Residents allege excessive force by police officers

When Rick Rucker invited 20 of his friends to his College Towers apartment to celebrate his birthday, he never thought he would end the night sleeping in a jail cell.
At 1:45 a.m. Jan. 7, after many of the guests had already gone home, two Kent city police officers arrived at the apartment after receiving a call about a noise complaint.
Kent police Capt. Michelle Lee said when the two officers made contact with Rucker he was uncooperative, and after they were unable to place him under arrest, the officers called for backup to control the situation.
As a result, Rucker, a 2005 graduate; James Bradley, junior business administration major; Youngstown State alumnus Herbie Jones; junior marketing major Aaron Cephus and Laurence Hall, philosophy grad student were arrested.
Rucker doesn't agree with the police department's version of that night's events. His guests have filed formal civil complaints against the Kent Police Department.
When asked about the complaints Lee said, "There have been some officer complaints filed, but I can't really say much else about that because of the current investigation by internal affairs."
Rucker said he "just wanted my friends to come over to my place and have a fun, safe get together for my birthday. When I heard the officers were coming up, I told my friends to turn down the music and be quiet."
He said his cousin, Charles, answered the door and apologized for the disturbance, but the officers were not forgiving, so Rucker went out to handle the situation.
"I asked what the problem was, and one officer said they were going to issue me a citation," he said. "I said, 'Fine, just give it to me, and I'll send everyone home.' Instead, he said he didn't like my attitude and placed me under arrest."
Rucker said when he turned around the other cop sprayed him with Mace, causing him to fall into his apartment, onto the floor. Several of his guests removed his Mace-covered shirt and put him into the bathtub to try and get the substance out of his eyes.
Bradley said he got involved in the situation when he saw Rucker fall into the apartment.
"I was in the living room, not close to the door, and only went to the door to see what was happening after Rick got w, and I saw an officer push a girl," he said. "At that point I thought it was getting out of hand."
Bradley said he put his hands up as he walked to the door to show that he was not a threat, but as he approached, he was sprayed with Mace as well.
"I think they got mad because I was asking the officers for their names," he said. "The didn't even arrest me until after I left the party. I was walking to my car to leave, and they asked for my ID, then put me under arrest."
Rucker said the police didn't need to use Mace and physical force in the situation because it could have been easily resolved. Because of this, 13 party guests filed formal complaints with the police department.
Rucker could not file a complaint because he was arrested. Instead, he has requested help from the Kent State NAACP and the NAACP at the state level.
"None of this was justified," he said. "No one else should have been Maced; all they did was ask for the officers' badge numbers."
Bradley is also adamant about making sure this type of situation doesn't happen again. Black United Students called an emergency meeting last night to discuss the matter.
"I think that Kent needs to work on how to do things," he said. "It just seems like there are a lot of problems. I couldn't wait to speak with BUS and see if we can find a resolution to this problem."
Rucker said he knows of other similar situations but has never been involved in one and was shocked when it happened.
"I am not a violent person, and I wasn't being aggressive at all," he said. "I feel it was overreaction on their behalf."

If they knew every condescending comment would be played ten thousand times in front of their peers, bosses, family and media, they might think about each comment and action before doing it to make them feel like a big man.
Put a video camera on every officer's lapel that only goes off then they enter restrooms. Period.

You start off by saying you don't know what happened... but speculate they were wasted?
Lets for a moment assume they were. They were in a private home. If the music was too loud, let them turn it down. A kid got maced in his own apartment for giving a cop attitude? That is a big deal. I'm sure it is also for the kids who got maced, and for the cop who did the macing 'cause there are now 13 civilian complaints filed against him. Macing someone with his hands in the air on private property? Real professional NOT!

i totally agree with you.
trust me when i say this, i have had more than my share of dealing with the police. more than alot of peoples share. :-X cops will treat you like you treat them. they pull you over, or what ever the case, they can sense if you have a 'i hate the cops' mindset. and they will react to that because, first and foremost, they have to protect themselves, and second, they have to protect anyone else involved in the situation at hand. do some cross the line? of course. and the ones that continue to cross the line and disrespect the public will have what's coming to them, one day.
but in a case where the news media reports a cop has gone over the line and all you read about is the "victims" side of the case, then i will always take the side of the police. until i hear differently.

Not to defend the little douche, but there are cops who would use this blanket permission to suddenly mace the fck out of anyone with one beer in them, or who didn't say "yes sir" fast enough with every response. When man cannot be counted on to police himself and use his own power correctly, societal standards need to be applied to ensure he cannot. In other words, create the rules so that devils could run the place. Take away the decisional power which will invariably lead to unchecked abuses.

i used to do a beat near a college,, same calls to the same apartments every weekend.. never had a problem- shit, i used to do them same thing,, but i just told them to be quiet and not to get into trouble. i let them do shit they wernt supposed to because they were always cool to us...but if one of those kids acted up,made a threat, or endangered himself or someone else - they would go down... which is what ill assume happend in this situation..

EVER.. we always know a lawsuit is comming, and we just dont want to deal with it.. when a cop goes on a call he wants nothing to happen,, as soon as you slap on those cuffs you know your getting 5 hours of paperwork,lawyers, and court appearances shoved up your ass.. s

It's tough to hand cops weapons and then count on them at appropriate moments, I mean maybe I would have used mace, maybe I wouldn't, but I wasn't there was I? I find it difficult to have a legitimate opinion on this premise alone. We weren't there, maybe there are things we don't know, and maybe the cop is a jerk and should be thrown off the force who the F knows.

240. He was not drunk and disorderly. He was inside his home. He was having a party in his apartment. He should have been made to turn the music down, not maced in his own home. this was a case of noise. 20 people having a party at 2am will disturn neighbours. His biggest crime was not having the foresight to invite his neighbours to the party. Works like a charm. If all the neighbours aare at your party, ...there's no one to complain about the noise.

Except you fail to tke into account that the party was going on inside, and he was outside talking to the cops. The partygoers discovered something was up when their host fell inside the apartment covered in mace. They were the ones who put him in the bathtub and washed off the mace afterall. I just love how you rush to judgement about this guy based on nothing more than the fact that he's black. You assume you know his attitude, you assume you know what he said, even if everything portrays otherwise. You assume 13 people would put themselves in the line of fire by filing charges against police officers for the fun of it? I believe there's a word for such Pre-Judgement. :-\

I am sure most cops do the right thing the best they can...but there are many who are on a power trip and abuse their authority.( mostly relatively young,fairly new cops in my opinion) I am not a fan of police,because I have been on the wrong end of their enthusiasm for their job,however,if I were going to bet,I would bet my paycheck these kids were asking for a beat down.That's just my opinion,but I highly doubt they were very cooperative,given the circumstances.

So, mace is better than a bullet. It's also better than the baton, which can break a bone. And "mouthing off" does qualify. If the kid poses a threat with his mouth, he could get maced.

It's in the use of force. Deal with it. If a suspect refuses to give you his arms you can strike blows to the body called "distraction strikes" which are within policy.

First of all this was a birthday party within his home. I wouldn't be surprised if there wasn't a few joints present at the party, but I have yet to hear that smoking a joint within the privacy of your own home is justification for being maced. A concealed weapon? Good grief, now you're really stretching... or were you refering to his d*ck, ...he is Black afterall.
So now the course of action is to go to a man house, ...and mace him when he answers the door, ...because he could have a concealed weapon? Nice. :-\
And don't demean the importance of Ohio. Ohio is a big deal. From what I understand, they were the reason the world has to put up with another 4 yrs of the stench of burning sulfur in the air.

Yeah...and maybe the cop was just being an ass. I tend to think that in this instance the kid was probably being difficult...however I also believe that many cops abuse their authority.It will be the cops word against the kids...and the cop will always win.No matter who was in the wrong.

i think he had just robbed a store, but i'm not sure.
i'm positive there is going to be a big stink about how the cops chase suspects. and if they even should.
although the guy didn't deserve to die just from running, he make your own decisions and you have to accept the consequences.
any thoughts???

I think they HAVE to chase people.If they didn't nobody would ever stop. If I knew that the cops were not going to chase me,I would run every time.
The only problem I have is when you see 15 cop cars chasing 1 car...THAT is overkill and increases the risk for Innocent people being killed dramatically.It should be only 1 or 2 cop cars no more.

agreed, i would never stop either if i knew they would just turn around.
i think it would depend on what the suspect had just done on whether how many cops follow chase. speeding?? maybe not 15. murder?? send the whole fleet.
but in the same breath, if a cop goes to stop someone just for a broken tail light and they take off, the cops has no idea if they just murdered 5 people or not. i suppose they couldn't take that chance.
it's kind of a damned if you do, damned if you don't. if that person with the broken tail light didn't stop, the cop didn't chase and later was found out the person had killed his own family. the cop would be ripped apart from everyone in the community.
