WASHINGTON (Reuters) - For the first time in U.S. history, the Supreme Court ruled on Thursday that individual Americans have the right to own guns for personal use, and struck down a strict gun control law in the U.S. capital.
The landmark 5-4 ruling marked the first time in nearly 70 years the country's high court has addressed whether the Second Amendment of the U.S. Constitution protects an individual right to keep and bear arms, rather than a right tied to service in a state militia.
In the majority opinion, Justice Antonin Scalia said the Second Amendment protected an individual right to possess a firearm unconnected with service in a militia and to use that arm for traditionally lawful purposes, such as self-defense within the home.
Although an individual now has a constitutional right to own guns, that new right is not unlimited, wrote Scalia, a hunter.
He said the ruling should not be taken to cast doubt on long-standing prohibitions on the possession of firearms by felons and the mentally ill or on laws forbidding the carrying of firearms in places like schools and government buildings or laws imposing conditions on gun sales.

I'm really surprised that it took over 200 years for the question of whether the second amendment is referring to an individual right or a collective right to be settled, even though given the history it was apparent to me it was an individual right. After all, if "militia" meant the National Guard, why the fuck would it even need to be in the Bill of Rights, given that the government controlls the National Guard? The word "militia" in the 1700's referred to ad-hoc citizen's groups protecting their rights from the government, not an organization that is essentially a branch of the national military controlled by the government.

Yeah, but courts are big on precedent... even if the balance of power on the court changes, they won't re-consider this for at least 50 years or so. We should be safe for quite a while.

No.....Newsweek is a total left publication that is having financial difficulty and trying to stay afloat. They have I think 12 columnists 10 are liberal with 2 Conservative columnists that lean more to the left. Every post you make shows your true colors.

Wow, I hope he isn't so slow to react when major decisions to be made as president.
That's what worries me. If he cannot wisely capitalize upon a mess like the Wright story - can we count upon him to capitalize upon opportunities in the world? If he can't quickly and definitivly make a decision on something as small as a campaign strategy, can we trust him to make major decisions regaring nat'l security?
What I see so far in the campaigns is that mccain is less shrewd, less effective than Obama. He can't "sell" himself, he's not getting donations. That shit is easy compared to the economy/war that our next prez will inherit.
