Title: "Friends" who owe money

Does anyone know what to do about a "friend" who owes me fifteen thousand dollars, but has turned into a hippie, moved to a very small town in central Texas, (because of the quality and availability of the marijuana there), and hasn't a snowball's chance in hell of ever repaying me?  He has no chance because he refuses point blank to abstain from weed long enough to get a real job. (He used to be a Geographic Information Systems specialist for the oil industry)

His wife died and he took a trip to Amsterdam for a couple of months and spent every nickel he had. (he rented an apartment that cost $175.00 a DAY, amongst other expenses)  I then had to finance his return, getting current on his house, several months of his utilities, and other things. The amount was fifteen thousand dollars and was done with the understanding that he would get a job on his return from Amsterdam and he would have me repaid in 5 months.

Well, he did no such thing, after playing Warcraft for 9 months, he upped and left for this little town with an art colony in central Texas near Austin.  He spends his days playing the guitar on a porch, writing bad beat poetry, and smoking marijuana.  Every time I talked to him about repayment he says I am being an asshole.

What can I do?  He has left me hanging for over two years now, there is nothing on paper.  I rather need the money now for my mother's care.

Any ideas?

If you made the payments on his house current, that would mean he has a house no?
Is there any way to pull out any equity in that, or has he pissed that away too?

He walked away from his house, fully furnished two years ago.  It sits there unoccupied, but fully furnished.  He has made no payments for two years, no taxes for two years, with bees hiving in the walls.  He won't come to town to deal with the thing.  I believe he is upside down.

You may wish to speak to an attorney, but more than likely, even if you can prove that he owes you the money, the guy has made himself "judgment proof."  Even if you were to win a lawsuit, there is nothing to collect.  I wish I had better news for you, sir.

It's OK furniture, but not enough to make it worthwhile to harvest.  Probably only would fetch only 1500 total, and this would be retail.

Unless he owns it free and clear which is unlikely considering you made house payments for him, it is not his house anymore. If he hasn't made a payment in 2 years it would have been foreclosed on a long time ago. Then a management company would come in and make it sellable and the bank would try to unload it. Not sure why it is sitting there with Bee Hives in the walls, something is not adding up here.

As bizarre as it sounds, it is literally true.  He has made no payments, no taxes have been paid, yet civil courts have blocked the mortgage holder from forclosing.  I know because I have steamed open some of his more official looking mail from his mail box.  Some are notices from the mortgage holder citing that he is 24 months in arrears. Some are notices from law firms saying they haven't foreclosed yet, but are going to. Some are from the county tax collector citing two years of arrears. Some are from various counties around the state citing his failure to pay traffic fines for the past two years.  The ones from the law firms cite that they have tried to get certified notices to him at a half dozen addresses, all to no avail.  I would show pictures, but, well, I have been snooping in US mail.

A very satisfying masterbation fantasy, (measure out the punishment over a time period, let him heal, then do it again) but in real life would not solve anything.

Thanks, I will seek some local professional real estate help and see if this is feasible.  But it may be hard because I am cash strapped because most of my assets are tied up caring for my terminal mother.  And I have been laid off.

I know hurting him wont get your money back. But sometimes people like him need to swallow some teeth to bring them back to the reality that there are consequences to screwing over your friends for 15g's.  I dont know what else you think your going to do considering you loaned someone 15 grand without any proof or documentation. Or you could keep breaking into his place and stealing his weed, im sure that would break his little heart.

You have nothing to prove he agreed to pay you back

I wouldn't even bother with looking into the house crap it doesn't seem like you can afford to have more money tied up

If the house is falling apart the debt owed would come off the top after any sale , he'd be left with almost nil , even if he had fire insurance and you burned it down the debt gets paid first and you sadly aren't even in queue for payment

Sorry but you're only option is revenge , I wouldn't count on getting a penny back , once you loan money you may as well forget you had it

Maybe you can ask and try seeing if he's interested in going on a camping trip , think Blair Witch , scare the living sh!t out of him if you can't inflict bodily harm

and mos def steal his weed or set him up for a huge huge bust so he goes to prison , they'll take care of him , is he pretty ?

probably too late for you mate but few things break friendships quicker than loans to them. The dual resentment of obligations and balances unpaid make for an unpleasent relationship. and it doesnt get much better between family. You may have to chalk this down to experience and any future return as a bonus.

Edit: I just noticed your post about this guy having died due to heart problems. That is sad for his children and relatives. Especially when they have to deal with the mess that he left behind with his estate.
