Fox News' senior judicial analyst made some surprising remarks Saturday that may go against the grain at his conservative network.

In a interview with Ralph Nader on C-SPAN's Book TV to promote his book Lies the Government Told You, Judge Andrew Napolitano said that President George W. Bush and Vice President Dick Cheney should have been indicted for "torturing, for spying, for arresting without warrant."




Add treason to that list.

I have no problem with spying, torture, etc.  I don't like warrentless searches and indefinate detention, but I apply the 33 family test. 

If some shitbag held my family hostage, and I had a buddy or co-conspirator in custody, would I be ok with torturing the bastard to get my family back.  Answer?  YES, with joy pleasure and I'll do it myself voluntarily.

That is how I view my nation and its citizens, as family.  You screw with the family, my Sword of Damocles is coming down on your ass.

So in your opinion, no american should ever be tortured, even if he has info on an upcoming attack?

Most people, civilian or military, captured by Muslim jihadists are usually severely tortured and then killed. Confirm/deny?

No, of some one has knowledge of an imminent attack that can result in the death's of 240's family, I myself would have zero issue with doing what is necessary to get the needed info.

of course.  lions and other savages do the same.  please tell me youre not thinking I defended them? lol... I have no prob torturing bad guys - quietly.  bragging about it is asinine.  better to find them, beat them, then sink them, and deny we ever had them.  I thought my position was very clear there haha...

My point where I was going with 333386 is that the problem arises with this... who gets to make the call as to when it's necessaey?  Suppose obama decides to appoint a bunch of nuts to make these calls.  They decide any bald white guys on message boards talking about "CW2" might have info about upcoming attacks, and so they start torturing them. 

See how it can be abused?  I dont give a shit what we do to enemies... i'd cap 5 of them, eat a ham sandwich, and then cap 5 more.  You know this, mannnnn.  My point is that when we say it's okay to torture americans... then we assign responsibiltity for choosing who gets torture to... the govt... we leave a lot of room for abuse, ya know?

Yeah, it's a slippery road. Can't really say where I stand on that issue. Would you support torturing or outright killing Anwar Al-Awlaki?

in war time once war has been declared, you dont have to have a warrent to search, detain or hold someone who poses a thread or has info on a threat to the country!  correct me if i am wrong but  our government can hold a person without trial, until the end of the war if they are deemed a threat or have info.
