No, they took it as a request to not go
something he volunteered to do and was not required... and, in fact, even AFTER volunteering, he could choose at any time to "un-volunteer". He volunteered just so they could file this silly lawsuit.
He is in the Guard and had a day time job working for a military contractor.
After he filed this lawsuit, the military decided that it wouldn't be prudent to have him at their facility until the case is heard, so they denied his entry. The contracting company that he works for, noting that his only job was AT the facility, fired him.
But he never DID have to go. Not only that, but he never had to volunteer to go.
