March, when the state is due to present preliminary evidence that they drugged, killed and burned the body of their live-in personal assistant.

"The defendants will continue to be held without bail," Las Vegas Justice of the Peace Joe M. Bonaventure said Friday as he rejected Titus' and Ryan's lawyers' arguments that the married couple, who were arrested Dec. 23 near Boston, posed no flight risk.

Lawyers for Titus, 41, and Ryan, 33, maintain that their husband-and-wife clients aren't guilty and were entitled to bail because the state had not presented enough evidence that a murder had been committed.

"They don't even have an autopsy that establishes a cause of death," Ryan's lawyer, Tom Pitaro, said.

The judge said he would reconsider his ruling after a March 29 hearing at which prosecutors will seek to have Titus and Ryan bound over for trial on felony murder, kidnapping and arson charges.

Prosecutor Robert Daskas has called it premature to say whether the state will seek the death penalty.

Titus is a 1996 bodybuilding champion and Mr. Olympia competitor. Ryan is a past Fitness America and Fitness International winner.

They are accused of using a Taser stun gun, administering morphine or a related drug, and asphyxiating or suffocating Melissa James, a 28-year-old former fitness instructor who moved last year from Lambertville, N.J., to live with the couple.

James' charred body was found Dec. 14 in the trunk of Ryan's burned-out Jaguar sedan off a desert highway with what authorities described as a fabric or wire around her neck.

That same day, Titus told Las Vegas police he'd had an affair with James. By the time police obtained arrest warrants Dec. 20, Titus and Ryan had left the state.

They were arrested Dec. 23 at a nail salon in Stoughton, Mass., and gave statements to authorities that Daskas said included admissions that they doused James' body with a flammable liquid, drove it to the desert and set it afire.

Bonaventure did not rule Friday on a request from defense lawyers to suppress those statements.

An alleged accomplice, Anthony Gross, 23, has pleaded not guilty to accessory to murder and third-degree arson charges. He is accused of buying gasoline for Titus, who allegedly drove the Jaguar to a remote spot off a desert highway and set it afire. Gross remains under house arrest after posting $13,000 bail.

On Friday, Titus and Ryan, wearing blue cotton jail uniforms, sat separated by their lawyers with a jail guard behind their chairs. They said nothing during the hearing.

Titus' lawyer, Richard Schonfeld, complained that Titus was being kept in isolation at the Clark County jail - a procedure authorities use to protect celebrity inmates.

They should have granted them bail.  Craig is no flight risk, he's too f-ing stupid to get out of the country.

So, what were they doing in Boston in a trade-in vehicle? Looking for the best nail salon in North America?
They have already flown the coop, so he was a flight risk and IS a flight risk.

Craig Titus may be an intimidating mass of muscle and a past Mr. Olympia place winner, but in court Friday the bodybuilder sobbed at the sight of his wife, Kelly Ryan.

Titus and Ryan were in the courtroom of Justice of the Peace Joe M. Bonaventure for a bail hearing on charges they murdered their personal assistant, Melissa James.

Shortly before the hearing began, Titus was seen dabbing tears and choking back sobs upon the arrival of Ryan.

During the subsequent hearing, Clark County Prosecutor Robert Daskas described as "overwhelming" the evidence against the fitness couple in the death of James.

"They had motive to kill Melissa James," Daskas said. "They believed, rightly or wrongly, that Melissa James had stolen from them -- assumed their identities and stolen from them."

Daskas said an autopsy revealed James had morphine in her system, a detail that had not been disclosed before Friday's hearing.

He said the morphine in her system supports the prosecution's belief that Titus and Ryan drugged James, used a Taser gun on her, killed her, then torched her body in the trunk of Ryan's car, which was found in the desert on Dec. 14.

"There were levels of morphine in her system consistent with the way we've charged the case," Daskas said.

He then went on to question Titus' character.

He pointed out that after James' body was found, but before the victim's identification had been officially confirmed by police through DNA analysis, Titus talked to James' mother, Maura James, on the phone. During the conversation, Titus tried to convince Maura James that the body found in the car was not her daughter's.

"Titus expressed to Maura James ... that that was not Melissa James in the trunk of the car," Daskas said. "It gave Maura James a glimmer of hope.

"He even said he had a friend who'd spoken to Melissa James on the phone ... again giving Maura James a glimmer of hope," Daskas said.

Daskas said Titus also told Maura James he believed "Melissa staged this whole thing so she could assume a new identity."

"What does that say about Craig Titus' characterá" Daskas asked.

Authorities said the charred body of Melissa James, 28, was found in the back of Ryan's car off state Route 160 on Dec. 14. James was the couple's live-in assistant. Police said when they questioned Titus and Ryan about the matter, the two repeatedly lied about the circumstances of James' disappearance.

A friend of the couple, Anthony R. Gross, 23, is charged with arson and being an accessory to murder because, authorities say, he helped Ryan and Titus dispose of the body.

Titus told police he was having an affair with James and that his wife did not know about the affair, according to a police report.

Titus and Ryan later told police they had discovered James was stealing from them and kicked her out of their house in southwest Las Vegas, the report said. They also alleged that James had stolen Ryan's car, but neither allegation was reported to police until after James' body was found, the report said.

Police have obtained video surveillance footage showing Ryan buying several large bottles of lighter fluid at a Wal-Mart in northwest Las Vegas about 30 minutes before James' body was set on fire, according to a court motion.

Daskas said authorities believe Melissa James' body was in the trunk of Ryan's car at the time.

But Ryan's defense attorney, Tom Pitaro, and Titus' defense attorney, Richard Schonfeld, said the allegations against their clients are merely that, untested allegations.

Pitaro and Schonfeld both said that, in outlining a possible scenario for Melissa James' murder by Titus and Ryan, authorities are relying on statements from witnesses whose credibility will be brought into question.

"One (witness) said he was grateful Mr. Titus was arrested, because now he can steal his business," Schonfeld said. "One witness is a chronic marijuana smoker."

Schonfeld and Pitaro urged Bonaventure to set a reasonable bail for the couple, saying prosecutors really don't even know how Melissa James was killed, not to mention who did it.

"They've got more theories than you can shake a stick at," Pitaro said.

"For all the sound and fury (from prosecutors), it signifies nothing," he said.

Bonaventure said he will not issue a bail ruling until the pair's preliminary hearing, which is set for March 29.

That means Titus and Ryan will remain in custody until at least the date of the hearing.

Did any one realy think they would make bail after their little cross country jaunt prior to been captured, plus the fact they are not looking at any one elese in this case other than those they have in custody !!!!

He wasn't crying too much for Kelly over the years as he alienated her from her true friends, got her hooked on a variety of drugs, had her trolling strip clubs with him, advised her to get worked over by plastric surgeon after plastic surgeon, got her involved in scam after scam.....yes Craig's such a sensitive guy...boo fuckin' hoo

im sure kelly is a big girl and can make grownup desisions on her own.  she knows like everyone else that drugs are bad, and if her beliefs were against going to strip clubs then she would have made the choice not to be around that environment. also to add to that, if kelly found out that graig was into that kind of shit drugs,strip clubs etc, then she would have made another desision and that would have been divorce, separation etc....

have you ever been with a girl that's into muscle? a girl that is into specific looks that you only get after doing gear no matter if youre 200 pounds or 250 pounds its the same overall look... well the ugly wife was that typa girl. she adore us...those typa girls would do anything for us...they are all fake and they dont stop with muscle...it usually develop to bad boy with muscle kinda thing. and why are they like that? cuz of a mental problem! it all starts in the head...you cant stop it...it's something she used to do from young young age (15-16) she was adicted to muscle....from the highschool quarterback to the local chubby bouncer...to the local gym rat... to the murderer. it is what it is....brainless ugly wife.

Thank you very much.  I have been sick and tired of hearing what a great person Kelly is and what a great champ.  She has never been a great champ because being a champ is about how hard you work,,,,not how much you can improve through surgery.  Now I know, there is politics involved, and some drugs whatever. I am not debating all that stuff.  But Kelly is a grown woman who could have made better decisions but she did not.  She is just as much to blame as Craig.  A strong person, and a person that knows what is right and what is wrong would have left his ass years ago.
