NRA Will Sue Obama Administration Over New Gun-Control Measure

The National Rifle Association plans to sue the Obama administration over its new gun-reporting requirement in four states bordering Mexico.

On Monday, the Justice Department said it would require firearms dealers in Arizona, California, New Mexico, and Texas to report multiple sales of certain semi-automatic rifles to the same person within a five-day period. The goal is to stop the illegal flow of weapons to Mexican drug cartels, said Deputy Attorney General James Cole.

The new reporting requirement applies to semi-automatic rifles with detachable magazines and calibers greater than .22. Such weapons, Cole said, "are highly sought after by dangerous drug trafficiking organizations and frequently recovered at violent crime scenes near the Southwest Border."

NRA Executive Director Chris Cox called the reporting requirement "a blatant effort by the Obama administration and ATF to divert focus of Congress and the general public from their gross incompetence in the Fast and Furious scandal."

As CNSNews.com has reported, a House committee is investigating the Bureau of Alcohol, Tobacco, Firearms and Explosives for its botched gun-tracking operation in which the ATF -- evidently with the approval of Justice Department higher-ups -- allowed straw purchasers in the U.S. to send guns to Mexican criminals. Two of the guns sold as part of Operation Fast and Furious ended up at the Arizona crime scene where a U.S. Border Patrol agent was murdered in December.

Although ATF's goal was to track the guns, Rep. Darrell Issa, chairman of the House Oversight and Government Affairs Committee, said tracking devices were put on guns in only two instances.

Most of the tracking involved "a few hours of following the first car," Issa told Fox News. "In one case, he said, the ATF did track the guns with a GPS device "quite a ways into Mexico, but of course, they didn't inform the Mexican officials, and they didn't have a team on the other side of the border" to follow the signal, which "simply disappeared."

The NRA said the Justice Department's "scheme" will "unjustly burden law-abiding retailers in border states." Cox said the move will not affect drug cartels -- which are not deterred by paperwork violations -- and it won't prevent violence along the border.

"ATF and the Administration lack the statutory authority to do this, and the NRA will file suit as soon as ATF sends the first demand letters," Cox said in a statement posted on the NRA's Web site.

Rep. Lamar Smith (R-Texas) called the Justice Department's new reporting requirement "the height of hypocrisy," given that the administration "knowingly and intentionally allowed guns to be trafficked into Mexico."

"Limiting the Second Amendment rights of law-abiding citizens is not going to solve the problem," the Associated Press quoted Smith as saying.

Correct - obama's CYA over his failed F&F scam is going to get overrided as not applying equally to all the states.

U.S. Senate Stands with NRA in Strongly Opposing U.N Gun Control Efforts

For nearly 20 years, the NRA has worked tirelessly to oppose any United Nations effort to undermine the constitutional rights of law-abiding American gun owners.  The latest attempt by the U.N. and global gun banners to eliminate our Second Amendment freedoms is to include civilian arms in the current Arms Trade Treaty (ATT), which will be finalized next year.


In order for any treaty to take effect, however, it must be ratified by two-thirds of the U.S. Senate.   To ensure that any ATT that includes civilian arms is dead on arrival in the Senate, the NRA has been working to get as many U.S. Senators as possible to publicly oppose any ATT that includes restrictions on civilian arms.


As of this morning, 50 members of the U.S. Senate have signed letters to President Obama and Secretary of State Clinton saying they will oppose any ATT that includes civilian firearms ownership.  These strongly worded letters caution the President and Secretary of State to uphold the Constitution of the United States.  As Senator Jerry Moran's letter warns, “(A)s the treaty process continues, we strongly encourage your administration to uphold our constitutional protections of civilian firearms ownership.  These freedoms are non-negotiable, and we will oppose ratification of an Arms Trade Treaty presented to the Senate that in any way restricts the rights of law-abiding U.S. citizens to manufacture, assemble, possess, transfer or purchase firearms, ammunition and related items.”

Thanking the NRA for our long-standing work on this issue, Senator Moran remarked, "I appreciate the NRA's partnership on this important effort to defend the rights of American gun owners. I want to thank them for their active support in sending a strong message to the Obama Administration that our firearm freedoms are not negotiable."

As we have for nearly two decades, the NRA will continue to fight against any U.N. treaty that undermines the constitutional rights of American gun owners.  These letters send a clear message to the international bureaucrats who want to eliminate our fundamental, individual right to keep and bear arms.   Clearly, a U.N. ATT that includes civilian arms within its scope is not supported by the American people or their elected U.S. Senators.  We are grateful to Senator Moran, Senator Jon Tester, and all members of the Senate who have chosen to stand on the side of America's 80 million gun owners in opposition to those who want to eliminate our freedoms.  And thank you as well to those NRA members who contacted their Senators and encouraged them to support this critical effort.

For awhile now I’ve gotten e-mails from people concerned about Pres. Obama and this administration restricting gun rights. I honestly thought they were being a bit conspiratorial. That is, until I read this:

Twelve Democratic senators have joined 45 Republicans in a fast growing movement to halt progress on an Obama-backed United Nations effort that could bring international gun control into the United States and slap America’s gun owners with severe restrictions.

Montana Democratic Sen. Jon Tester’s office today provided Whispers with their letter, signed by 11 other Democrats, urging the president to press for significant changes in the treaty. Their major concern: that domestic manufacture, possession, and sales of firearms and ammo will be included, thereby giving an international authority the right to regulate arms sales already protected by the Second Amendment. They also said any move for an international gun registry would be a non-starter

When Democrats themselves are joining Republicans to defend our 2nd Amendment rights, you know you have something to worry about.

Speaking to La Raza the other day, Pres. Obama said, “I know some people want me to bypass Congress and change the laws on my own,” (to which the crowd changed “Yes you can!” (Scary, right?) Then Obama added, “Believe me, the idea of doing things on my own is very tempting.”

In this case, so tempting he decided that if he can’t change the laws here, he could just bypass them by an international treaty.

"Does the Second Amendment to the United States Constitution protect a right to possess and carry a firearm for self-defense outside the home?"

Two months from today the United States Supreme Court will meet in conference. If four justices vote to hear the case, that question will be answered by the High Court before the court adjourns next year, just in time for the Presidential election.

The irony is, it is a question the Obama administration might not have been faced with if it had chosen to drop the criminal prosecution of a man convicted of having a loaded gun in his possession in a National Park, something which is no longer a crime; at least not in the jurisdiction where he was convicted.*

Obama was a constitutional law professor before being elected to the United States Senate. He really should have seen this one coming from a mile away.

Following are a few brief excerpts from the 85 page Cert Petition prepared by Cloudigy Law PLLC. The article concludes with a caveat regarding carrying firearms in National Parks located in California and a short political analysis.

Sean Masciandaro is a law-abiding citizen who was found sleeping in his car with a loaded handgun in a bag in the trunk. He was sleeping in a parking lot on Daingerfield Island, which is National Park Service (“NPS”) land. Because of the loaded handgun in his car, he was convicted of violating 36 C.F.R. § 2.4(b) (2007),** which prohibits possession and carrying of loaded weapons in motor vehicles located on NPS land.

In a letter to President Obama and Secretary of State Hillary Clinton, 45 senators expressed their concern about the dangers posed to Second Amendment rights by the United Nations' Arms Trade Treaty. The senators stated their intention to oppose ratification of an Arms Trade Treaty that in any way restricts the rights of law-abiding American gun owners. "Our country's sovereignty and the rights of American citizens must not be infringed upon by the United Nations," said Sen. Jerry Moran (R-Kan.). "Today, the Senate sends a powerful message to the Obama Administration: an Arms Trade Treaty that does not protect ownership of civilian firearms will fail in the Senate. Our firearm freedoms are not negotiable."
