PHILADELPHIA — The lawyer for a Pennsylvania school district says it should be able to discipline a middle school student for posting a photo of her principal on a Web site portraying him as a pedophile.
The Blue Mountain School District in Schuylkill County argued before a federal appeals court in Philadelphia that the principal's career could have been damaged.
The American Civil Liberties Union argues that students enjoy free-speech rights off-campus that protect such parodies, however vulgar.
An ACLU lawyer told a three-judge panel that parents, not schools, should be monitoring the behavior of students when they're not at school.

The girl should not be disciplined by the school.
She should instead face investigation by the legal system for defamation of character .

I think it depends on the school's code of conduct. This appears to be a public school, so I doubt the school regulates conduct outside of school hours.

That was how I reasoned basically.
It's just about addressing her through the proper channels.

That's just up to him, civil not criminal and he might have a case and there's not shit the ACLU can do about that.

I don't think the ACLU cares whether he has a case or not, ...just that the school district not overstep it's bounds

100% correct.
I guarantee if that principal sues and wins 20 grand from the parents, that girl will get way tougher punishment at home.
