WASHINGTON – In a victory for President Barack Obama, the Democratic-controlled House narrowly passed landmark health care legislation Saturday night to expand coverage to tens of millions who lack it and place tough new restrictions on the insurance industry. Republican opposition was nearly unanimous.

The 220-215 vote cleared the way for the Senate to begin debate on the issue that has come to overshadow all others in Congress.

A triumphant Speaker Nancy Pelosi likened the legislation to the passage of Social Security in 1935 and Medicare 30 years later.

"It provides coverage for 96 percent of Americans. It offers everyone, regardless of health or income, the peace of mind that comes from knowing they will have access to affordable health care when they need it," said Rep. John Dingell, the 83-year-old Michigan lawmaker who has introduced national health insurance in every Congress since succeeding his father in 1955.

In the run-up to a final vote, conservatives from the two political parties joined forces to impose tough new restrictions on abortion coverage in insurance policies to be sold to many individuals and small groups. They prevailed on a roll call of 240-194.

Ironically, that only solidified support for the legislation, clearing the way for conservative Democrats to vote for it.

The legislation would require most Americans to carry insurance and provide federal subsidies to those who otherwise could not afford it. Large companies would have to offer coverage to their employees. Both consumers and companies would be slapped with penalties if they defied the government's mandates.

Insurance industry practices such as denying coverage on the basis of pre-existing medical conditions would be banned, and insurers would no longer be able to charge higher premiums on the basis of gender or medical history. In a further slap, the industry would lose its exemption from federal antitrust restrictions on price gouging, bid rigging and market allocation.

The Numbers: H.R. 3962 will cover 96% of Americans, at a 10-year cost of “under $900 billion.” It will reduce the deficit by $104 billion over the same time period, and reduce Medicare spending growth 1.3% annually by cutting $400 billion primarily from private Medicare Advantage plans. Don’t feel sorry for them, see #2.

Consumer Protections: Guaranteed coverage, limited premium variations, standard minimum benefits packages and employer/individual mandates are all still included. That last one protects people from medical bankruptcy. But best of all, insurers are now required to spend 85% of premium revenue on members’ care. Currently in private Medicare Advantage plans, it’s almost the inverse; only $0.14 of every $1.00 in premiums is spent on members’ care. The bill also closes the “donut hole” in Medicare Part D, reducing senior’s out-of-pocket prescription expenses. Prevention and wellness services will be provided in all plans at no cost.

Selective Taxation: The bill derives revenue from a 5.4% “millionaire’s tax” on individuals making over $500,000 and couples making over $1 million (0.3% of households in the US, to be exact.) It also taxes medical device makers to the tune of $20 billion.

Choice and Potential Competition: A public option will finally give consumers another choice besides private insurance or nothing. The Insurance Exchange where we can compare plans remains intact.

Insurance Anti-trust Exemption: This feature, unique to health insurance and baseball, is now history. Meaning private insurers are no longer immune to regulations concerning price-fixing, big rigging, and market allocation. The Federal Trade Commission also now has full rights to investigate the industry.

It was always clear that the real health-care battle would be in the Senate.  But what would have been shocking eight months ago is to hear that it would take until November for the Democrats to pass a bill even in the House.  It would have been even more shocking to have heard that, even after a full-court-press by the White House, the bill would pass by only five votes — meaning that if just three of the 435 members had changed their minds, it would have changed the bill's fate.  And it would have been shocking to have heard that 39 Democrats would jump ship.

The House bill has passed — barely and belatedly — and it is now dead.  Nothing like it will ever pass the Senate.  The question now is whether anything will, now that the voters have spoken in New Jersey and Virginia — and now that the exceedingly narrow margin in the House will likely invite even greater scrutiny of that which is being proposed.

Greater scrutiny will not help the Democrats' efforts.  In truth, their hopes for passage largely hinge on successfully hiding two plain facts from the voters:  One, the House Republicans and the Congressional Budget Office have now shown that a bill costing $61 billion can lower Americans' insurance premiums, while bills costing $1.7 trillion cannot (and instead would raise them substantially).  Two, the Democrats' plans would be paid for only if they follow through on plans to siphon hundreds of billions of dollars out of already-barely-solvent Medicare, and to do so just in time for the baby boomers' retirement.   

Given the magnitude of the challenge of continuing to hide these plain facts from an increasingly attentive citizenry, the Democratic health-care train has a very bumpy ride ahead — as it rolls into the chamber that the American Founders thought from the beginning would ultimately decide our fate: the Senate.

Senior Senate Democratic aides had heard Coburn was considering having potentially thousands of pages read aloud in effort to stall passage. “If he did this it would be even outrageous for a guy who’s become known as Dr. No around here,” one of them told POLITICO.

Coburn’s office confirmed that he is indeed thinking about having the bill read.

“That's a possibility,” Coburn spokesman John Hart said. “He wants to make sure everyone has a chance to read the bill.”

Coburn, who has a reputation for using procedural rules to block and delay legislation, has been an outspoken critic of the president’s health care overhaul. He recently told the New York Times: “My mission is to frame this health care debate in terms of the fiscal ruin of this country. … I have instructed my staff to clear my schedule for every minute that bill is on the floor
