The thing is, if Jason did want to press charges, he would probably have a case, especially since he has developmental delays.

A jury would see a juiced up Piani, and a developmentally delayed person (Jason). It wouldn't take too much convincing to convict Rich on assault charges.

If a lawyer puts an emphasis on Jason lacking cognitive skills (i.e., ability to make sound decisions), then the whole issue of Jason agreeing, is thrown out the window. Piani should have known better.

Its the same thing if you convince a 90 year old person with Alzheimers to give you money. Even if the elderly person agrees, it still may be deemed illegal  (the best analogy I can think of at the moment).
