President Obama Likely to Order Military Commission Charges Dropped Against Terrorist Suspect

ABC News has learned that on Friday, President Obama will likely order the Department of Defense's Military Commission to withdraw charges against terrorist suspect Abd al-Rahim al-Nashiri. The charges may later be reinstated in a military commission or pursued in a civilian court. Al-Nashiri will remain in custody.

The announcement will not be made until after President Obama meets with the families of victims of terrorist attacks on 9/11 and on the U.S.S. Cole, where he will assure them that this step is not being done to be lenient towards al-Nashiri. The move is being done to stop the continued prosecution of al-Nashiri in a court system that his administration may ultimately find illegitimate, not for any other reason, sources told ABC News.

President Obama has expressed concern about whether the military commissions set up by the Bush administration are the proper way to go forward in pursuing charges against the U.S. detainees, and on January 22 he asked all the judges supervising the trials of detainees for a continuance of 120 days, so a team of administration officials could review the best way forward.

In almost the cases, that continuance request was granted. But last week the judge supervising the al-Nashiri trial -- Army Col. James L. Pohl, the chief judge at the Guantanamo Bay war crimes court -- said he would not heed President Obama's request for a 120-day continuance, or delay, in prosecutions of terrorism suspects. Pohl called the president's request "not reasonable" and not "in the interests of justice."

The arraignment of al-Nashiri is scheduled for Monday, February 9.

On his first day in office, Obama ordered the halt, requiring prosecutors to seek delays in the 14 active cases before military commissions there. But the judge, Col. James Pohl, ordered arraignment for Abd al-Rahim al-Nashiri to go ahead as scheduled on Monday.

With this move, all cases at Guantanamo are now in line with the president's order to halt court proceedings at the detention center, according to Gordon.

This is where we have to wait and see.  they may have been perfectly fine in WW2, however, this is far different than WW2 in that these prisoners are more criminal than captured enemy soldiers from the army of another independent country.

What's not going to happen which has been subtly suggested in this thread is the charges being drop an this guy being let go.  IF that happens there will be trouble unless its proved he's the wrong guy.

I think it can be argued with more credibility that he may be more concerned about maintaining the integrity of the process rather than saying he for terrorists rights.

The whole point is he closed Gitmo before think about what he would actually have to do with prisoners and he got called on it By Col. Pohl.

If Kalid goes before an American judge and if the supreme court finds waterboarding to be torture. He will be free.

Even more disturbing is that most of the people held at Gitmo didn't perform any illegal acts on US soil so America can not try them, so they will be sent home only to become terrorist again.

Considering that these courts were declared legal during WW2, it definately does not seem that he is protecting anything but the rights of those who kill our soldiers.

Many of these guys can't be sent home because the US won't deport a prisoner to nation that would kill or torture them.

I don't think many people truly grasp what will happen if Gitmo closes.
You will likely have known terrorists living free in the US. Nothing like going to the Kalid school of terrorism based in Baltimore.

There are many reasons for this but the main point is that they can't hold a prisoner indefinitely and they can't be deported to country where they will be killed.

Many of these guys can't be sent home because the US won't deport a prisoner to nation that would kill or torture them.

For some reason I think Bush has been drunk continously since his plane landed in Dallas.

He hardly cared about the job when he had it and probably hasn't even turned on the news

How can something, not in the Constitution, be un-Constitutional. This guy is not covered by the Constitution or our laws. He falls in a grey area readily covered by military triibunals that didn't just spring to life under Bush...study ur history. Had this been FDR..they would have had a fair trail and hung.

I think it's more to do with moving away from this slippery slope we were sliding into in several areas.  with Americans being declared terrorists and enemy combatants and removed from constitutional protection.  The terrorist charge gets leveled so easy.  I just watched a show where some lady got drunk on a plane and flipped out.  She was charged with being a terrorist.  The charges were dropped but going down the whole path we were, maybe the day comes where it's common for people to be removed from their given protections under the constitution.  This guy isn't going to get off.

I know that....and I understand what Barry is trying to do...however this guy does'nt fall under our domestic laws. He's an enemy combatant...which is a Bushism....they used to be called spies/saboteurs. This guy launched his attack outside the states etc so that doesn't really fit. I don't a ready made solution, other then to say this guy should not be subject to our laws and protections. I will go out ona limb and say that the case u sight will happen again and has happened before and cooler heads have and will prevail.
