Looks to me like the guy who got killed was the jackass who started it and escalated it.  That's what the dumbass gets for trying to be "hard".  ::)

You can see in the video that the touch was accidental...the shooter never even looked at the dead guy...looks like the dead guy sais something to cause the shooter to turn around......I am not saying he deserved to be shot but he did ask for it...if he wouldn't have said something the guy wouldn't have spat on him...and if he hadn't punched him he likely wouldn't have been shot.
