I've only seen clips and read about Neely's extensive criminal history.  Does not look like manslaughter to me.  Does the full video provide any better context?

Former US Marine to be charged in choking death on New York subway

NEW YORK, May 11 (Reuters) - A former U.S. Marine who killed a homeless man by putting him in a chokehold on the New York City subway will be arrested on Friday and arraigned on a charge of manslaughter, the Manhattan district attorney said on Thursday.

A viral video showed the former Marine, identified as Daniel Penny, putting 30-year-old Jordan Neely in a chokehold on May 1 while they rode on the F train in Manhattan. Neely died from a compression of the neck, the medical examiner said, but Penny's lawyers said he did not mean to kill him.

According to witnesses, Neely, who was known to impersonate Michael Jackson in the subway system, was complaining loudly about being hungry and saying he was ready to die when Penny came up behind him and gripped him around the neck. Penny restrained him on the floor of the subway car until he appeared to stop moving. Neely was later declared dead.

"We can confirm that Daniel Penny will be arrested on a charge of manslaughter in the second degree. We cannot provide any additional information until he has been arraigned in Manhattan Criminal Court, which we expect to take place tomorrow," Manhattan District Attorney Alvin Bragg said in a statement.

A bystander's video of Neely's death garnered national attention and revived a debate among New Yorkers about crime in the subway and what to do with a growing number of homeless people in the city.

The killing, and a delay by prosecutors in charging Penny, sparked protests, with some saying the incident amounted to a "lynching" and an example of "white vigilantism" against people of color. Neely was Black and Penny is white.

In a statement from his legal team, Penny expressed "condolences to those close to Mr. Neely." The statement alleged that Neely had aggressively threatened passengers riding in the subway car.

"Daniel never intended to harm Mr. Neely and could not have foreseen his untimely death," the statement said.

Penny's attorneys, Steven Raiser and Thomas Kenniff, did not immediately respond to a request for comment.

An attorney for Neely's family said in a statement on Monday that Penny's actions on the train and his words show that "he needs to be in prison."

A spate of attacks on train passengers last year, particularly Asian Americans, prompted Adams to increase police patrols and expand outreach to the mentally ill in the subway system, citing rising homelessness in the wake of the pandemic.

The video that circulated on social media after Neely's death showed a man identified as Penny applying a chokehold to a man identified as Neely for more than three minutes. Two other men are seen in the video restraining Neely's arms before he went limp.

Reuters could not verify the authenticity of the video.

Former New York Gov. David Paterson, a Democrat, came out in support of Daniel Penny, the hero marine who protected others from a violent, longtime criminal on the New York subway earlier this month, which Townhall covered.

To recap, Penny, 24, put Jordan Neely in a chokehold on the subway to protect others after he threatened passengers with violence. Neely lost consciousness and passed away. Manhattan District Attorney Alvin Bragg filed charges against Penny shortly after. On Friday, Penny turned himself at the 5th Precinct in Lower Manhattan, as Rebecca noted.

In an interview on Sunday, former governor Paterson said that Penny did not commit a crime and should not have been charged with manslaughter (via the New York Post):

Paterson theorized that Manhattan District Attorney Alvin Bragg didn’t want to let Penny, 24, loose because of a history of minorities getting killed under controversial circumstances — but said the defendant is not at fault for what the ex-gov deemed an unfortunate tragedy.

“[Penny] did something because he saw danger for other people and tried to prevent it,” the Democrat, New York’s first African-American governor, said Sunday during a chat with John Catsimatidis on the “Cats Roundtable” on WABC 770 AM.

“He did not meet the threshold where you charge someone.”

Paterson pointed out Neely, a 30-year-old homeless man, had a long history of mental illness and, while calling his death a “tragedy,” said that it shouldn’t be seen as “an execution.”

Following Neely’s death, left-wing activists “ignited” in New York City, which Sarah covered. Protesters threatened to “tear the city down” and to “abolish the police” in the crime-ridden city. Townhall has covered how crimes, on the subway, specifically, has skyrocketed in recent years.

Juan Alberto Vázquez, one of the witnesses to Neely’s death, who filmed the incident, said in an interview with Curbed that Neely got on the train and “started yelling that he didn’t have food, that he didn’t have water. From what I understood, he was yelling that he was tired, that he didn’t care about going to jail.”

“I tried to start filming from that moment, but I didn’t because I couldn’t see anything — it was too crowded. And then I heard him take off his jacket.  He bundled it up and just threw it on the floor, very violently. You could hear the sound of the zipper hitting the floor. At that moment, when he threw the jacket, the people who were sitting around him stood up and moved away. He kept standing there, and he kept yelling,” Vázquez added.

A GiveSendGo fundraiser set up for Penny raised over $2 million.

“Daniel Penny is, a twenty-four-year-old college student and decorated Marine veteran, facing a criminal investigation stemming from him protecting individuals on a NYC subway train from an assailant who later died,” the fundraiser description reads. “Funds are being raised to pay Mr. Penny’s legal fees incurred from any criminal charges filed and any future civil lawsuits that may arise, as well as expenses related to his defense.”

Any leftover money from the fundraiser will be donated to a mental health advocacy program in NYC.

Neely was so dirty that officers didn't feel safe performing CPR.

An NYPD Sergeant said no one wanted to give mouth-to-mouth because they didn't want to get hepatitis and Neely was very dirty.

"He seemed to be a drug user... he was an apparent drug user. He was very dirty. I didn’t want them to get hepatitis."

"If he did wake up he would have been vomiting. I didn’t want my officers to do that."

"He was filthy. He looked like a homeless individual. You have to protect your officer."

"I wouldn’t want my officer to get sick if the person throws up."

I was wondering why this case even got to this point but then I remembered it is New York and Alvin Bragg is the prosecutor.
