Now We Know Why Capitol Police Won’t Release Any of Those 14,000 Hours of Jan. 6 Footage — Congress is Blocking It

The U.S. public is purposefully being kept in the dark about what actually happened on January 6. But it isn’t Donald Trump or his associates that stand in the way — it’s the Democrat-led Congress.
The Capitol Police are seeking to shut down a legal request for its communications and surveillance video on January 6, as was requested in connection with a Judicial Watch lawsuit.
The Speaker Pelosi-led House “has argued that the videos and emails are not public records, there is no public interest in their release, and that ‘sovereign immunity’ prevents citizens from suing for their release,” Judicial Watch pointed out.
The Capitol Police’s excuse for not providing transparency to the public, more than one year after the highly controversial and politically consequential incident, did not satisfy Judicial Watch.
“In ‘the courts of this country’ – including the federal courts – the common law bestows upon the public a right of access to public records and documents … the Supreme Court was unequivocal in stating that there is a federal common law right of access ‘to inspect and copy public records and documents’,’ Judicial Watch wrote. “[T]he general rule is that all three branches of government, legislative, executive, and judicial, are subject to the common law right. The right of access is a precious ‘common law right … that predates the Constitution itself.”

BS "immunity". Per the usual government logic, "if they have nothing to hide, what are they afraid of"?

Pelosi Congress Claims Sovereign Immunity in Federal Court to Keep Secret January 6 Videos and Emails

Judicial Watch announced that it filed an opposition to the U.S. Capitol Police’s (USCP) effort to shut down Judicial Watch’s federal lawsuit for January 6 videos and emails. Through its police department, Congress argues that the videos and emails are not public records, there is no public interest in their release, and that “sovereign immunity” prevents citizens from suing for their release.

Judicial Watch filed a lawsuit under the common law right of access after the Capitol Police refused to provide any records in response to a January 21, 2021, request (Judicial Watch v. United States Capitol Police (No. 1:21-cv-00401)). Judicial Watch asks for:

  • Email communications between the U.S. Capitol Police Executive Team and the Capitol Police Board concerning the security of the Capitol on January 6, 2021. The timeframe of this request is from January 1, 2021 through January 10, 2021.
  • Email communications of the Capitol Police Board with the Federal Bureau of Investigation, the U.S. Department of Justice, and the U.S. Department of Homeland Security concerning the security of the Capitol on January 6, 2021. The timeframe of this request is from January 1, 2021through January 10, 2021.
  • All video footage from within the Capitol between 12 pm and 9 pm on January 6, 2021

Congress exempts itself from the Freedom of Information Act. Judicial Watch, therefore, brought its lawsuit under the common law right of access to public records. In opposing the broad assertion of secrecy, Judicial Watch details Supreme Court and other precedent that upholds the public’s right to know what “their government is up to:”

“In ‘the courts of this country’— including the federal courts—the common law bestows upon the public a right of access to public records and documents” … “the Supreme Court was unequivocal in stating that there is a federal common law right of access ‘to inspect and copy public records and documents.’” … “[T]he general rule is that all three branches of government, legislative, executive, and judicial, are subject to the common law right.” The right of access is “a precious common law right . . . that predates the Constitution itself.”

The Court of Appeals for this circuit has recognized that “openness in government has always been thought crucial to ensuring that the people remain in control of their government….” “Neither our elected nor our appointed representatives may abridge the free flow of information simply to protect their own activities from public scrutiny. An official policy of secrecy must be supported by some legitimate justification that serves the interest of the public office.”

“The Pelosi Congress (and its police department) is telling a federal court it is immune from all transparency under law and is trying to hide every second of its January 6 videos and countless emails,” stated Judicial Watch President Tom Fitton. “The hypocrisy is rich, as this is the same Congress that is trying to jail witnesses who, citing privileges, object to providing documents to the Pelosi rump January 6 committee.”

Better than nothing..

The Republican National Committee on Friday voted in favor of formally censuring party Reps. Liz Cheney and Adam Kinzinger for their participation in the Democrat-led House committee's investigation into the Jan. 6 Capitol riot.

The vote reportedly passed overwhelmingly at the RNC's annual winter meeting, this year in Salt Lake City, Utah.

The resolution on Thursday cleared an RNC committee. RNC Chairwoman Ronna McDaniel reportedly worked with Trump ally David Bossie to draw up the resolution.

"We've had two members engage in a Democrat-led persecution of ordinary citizens who engaged in legitimate political discourse," McDaniel said about the censure. "This has gone beyond their original intent. They are not sticking up for hard-working Republicans."

The censure vote is the strongest and most public effort thus far to punish the Cheney, of Wyoming, and Kingziner of Illinois, each vocal critics of former President Trump.

The censure is a lighter sentence, however, than what was in the original resolution – to expel both members from the House GOP Conference.

Some Republican lawmakers, including Sens. Mitt Romney, of Utah, and Bill Cassidy, of Louisiana, have questioned the wisdom of the censure.

Also during the party meetings this week, leaders of the Wyoming GOP party quietly signed a special letter that will allow the national party to fund Cheney's 2020 primary challenger, Trump-backed Harriet Hageman.

That is correct.  The Lying Liar Lied Again

For the average Trumptard a fact = something that THE TRAITOR said....PERIOD

If THE TRAITOR said the Sun rises in the West and sets in the East then Trumptards would immediately agree and repeat it even as they saw with their own eyes that it was not correct

There is a quote from Voltaire that says "Anyone who can make you believe absurdities can make you commit atrocities.”

The full quote was actually referring to atrocities committed in the name of Religion (the absurdity) but Trumptardism is a "religion".   Trump is the infallible messiah who is here to save them from their wretched lives and restore the world to it's proper order.

Here's the full translation from Voltaire

Quote
Formerly there were those who said: You believe things that are incomprehensible, inconsistent, impossible because we have commanded you to believe them; go then and do what is injust because we command it. Such people show admirable reasoning. Truly, whoever can make you believe absurdities can make you commit atrocities. If the God‐given understanding of your mind does not resist a demand to believe what is impossible, then you will not resist a demand to do wrong to that God‐given sense of justice in your heart. As soon as one faculty of your soul has been dominated, other faculties will follow as well. And from this derives all those crimes of religion which have overrun the world.

oh boy…

With the anniversary of January 6th having passed earlier this month, Donald Trump’s claim that he requested national guard troops ahead of that day has been scrutinized by the so-called “fact checkers” once again. While a number have been published in recent weeks, I’ll be addressing Politifact’s from last year, as I’ve made a habit of specifically going after their godawful “fact checks.”

Sports reporter turned pretend fact checker Tom Kertscher attempted to fact check Donald Trump’s claim that he “requested 10,000 national guard troops for January 6th, which Pelosi denied.” Trump first made the claim during a February 28, 2021 interview on Fox News. When asked if he thought there was anything he could’ve done differently by host Steve Hilton, Trump replied “We said to the Department of Defense, the top person, days before we had the rally … I requested … I definitely gave the number of 10,000 National Guardsmen, I think you should have 10,000 of the National Guard ready. They took that number. From what I understand, they gave it to the people at the Capitol, which is controlled by Pelosi. And I heard they rejected it because they didn’t think it would look good. So, you know, that was a big mistake.”

Sportsball’s rebuttal is as follows:

He quotes an article in far-left Vanity Fair quoting then acting defense secretary Christopher Miller met with Trump on the night of January 5th, and Trump asked Miller how many troops the Pentagon planned to deploy to D.C. the next day, but “There is no clear evidence that Trump made a request for 10,000 National Guard troops.”
He says “a Defense Department spokesman said the department ‘has no record of such an order being given’ by Trump. This quote is anonymous and unsourced, and I cannot find it in any publication besides the PolitiFact article quoting it.
In a February 23, 2021 Senate hearing, former Capitol Police Chief Steven Sund said he met with the former House sergeant-at-arms Paul Irving (who reports to Pelosi), and former Senate sergeant-at-arms Michael Stenger, and that he requested the National Guard deploy troops on January 6th. Irving testified that he didn’t “take the discussion as a request,” and that the three men agreed there was no need for troops.
Now unlike most of my fact checks of fact checks, this isn’t a case where there’s a clear verdict. In fact, whether or not you believe Trump’s claims boils down to which officials you happen to trust. Kertscher is only quoting those who contradict Trump, but there are others who seconded his claim.

Former Acting Director of National Intelligence Ric Grenell blasted the “fact check,” stating that Kertscher is focusing on the lack of a formal request, “But the leaders of the Pentagon then made clear they offered Pelosi and she said No.”

Wrong. Politifact is so left wing. They focus on “no formal” request.

But the leaders of the Pentagon then made clear they offered Pelosi and she said No.

They are on the record. This is proof. https://t.co/HlYGsOexkP

— Richard Grenell (@RichardGrenell) January 22, 2022

Kash Patel, who served as acting United States Secretary of Defense, also supported the “10,000 national guard” claim, explaining to Hannity earlier this month:

I was in the Oval Office on that day, days prior to January 6, with the secretary of defense, the chairman of the Joint Chiefs of Staff and others and President Trump.

And he authorized, as the law requires, 10,000 to 20,000 National Guardsmen and Women to be utilized around the country. But the second part of the law requires a federal agency or governor or mayor, such as the United States Capitol Police or Mayor Bowser to make a request, otherwise, the National Guard cannot be deployed legally.

…….

Biden’s DOD inspector general himself said the Trump administration DOD did not delay or obstruct their response to January 6th and Mayor Bowser and the Capitol police repeatedly in writing refused to request the National Guard. And that’s in the report and it’s in the DOD records, and I wonder why so many people aren’t asking for it.
Mark Meadows, the former White House chief of staff, told Fox News’ "Sunday Morning Futures w Maria Bartiromo" that Trump issued a "direct order" to have up to 10,000 troops ready. Kash Patel suggested 20,000 troops so Trump upped it to 20k. He was turned down by Bowser & Pelosi pic.twitter.com/itsL4OIHmn

— The Nasty Italian🍷🇺🇸 🇮🇹 (@sayitnspinit) January 21, 2022

Hannity asked “for the National Guard to have been called up, that had to be approved by Nancy Pelosi. Is that the correct chain of command?” and Patel clarified:

Well, Nancy Pelosi supervises the United States Capitol Police. That’s the federal agency and Mayor Bowser who would have requested the National Guard. So I can’t imagine the universe where the United States Capitol Police didn’t consult with their chain of command to make that request.

…..

It’s backed up by writing; Mayor Bowser’s written refusal, the communications between the leader of the Capitol police and their chain of command to the DOD refusing our request to allow National Guardsmen and Women to stage on January 4 and January 5, before January 6. That’s in the timeline.

What did Nancy Pelosi know and when did she know it?
As reported back in mid January — Speaker Nancy Pelosi and GOP Leader Mitch McConnell refused National Guard support before the announced protests on January 6th.

This was well documented and explains why Democrats closed their bogus impeachment case against President Trump rather than allow the light of truth to shine down on the American public who would learn that it was Nancy Pelosi who failed to secure the US Capitol in January.

In a WaPo interview with the Washington DC police chief, Steve Sund, The National Pulse reports the outgoing police chief “believes his efforts to secure the premises were undermined by a lack of concern from House and Senate security officials who answer directly to Speaker Nancy Pelosi and Senate leader Mitch McConnell.”

DC Police Chief Sund Stated:

“Two days before Congress was set to formalize President-elect Joe Biden’s victory, Capitol Police Chief Steven Sund was growing increasingly worried about the size of the pro-Trump crowds expected to stream into Washington in protest.

To be on the safe side, Sund asked House and Senate security officials for permission to request that the D.C. National Guard be placed on standby in case he needed quick backup.

But, Sund said Sunday, they turned him down.”
But, it was fruitless.

John Falcicchio, chief of staff for D.C. Mayor Muriel E. Bowser admitted: “Literally, this guy is on the phone, I mean, crying out for help. It’s burned in my memories.”

This is just the latest example of the Democrats lying and blaming their failures on Donald Trump.

Today the Daily Caller has more on Pelosi’s failings prior to the January 6th storming of the US Capitol.

Advertisement - story continues below
In the aftermath of the Jan. 6 Capitol riot, Former Sergeant at Arms Paul Irving recalled to House Admin how previous discussions with House Speaker Nancy Pelosi and her office factored in to his “blender of decision making,” according to three sources with direct knowledge of Irving’s talk with House Admin.

Pelosi’s office had previously impressed upon Irving that the National Guard was to remain off Capitol Grounds, Irving allegedly told House Admin. The discussions, which centered around “optics,” allegedly occurred in the months prior to the Jan. 6 riot, during a time when deployment of federal resources for civil unrest was unpopular with Democrats and many members of Congress.

The three sources who confirmed the discussion to the Daily Caller did so under the condition of anonymity, citing the fear of putting a chill on further witnesses to how the security situation unfolded Jan. 6.
The fact that Nancy Pelosi left the US Capitol open and defenseless in early January is one thing. The fact that she lied about it and blamed her failings on President Trump is grounds for removal.

The fact that she lied about it and blamed her failings on President Trump is grounds for removal.

who did he ask

Did you notice that it doesn't say that he asked Pelosi or McConnell (who ran the Senate)

other articles I've read said that he asked his supervisors....so who were they (not Pelosi or McConnell since neither of them directly supervise or have anything to do with the day to day administration of the Capitol Police)

BTW - Sund also blames Homeland Security and the FBI for failing to warn them or see this coming.  Do you remember who is responsible for the FBI and Homeland Security.  By your logic isn't that Donald Trump?

BTW thanks for brining up Sund - Here's something else he said which I'm sure you'll agree with...right

The violent attack on the U.S. Capitol was unlike any I have ever experienced in my 30 years in law enforcement here in Washington, D.C.  Maintaining public safety in an open environment – specifically for First Amendment activities – has long been a challenge. The USCP had a robust plan established to address anticipated First Amendment activities.  But make no mistake – these mass riots were not First Amendment activities; they were criminal riotous behavior.
