Obama Administration to Review All Deportation Cases, Apply DREAM Act-Style Criteria

The Obama administration announced Thursday that it would launch a case-by-case review of illegal immigrants slated for deportation, in a move that could grant a reprieve to so-called DREAM Act beneficiaries and thousands of others.

The DREAM Act is a proposal in Congress to give illegal immigrants who came to the U.S. as children a chance at legal status if they complete two years of college or military service. Though the bill has not passed, supporters and critics alike suggested Thursday's announcement could serve to unilaterally carry out its provisions.

A spokeswoman with the Federation for American Immigration Reform described the new policy as "blanket amnesty."

But Homeland Security Secretary Janet Napolitano said in a letter to Senate Democrats that it would "enhance public safety" by focusing deportation efforts on those "who pose a threat."


Under the plan, DHS and the Department of Justice will review all cases in removal proceedings as well as any new cases to make sure those who are deported meet the kind of criteria established in a June 17 agency memo.

The memo from Immigration and Customs Enforcement Director John Morton instructed staff to consider 19 factors when exercising "prosecutorial discretion" -- or the discretion an ICE attorney has in deciding whether and how to pursue an immigration case. The list includes factors similar to those in the DREAM Act, like whether someone arrived in the U.S. as a "young child," is pursuing an education or has served in the military.

Thursday's announcement goes beyond the memo by establishing a process to flag and exempt certain illegal immigrants from deportation. A team of attorneys and officials will be tasked with reviewing the more than 300,000 cases in the system.

An ICE memo obtained by FoxNews.com said the effort would not provide "categorical relief for any group," but would try to prevent "low-priority" cases -- like those not involving convicted criminals -- from clogging the system.

Cecilia Munoz, White House director of intergovernmental affairs, wrote on the White House blog that the review would "clear out low-priority cases on a case-by-case basis and make more room to deport people who have been convicted of crimes or pose a security risk" -- while ensuring the low-priority cases are kept "out of the deportation pipeline in the first place."

Describing groups of people similar to those targeted in the DREAM Act, she said the low-priority list would include "individuals such as young people who were brought to this country as small children, and who know no other home," as well as "individuals such as military veterans and the spouses of active-duty military personnel."

She said that with more than 10 million people in the country illegally, the strategy is meant to focus limited resources on those who pose the greatest risk.
House Democratic Leader Nancy Pelosi and Senate Democratic Leader Harry Reid praised the decision.

"This new DHS directive will help prioritize our limited enforcement resources to focus on serious felons, gang members and individuals who are a national security threat rather than college students and veterans who have risked their lives for our country," Reid said in a statement. "I am especially pleased about the impact these new policies will have on those who would benefit from the DREAM Act. ... We lose a lot by sending them back to countries they do not know."

Reid said Congress should still pass immigration reform legislation.

Napolitano also stressed in her letter that the new process "will not alleviate the need for passage of the DREAM Act or for larger reforms."

But FAIR described the announcement as a complete overhaul of immigration law without approval by Congress.

"Having failed in the legislative process, the Obama administration has simply decided to usurp Congress's constitutional authority and implement an amnesty program for millions of illegal aliens," FAIR President Dan Stein said. "This step by the White House amounts to a complete abrogation of the president's duty to enforce the laws of the land and a huge breach of the public trust. ... In essence, the administration has declared that U.S. immigration is now virtually unlimited to anyone willing to try to enter -- and only those who commit violent felonies after arrival are subject to enforcement."

Washington, D.C.—Nevada Senator Harry Reid issued the following statement after the Obama Administration announced measures to make immigration enforcement more efficient and effective by executing a case-by-case review of individuals currently in removal proceedings, and those who may be placed in proceedings in the future. This will help focus on our highest deportation priorities such as violent criminals. The Department of Homeland Security announced the changes in a response to a letter Senator Reid and 21 other Democratic senators sent to the President on April 13:

“I applaud President Obama for taking this decisive step to bring our immigration enforcement policies more in line with our national security and public safety priorities. This new DHS directive will help prioritize our limited enforcement resources to focus on serious felons, gang members and individuals who are a national security threat rather than college students and veterans who have risked their lives for our country. This commonsense approach will address an untenable situation where the deportations of foreign drug traffickers and violent criminals face long delays because our immigration courts are overwhelmed by low-priority cases of individuals with no criminal records.

“I am especially pleased about the impact these new policies will have on those who would benefit from the DREAM Act. These young people are American in all but paperwork: in language, culture, love for this land, and yearning to serve in our military, or become college graduates who fully contribute to our nation. We lose a lot by sending them back to countries they do not know.

“The President’s decision is a step in the right direction. However, the solution to our broken immigration system must come from Congress. Once more, I ask my Republican colleagues to join Democrats in enacting tough, smart, and fair comprehensive immigration reform that secures our borders; strengthens existing immigration laws; and requires the approximately 11 million people in this country illegally to register with the government and get right with the law.”

(Washington) – Today, Congressman Luis V. Gutierrez (D-IL) issued a statement reacting to an announcement that the Department of Homeland Security (DHS) would review deportation cases based on newly-issued guidelines establishing which cases are priorities for deportation and which are not. The review of pending deportation cases and the instructions to all elements of DHS over how immigrants that meet certain criteria should be handled has come after months of sustained advocacy by Congressman Gutierrez, the Congressional Hispanic Caucus, other Democratic leaders in the House and Senate, and determined public pressure by from clergy, advocates, immigrants, and DREAM Act students nationwide. The announcement by DHS will apparently make one of Congressman Gutierrez' key demands a reality: putting a halt to the deportation of young people who were brought to the U.S. as children and who are crime free and pursuing their education; in other words, those who would qualify for the DREAM Act, which was passed by the House of Representatives in 2010 but died in the Senate when only 55 out of 100 Senators voted to move the bill forward.

The Congressman was briefed on today's DHS announcement by the Director of Immigration and Customs Enforcement (ICE) John Morton by telephone yesterday evening. The following is a statement by Rep. Luis V. Gutierrez:

I have been vocal in my criticism of the President and his Administration over the dramatic increase in deportations on his watch and have traveled the country urging him to use his power under existing law to do what he can to help. This is the Barack Obama I have been waiting for and that Latino and immigrant voters helped put in office to fight for sensible immigration policies. Focusing scarce resources on deporting serious criminals, gang bangers, and drug dealers and setting aside non-criminals with deep roots in the U.S. until Congress fixes our laws is the right thing to do and I am proud of the President and Secretary Napolitano for standing up for a more rational approach to enforcing our current immigration laws.

Today is a victory not just for immigrants but for the American people as a whole because it makes no sense to deport DREAM Act students and others who can make great contributions to America and pose no threat. It is not in our national interest to send away young people who were raised in the U.S. and have been educated here and want only to contribute to this country's success.

I have asked ICE Director John Morton to come to Capitol Hill and brief Members of Congress on how this will affect their constituents as soon as Congress reconvenes. My Chicago office and Congressional offices across the country have been inundated with cases of DREAM Act students, military families, and U.S. citizens whose families are being threatened with deportation or who have actually been deported. Putting the new priorities into practice so that cases can be reviewed and getting the word out to caseworkers in Congressional offices, in the legal community, and to individual immigrants facing deportation is critical and time-sensitive and we will work with ICE and DHS on that immediately.

This action does not address all of my concerns, but it is the start of a process that will save many American families and individuals who deserve to live long and productive lives in this country. There are still U.S. citizens and legal permanent residents in families with undocumented immigrants who can obtain legal status under existing law, but who do not do so because of an unfair three- and ten-year penalty barring them from the U.S. if they apply. The rapidly expanding "Secure Communities" state and local enforcement program that undermines public safety and has caught tens of thousands of non-criminals in its dragnet remains a big problem. But today's announcement shows that this President is willing to put muscle behind his words and to use his power to intervene when the lives of good people are being ruined by bad laws.

US offers $14.5 million for Somalia food aid

The United States said Friday it is offering nearly $15 million for food for Somalis hit by drought and political unrest.
"The United States has approved a $14.5 million contribution to the World Food Programme to benefit Somalis in need of food assistance," Mark Toner, a State Department spokesman, told reporters.

"The United States is also staging approximately 19,000 metric tons of food aid and it's prepositioning sites worldwide in order to be prepared for additional emergency food assistance in the weeks and the months to come," he added.

He said the United States has already provided around $15 million in food assistance, $23 million in non-food humanitarian aid, and $27 million in development assistance since 2010.

"The United States has been the largest overall donor of humanitarian and food aid to Somalia. Since 1991 the US has provided more than $1 billion in humanitarian assistance to Somalia," he said.

In February, UN official Valerie Amos said drought in Somalia is threatening two million people, the vast majority living in zones controlled by radical Islamist insurgents where it is impossible to send aid.

Republicans accused the Obama administration of instituting "backdoor amnesty" after officials announced they would launch a case-by-case review of illegal immigrants slated for deportation in an effort to thin the list and focus resources on kicking out criminals.

Arizona Gov. Jan Brewer, one of the president's toughest critics on border policy, said the move amounts to the administration implementing an immigration overhaul "via executive fiat."

"This plan amounts to backdoor amnesty for hundreds of thousands -- if not millions -- of illegal aliens," the Republican governor said in a written statement. "We need to remind President Obama that we elected a president that serves beneath the law and did not anoint a king that is above the law."

Texas Republican Rep. Michael McCaul said the plan circumvents Congress.

"It is just the latest attempt by this president to bypass the intended legislative process when he does not get his way," McCaul said.

WASHINGTON — The Obama administration announced Thursday that it would suspend deportation proceedings against many illegal immigrants who pose no threat to national security or public safety.

The new policy is expected to help thousands of illegal immigrants who came to the United States as young children, graduated from high school and want to go on to college or serve in the armed forces.

White House and immigration officials said they would exercise “prosecutorial discretion” to focus enforcement efforts on cases involving criminals and people who have flagrantly violated immigration laws.

Under the new policy, the secretary of homeland security, Janet Napolitano, can provide relief, on a case-by-case basis, to young people who are in the country illegally but pose no threat to national security or to the public safety.

The decision would, through administrative action, help many intended beneficiaries of legislation that has been stalled in Congress for a decade. The sponsor of the legislation, Senator Richard J. Durbin of Illinois, the No. 2 Senate Democrat, has argued that “these young people should not be punished for their parents’ mistakes.”

The action would also bolster President Obama’s reputation with Latino voters as he heads into the 2012 election. Just a week ago the leaders of major Hispanic organizations criticized his record, saying in a report that Mr. Obama and Congress had “overpromised and underdelivered” on immigration and other issues of concern to Latino voters, a major force in some swing states.

The chairman of the House Judiciary Committee, Representative Lamar Smith, Republican of Texas, denounced the new policy.

“The Obama administration has again made clear its plan to grant backdoor amnesty to illegal immigrants,” Mr. Smith said. “The administration should enforce immigration laws, not look for ways to ignore them. Officials should remember the oath of office they took to uphold the Constitution and the laws of the land.”

White House officials emphasized that they were not granting relief to a whole class of people, but would review cases one by one, using new standards meant to distinguish low- and high-priority cases.

“The president has said on numerous occasions that it makes no sense to expend our enforcement resources on low-priority cases, such as individuals” who were brought to this country as young children and know no other home, Ms. Napolitano said in a letter to Mr. Durbin.

She said that low-priority cases were “clogging immigration court dockets” and diverting enforcement resources away from individuals who pose a threat to public safety.

Mr. Durbin said he believed the new policy would stop the deportation of most people who would qualify for relief under his bill, known as the Dream Act (formally the Development, Relief and Education for Alien Minors Act).

Some experts have estimated that more than two million people might be eligible to apply for legal status under the Dream Act. Mr. Durbin’s office estimates that 100,000 to 200,000 could eventually earn citizenship, though the numbers are uncertain.

Under the new policy, the government will review 300,000 cases of people in deportation proceedings to identify those who might qualify for relief and those who should be expelled as soon as possible.

White House officials said the new policy could help illegal immigrants with family members in the United States. The White House is interpreting “family” to include partners of lesbian, gay and bisexual people.

Richard Socarides, a New York lawyer who was an adviser to President Bill Clinton on gay issues, said, “The new policy will end, at least for now, the deportations of gay people legally married to their same-sex American citizen partners, and it may extend to other people in same-sex partnerships.”

J. Kevin Appleby, director of migration policy at the United States Conference of Catholic Bishops, said the initiative would keep immigrant families together. “It is consistent with the teaching of the church that human rights should be respected, regardless of an immigrant’s legal status,” he said.

Cecilia Muñoz, a White House official who helped develop the new policy, said officials would suspend deportation proceedings in low-priority cases that, for example, involve “military veterans and the spouses of active-duty military personnel.”

Stephen W. Yale-Loehr, who teaches immigration law at Cornell, said the new policy could also benefit “illegal immigrants who were stopped for traffic violations and thrown into deportation proceedings, as well as people whose only violation of immigration law is that they stayed beyond the expiration of their visas or worked here illegally.” Ms. Napolitano said her agency and the Justice Department would do the case-by-case review of all people in deportation proceedings.

Those who qualify for relief can apply for permission to work in the United States and will probably receive it, officials said.

The new policy “will not provide categorical relief for any group” and “will not alleviate the need for passage of the Dream Act or for larger reforms to our immigration laws,” Ms. Napolitano said.

People in deportation proceedings stand to benefit most from the new policy. The new enforcement priorities also make it less likely that the government will begin such proceedings in the future against people who have no criminal records and pose no threat to national security.

White House officials said the new policy ratified guidance on “prosecutorial discretion” recently issued by John Morton, the director of immigration and customs enforcement at the Department of Homeland Security.

The Senate majority leader, Harry Reid, Democrat of Nevada, praised the new directive, saying it would allow federal agents to “focus on serious felons, gang members and individuals who are a national security threat, rather than college students and veterans who have risked their lives for our country.”

Roy H. Beck, the president of Numbers USA, a nonprofit group that wants to reduce legal and illegal immigration, said he could understand the decision to defer deportation in some cases. But he said the decision to grant work permits was distressing.

“This is a jobs issue,” Mr. Beck said. “The president is taking sides, putting illegal aliens ahead of unemployed Americans.”

It's wrong to waste money on wars, supporting Israel, and on the army.

But, it's pefectly fine to spend money the nation doesn't have on taking care of illegals and giving them amnesty so that they can take over jobs that can go to people who came to this country legally. It's perfectly fine to send hundreds of millions to nations who don't care about their own and who in a blink of an eye will kill an american.  That makes much better sense. Don't you think?

Protesters in Los Angeles earlier this week hold signs representing the number of people deported under one U.S. program.Immigration rights advocates earlier this week voiced anger at the Obama administration for targeting criminal offenders for deportation — a crackdown, critics contend, that has netted too many low-levels offenders who are never even convicted of crimes.

Presumably, critics have less to complain about, after the president yesterday made a major shift in immigration policy, announcing that the administration might allow many of the 300,000 illegally immigrants currently facing deportation to remain in the country.

The White House announced that it would use more discretion and review deportation cases on an individual basis, possibly sparing those who aren’t deemed a true threat to public safety. Here’s an article from WSJ’s Miriam Jordan announcing the policy shift.

So, under the president’s  new case-by-case approach to deportation, what type of folks stand an improved chance of remaining in the U.S. ? The administration fortunately has provided some guidance.

We start with a statement posted to the White House blog from Cecilia Munoz, the White House Director of Intergovernmental Affairs.

“There are more than 10 million people who are in the U.S. illegally; it’s clear that we can’t deport such a large number,” she writes. “So the Administration has developed a strategy to make sure we use those resources in a way that puts public safety and national security first.”

In deciding who to deport, Department of Homeland Security and Justice Department will apply “common sense guidelines,” Munoz writes. She links to a June 17, 2011 memo written by John Morton, director of U.S. Custom and Immigration Enforcement, which spells out the sort guidelines that will be used.

In deciding whether to prosecute an individual, Morton writes, immigration officials should consider such factors as:

the person’s length of presence in the United States;
the circumstances of the person’s arrival in the United States, particularly if the alien came to the United States as a young child;
the person’s pursuit of education in the United States, with particular consideration given to those who have graduated from a U.S. high school or have successfully pursued or are pursuing a college or advanced degrees at a legitimate institution;
whether the person, or the person’s immediate relative, has served in the U.S. military, reserves, or national guard;
the person’s criminal history, including arrests, prior convictions, or outstanding arrest warrants;
the person’s ties and contributions to the community, including family relationships;
the person’s age, with particular consideration given to minors and the elderly;
whether the person has a U.S. citizen or permanent resident spouse, child, or parent;
whether the person is the primary caretaker of a person with a mental or physical disability, minor, or seriously ill relative;
whether the person or the person’s spouse is pregnant or nursing.

Morton cautions that the list of factors he provides is not exhaustive and that no one factor is determinative of whether a person will stay or go.

A senior administration official told WSJ that the new immigration policy is designed to make better use of limited immigration-enforcement resources and to help ease overburdened immigration courts. But a natural question that arises is whether immigration authorities, with their limited resources, will have the bandwidth to make the sort of case-by-case deportation determinations called for by the new policy.

America's immigration system is broken, but only a bipartisan political movement can fix it, President Barack Obama said Monday.

"The idea of doing things on my own is very tempting, I promise you, not just on immigration reform. But that's not how our system works. That's not how our democracy functions," Obama told the National Council of La Raza.

Speaking at the organization's annual conference in Washington, Obama said passing immigration reform measures will require support from both sides of the aisle in Congress.

"Let's be honest, I need a dance partner here, and the floor is empty," he said.

Audience members greeted Obama with a standing ovation, and responded to his discussion of immigration reform by chanting, "Yes you can, yes you can."

"I need you to keep building a movement for change outside of Washington, one they can't stop, one that's greater than this community," Obama told them.

The speech comes at a critical time for Obama, who is trying to drum up support among Latino voters in the run-up to the 2012 election.

"Feel free to keep the heat on me and the heat on Democrats. But here's the thing you should know, the Democrats and your president are with you, don't get confused about that," he said Monday.

La Raza is the largest national Latino civil rights and advocacy organization in the United States, and its meetings regularly draw top political leaders.

Its leader Monday praised Obama's efforts to help Latinos and lauded much of the president's work from the White House, particularly his appointment of Hilda Solis as labor secretary and Sonia Sotomayor as a Supreme Court justice.

"While we may not always agree, Hispanics do have a voice in the administration, and the Latino community does have the president's ear," said Janet Murguia, president of La Raza, which translates literally as "The Race."

But she went on to mention immigration, saying that "unfinished business" remains for Obama.

"Virtually everyone in this room has been affected by our nation's broken immigration system and the record number of deportations," she said.

Obama defended his administration's approach to deportations.

"I swore an oath to uphold the laws on the books. That doesn't mean I don't know very well the real pain and heartbreak that deportations cause. I share your concerns and I understand them," he said Monday. "We work every day to make sure we are enforcing flawed laws in the most humane possible way."

The Obama Administration announced on Thursday that it will individually review the 300,000 cases of illegal aliens currently holding deportation orders in an effort to appease his pro-amnesty critics and last year's record number of deportations.

The Administration deported 400,000 illegal aliens last year -- less than half had been convicted for other crimes. Pres. Obama is pledging to halt deportations of non-criminal illegal aliens. Illegal aliens that are considered low-priority deportations will no longer be the focus, including young people who were brought to the U.S. as children, military veterans and spouses of military personnel.

The Obama administration announced Thursday that it would launch a case-by-case review of illegal immigrants slated for deportation, in a move that could grant a reprieve to so-called DREAM Act beneficiaries and thousands of others.

The DREAM Act is a proposal in Congress to give illegal immigrants who came to the U.S. as children a chance at legal status if they complete two years of college or military service. Though the bill has not passed, supporters and critics alike suggested Thursday's announcement could serve to unilaterally carry out its provisions.

A spokeswoman with the Federation for American Immigration Reform described the new policy as "blanket amnesty."

But Homeland Security Secretary Janet Napolitano said in a letter to Senate Democrats that it would "enhance public safety" by focusing deportation efforts on those "who pose a threat."


Under the plan, DHS and the Department of Justice will review all cases in removal proceedings as well as any new cases to make sure those who are deported meet the kind of criteria established in a June 17 agency memo.

The memo from Immigration and Customs Enforcement Director John Morton instructed staff to consider 19 factors when exercising "prosecutorial discretion" -- or the discretion an ICE attorney has in deciding whether and how to pursue an immigration case. The list includes factors similar to those in the DREAM Act, like whether someone arrived in the U.S. as a "young child," is pursuing an education or has served in the military.

Thursday's announcement goes beyond the memo by establishing a process to flag and exempt certain illegal immigrants from deportation. A team of attorneys and officials will be tasked with reviewing the more than 300,000 cases in the system.

An ICE memo obtained by FoxNews.com said the effort would not provide "categorical relief for any group," but would try to prevent "low-priority" cases -- like those not involving convicted criminals -- from clogging the system.

Cecilia Munoz, White House director of intergovernmental affairs, wrote on the White House blog that the review would "clear out low-priority cases on a case-by-case basis and make more room to deport people who have been convicted of crimes or pose a security risk" -- while ensuring the low-priority cases are kept "out of the deportation pipeline in the first place."

Describing groups of people similar to those targeted in the DREAM Act, she said the low-priority list would include "individuals such as young people who were brought to this country as small children, and who know no other home," as well as "individuals such as military veterans and the spouses of active-duty military personnel."

She said that with more than 10 million people in the country illegally, the strategy is meant to focus limited resources on those who pose the greatest risk.
House Democratic Leader Nancy Pelosi and Senate Democratic Leader Harry Reid praised the decision.

"This new DHS directive will help prioritize our limited enforcement resources to focus on serious felons, gang members and individuals who are a national security threat rather than college students and veterans who have risked their lives for our country," Reid said in a statement. "I am especially pleased about the impact these new policies will have on those who would benefit from the DREAM Act. ... We lose a lot by sending them back to countries they do not know."

Reid said Congress should still pass immigration reform legislation.

Napolitano also stressed in her letter that the new process "will not alleviate the need for passage of the DREAM Act or for larger reforms."

But FAIR described the announcement as a complete overhaul of immigration law without approval by Congress.

"Having failed in the legislative process, the Obama administration has simply decided to usurp Congress's constitutional authority and implement an amnesty program for millions of illegal aliens," FAIR President Dan Stein said. "This step by the White House amounts to a complete abrogation of the president's duty to enforce the laws of the land and a huge breach of the public trust. ... In essence, the administration has declared that U.S. immigration is now virtually unlimited to anyone willing to try to enter -- and only those who commit violent felonies after arrival are subject to enforcement."

It cost 24,000 dollars to deport one person....I think its better to get rid of convicted felons first than to deport illegals that are paying taxes.  In fact, I actually support citizenship to any illegal immigrant that served in the military.  If they defended this country then they deserve to be U.S. citizens...like Rohan Coombs.

No further action was taken on Rohan’s part because he wasn’t going to second guess his commanding officer.
It wasn’t until Rohan got out of the military with an honorable discharge that things started to go downhill for him. Rohan suffers from PTSD and was unable to recognize it. He started using marijuana to ease the suffering from what he saw in Iraq during combat. During this time his wife had passed away 4 days before Christmas. This was devastating to Rohan and like his PTSD he did not seek help with dealing with his wife’s death.
He has been told he was a citizen for saying the oath to the military and for being told he was property of the U.S. and that made him a citizen. Now the judge in his case is telling him he is not a citizen and that he should be deported back to a country he hasn’t been to in over 30 years.

As of May 2010, there was 16,966 non-citizens right now on active duty serving in the military according to the Pentagon....prob more by now.


I've always believed that military service should qualify for citizenship.  If an non citizen dies during combat, he's automatically given citizenship and a military funeral. 

Being in the military means you're willing to die for the United States....if that's not a person who deserves to be a US citizen, then who is???

If you are an illegal immigrant and you have not been arrested for committing a crime, the odds that you will ever be deported have now gone way, way down. With the Republicans in control of the House of Representatives, Barack Obama knows that he simply is not going to be able to get amnesty for illegal immigrants passed by Congress.
But instead of giving up, Obama has decided to ram amnesty for illegal immigrants down our throats any way that he can. The head of the Department of Homeland Security, Janet Napolitano, has announced that there will now be a case-by-case review of all deportation cases involving illegal immigrants. Those involving "criminals" will be prioritized and almost all the rest will be thrown out. In essence, this is "backdoor amnesty" for illegal immigrants and it also represents a stunning admission by the Obama administration that it is simply going to refuse to enforce our immigration laws.

Yes, deportation cases for criminals should be moved to the top of the list, but openly announcing that almost all other illegal immigrants will not be deported is just going to encourage millions more illegal immigrants to come pouring in to this country.

Government officials have now been given a list of 19 factors to use when deciding whether to use "prosecutorial discretion" in deportation cases.

Essentially, what is going to happen now is that illegal immigrants are going to get to stay in the United States if any of the following apply....

-arrival in the U.S. as a young child

-actively "pursuing an education"

-serving or served in the U.S. military

-spouse of someone in the U.S. military

-18 years old or younger

-"elderly"

-pregnant or nursing

-victim of a "serious crime"

-serious disability or health problem

-caring for a family member with a serious disability or health problem

As you can see, these categories are so broad that almost all illegal immigrants will be able to fit into at least one of them.

Now we are not only going to have "anchor babies", we are also going to have "anchor pregnancies". Millions of women that want to come to this country will soon learn that all they have to do is to somehow get inside our borders and get pregnant and they will be golden. With millions upon millions of promiscuous American men running around, that should not be too hard to do.

Janet Napolitano says that she wants to primarily focus on deporting those that have been convicted of a crime or that pose a "security risk".

But isn't coming into this country illegally a crime?

The funny thing is that many of the elements of this new policy seem to have been lifted almost directly out of the DREAM Act. But the Obama administration knows that passage of the DREAM Act is very unlikely at this point so now it is basically imposing amnesty for illegal immigrants by executive fiat.

Quite a few prominent politicians are already expressing outrage. For example, the following is how Arizona Governor Jan Brewer characterizes this new plan by the Obama administration....

"This plan amounts to backdoor amnesty for hundreds of thousands -- if not millions -- of illegal aliens"

Brewer also feels that Obama needs to be reminded that he is not a king that gets to do whatever he wants.....

"We need to remind President Obama that we elected a president that serves beneath the law and did not anoint a king that is above the law."

Sadly, this is a pattern that we are starting to see with Obama. If there is a law that he does not like, he just declares that he is not going to enforce it and everyone applauds.

People like Obama love to talk about "the rule of law", but whenever it becomes inconvenient for them they quickly discard it.

Dan Stein, the President of the Federation for American Immigration Reform, says that this new policy will essentially open up the floodgates for more illegal immigration....

"In essence, the administration has declared that U.S. immigration is now virtually unlimited to anyone willing to try to enter and only those who commit violent felonies after arrival are subject to enforcement." Basically, by announcing this policy so openly, the Obama administration has given a huge, flashing green light to millions of potential illegal immigrants.

Obama is also openly pandering for votes in 2012. He is going to need all the help he can get to get re-elected, and this move will definitely get the radical pro-illegal immigration forces on his side.

But refusing to enforce the law in order to get a voting block on your side is no way to run a country.

Now Obama will almost certainly claim that anyone that is for enforcing our immigration laws is against Hispanic people.

But that is complete and utter nonsense. The truth is that God created all of us and we are all equally valuable in His eyes.

That is why the Declaration of Independence says that "all men are created equal".

All people should be loved and all people have great value.

We are a nation of immigrants and we will always need legal immigration.

But what we have now is a system that does not make sense at all. Right now, legal immigrants have to pay outrageous fees and go through months of hell in order to do things legally, and illegal immigrants just have to hop the border and start enjoying the free ride.

Today, far more immigrants move into the United States illegally than come in through the legal process. Now, thanks to Obama, even more people are going to come pouring in illegally.

There is nothing wrong with wanting everyone to come in through the front door.

In fact, it is the only thing that makes sense.

Right now millions upon millions of criminals, drug dealers and gang members are pouring across our poorly guarded border with Mexico. Large numbers of welfare parasites and people with dangerous diseases are also coming across on a regular basis.

Illegal immigration costs our economy billions upon billions of dollars. Illegal immigrants pay next to nothing in taxes, but they have no problem receiving tens of billions of dollars worth of free education benefits, free health care benefits, free housing assistance and free food stamp benefits.

According to a review of U.S. Bureau of Labor Statistics and Census Bureau data, legal and illegal immigrants gained over a million additional jobs between 2008 and 2010 even as millions of American citizens were losing their jobs during that same time period.

The cost of educating the children of illegal immigrants is staggering. It is estimated that U.S. taxpayers spend $12,000,000,000 a year on primary and secondary school education for the children of illegal immigrants.

So is it really unreasonable to ask the federal government to protect our borders, enforce our laws and require that all immigrants come in through the front door?

Well, that may seem like common sense to many of us, but unfortunately the Obama administration has chosen another direction.

So get ready for another huge wave of illegal immigrants.

After word of this new policy gets around, millions of them are going to be headed our way.

According to the Washington Post,  "the pace of company audits has roughly quadrupled since President George W. Bush's final year in office."

Oh please.  I don't care if an illegal lies his way into the military.  He still needs to be deported.  Go get in line behind all those immigrants who are doing it the right way.

Facebook issued an apology Saturday for deleting a post by Arizona Gov. Jan Brewer that criticized President Obama over his administration's new policy on prioritizing deportations of illegal immigrants.
Brewer's picture and a statement that accompanied it were removed Friday from Facebook, apparently because they "violated Facebook community standards."

"The post was removed in error," Andrew Noyes, Manager of Public Policy Communications at Facebook said in a statement. "We apologize for any inconvenience."

Before the photo's removal from the popular social networking site, it had garnered over 10,000 "likes" and comments, Brewer said in a follow-up post that included a reprint of Thursday's original deleted post.

Brewer, one of the president's toughest critics on border policy, said the administration's recent move to launch a case-by-case review of illegal immigrants slated for deportation amounts to an immigration overhaul "via executive fiat."

Why is it so hard for the Obama administration to comprehend the word “illegal”? If the Campaigner-in-Chief can handle a great big word like “redistribution,” what is it about “illegal” that he just can’t get?

It’s okay to our president because it suits his political needs for it to be so. President Obama sees an opportunity to pander to a 2012 voting block. And he’s not wasting any time.

In a statement released in Spanish on barackobama.com on Thursday, National Policy Director Katherine Archuleta wrote that the policy “hará que nuestro sistema de inmigración sea más justo e inteligente” (will make our immigration system more fair and intelligent). Really, Katherine? Rewarding lawbreakers doesn’t sound fair or intelligent to me, but to each her own.

Archuleta added, “Los candidatos a la presidencia republicanos son idénticos a los republicanos en el Congreso que han impedido cambios lógicos en cada oportunidad. En el debate Republicano de la semana pasada en Iowa, los candidatos únicamente hablaron de muros—como si muros más altos y estrechos mágicamente pudieran resolver este problema complejo.” (The Republican presidential candidates are identical to the Republicans in Congress that have prevented logical changes at every opportunity. In the Republican debate last week in Iowa, the candidates only spoke of walls — as if higher and narrower walls could magically solve this complex problem.)

What can you take away from this? Plenty.

First off, the apple doesn’t fall far from the tree in the Obama administration. It appears that Archuleta has our President’s blame game down to a science. Clearly President Obama’s lack of leadership on immigration is the fault of Republicans! (even though he operated with a Democrat Congress for two years). Clearly Republicans are simply obsessed with walls! (a.k.a. securing the border and upholding the Constitution).

Sometimes you just have to laugh.

Secondly, is this President Obama’s version of outreach to the Hispanic community? Blaming Republicans for upholding our laws? Condoning lawbreaking? Perhaps he should take some time to think about the millions of hard-working Hispanic Americans who reside in this country legally, who enrich our culture and economy, and who have as little patience for lawlessness as I do.

President Obama, real leaders don’t play the blame game; they take responsibility for what they have and haven’t done. Real leaders don’t buck the law; they uphold it.

And real leaders are fired up to challenge you in 2012.

California "Dream Act" approved for illegal immigrants

(Reuters) - California Governor Jerry Brown signed into law on Monday a bill allowing illegal immigrants to receive privately funded scholarships to attend the state's public colleges and universities.

The bill, dubbed the California Dream Act, passed the state Legislature earlier this month and aims at helping illegal immigrants who earned a diploma after attending at least three years of high school in the state.

Enactment of the California measure came three days after opponents of a similar law in Maryland collected enough signatures to force a state referendum seeking its repeal.

"At the end of the day, if we're going to continue as a powerful, equal-opportunity society, we're going to have to invest in our people," Brown, a Democrat, said at the signing ceremony in the library of a Los Angeles community college.

The California law is named after national legislation in Congress to give young, undocumented immigrants who have lived in the United States for at least five years a pathway to citizenship through college or military service.

The federal bill failed to win passage in December 2010, and its chances have dimmed since a newly elected Republican majority took control of the House of Representatives.

Critics say the California Dream Act gives illegal immigrants a false promise because their status will not change after graduating from college and they will remain unable to find legal employment. Former Governor Arnold Schwarzenegger, a Republican, vetoed an earlier version of the bill last year.

But Julian Rivera, 20, a student at the University of California at Berkeley who entered the United States illegally with his parents at age 12 from Mexico, said the measure could make it easier those like him to afford to stay in school.

"It doesn't matter where you come from, it doesn't matter what your background is, it just matters that you have passion for something and you want to do it," he said. "This is a country that has given us that freedom."

OPPOSING "THE DREAM"

Patrick McDonough, a Republican member of the Maryland House of Delegates who helped lead the petition drive for the repeal initiative there, said U.S. citizens who are struggling to pay for college should not have to compete with illegal immigrants for scarce financial resources.

"People would say, 'Why should we, when we're having tough economic times ourselves, pay for someone who is here illegally?'" he said.

The new California law is fairly limited in scope, making undocumented students who qualify eligible for private scholarships. A separate bill under consideration in the legislature would allow illegal immigrants to seek publicly funded scholarships as well.

State law already allows illegal immigrants who qualify for admission to a four-year state university to pay in-state tuition rather than the more expensive out-of-state tuition rate. But four-year institutions are still beyond reach for many undocumented students without financial aid.

Twelve other states also grant in-state tuition eligibility to illegal immigrants based on attendance and graduation from a state high school, according to the National Conference of State Legislatures.

Arizona, Colorado, Georgia, South Carolina and Indiana have laws barring illegal immigrants from in-state tuition benefits.

Passage of legislation in California and Maryland to extend private scholarships to illegal immigrants comes as a number of states, led by Arizona, have taken steps to crack down on the undocumented.

"You're going to see the red states go more the Arizona approach and blue states the California Dream Act approach," said John Skrentny, director of the Center for Comparative Immigration Studies at University of California, San Diego.

Blunt. Brash. Bold. Politically incorrect. Unapologetically patriotic. Philadelphia cheese-steak king Joey Vento was all that and a side of freedom fries. The 71-year-old owner of Geno’s Steaks died of a heart attack this week, but he reignited a national debate over radical multiculturalism that will burn for years to come.

Five years ago, Vento garnered national headlines when a local newspaper profiled his outspoken views on customers who couldn’t speak English. He hung a sign in his order window that read: “This is America. When ordering, speak English.” Though he never turned anyone away, the grandson of Italian immigrants informed hungry patrons that he reserved the “right to refuse service” to those he couldn’t understand.

No menus in 10 different languages. No dumbed-down pictographs for the idiocracy. The choice at Geno’s is simple: Sink or swim. Learn English or eat somewhere else. “If you can’t tell me what you want, I can’t serve you,” Vento told the Philadelphia Inquirer. “It’s up to you. If you can’t read, if you can’t say the word ‘cheese,’ how can I communicate with you — and why should I have to bend? I got a business to run.”

Vento’s refusal to coddle triggered a tsunami of complaints from self-appointed civil rights leaders. The ululations of the aggrieved resounded from sea to whining sea.

For exercising his constitutionally protected free speech, both the Philadelphia City Council and Philadelphia Human Relations Commission launched political inquisitions against Vento. Yes, it really happened in the home of Independence Hall. Members of the government bodies demanded that Vento remove his bald eagle-adorned sign and threatened to revoke his business license. After 21 months of investigation, a marathon seven-hour hearing and hysterical testimony likening his innocuous 4-inch-by-9-inch sign to “Jim Crow laws,” he was cleared of discrimination charges.

Plainspoken as ever, Vento understood full well why the multi-culti mob wanted to gag him: “I say what everybody’s thinking but is afraid to say.”

As a fellow Philly-born loudmouth, I cheered Vento on for years during his battles with the anti-assimilationists. He weathered the same old slings, arrows and accusations of being a “racist,” “xenophobe,” “nativist” and immigrant-basher — despite the fact that generations of assimilated immigrants and naturalized Americans agree with him. The vast majority of Americans support English as the official language of the United States. Latino parents in California revolted against “bilingual education” mandates that stuck their kids in Spanish-only classes.

Generations of successful immigrant families in America know English is the language of success, not the language of oppression. Yet, politicians in both parties have pandered ceaselessly to the language-Balkanizers.

The Clinton administration gave us Executive Order 13166, effectively requiring all government agencies to provide translations into any language on demand. Rather than rescind the order, the Bush administration went after localities and forced them to provide foreign language materials. In 2004, the Bush administration ordered Harris County, Texas, to provide all voter registration and election information and supplies, including the voting machine ballot, in Vietnamese, as well as English and Spanish.

Under the Obama administration, the Department of Justice threatened to cut off federal funding to the state of Oklahoma over a state constitutional amendment proposal to designate English as its official language. The Obama DOJ also has ordered my home state of Colorado to protect the interests of “language minority populations” by funding free translators for any foreigners — legal or illegal — who sue in civil cases here. In the same vein, the Philadelphia Human Rights Commission that tried to silence Vento distributes pamphlets asking “Are you a victim of discrimination?” in seven languages.

“Progressive” politicians pandering for votes treat non-English speakers as hopeless victims of white hegemony, instead of beneficiaries of the American dream. By contrast, small-business man Joey Vento promoted a common culture, a common tongue and common sense. We need more assimilation warriors like him to challenge the infantilizing Babel Lobby.

Question: Can a non-U.S. Citizen join the United States Military?
Answer: Yes. A non-citizen can enlist in the military. However, federal law prohibits non-citizens from becoming commission or warrant officers.
In order for a non-citizen to enlist in the military, he/she must first be a legal immigrant (with a green card), permamently residing in the United States. It's important to note that the military cannot and will not assist in the immigration process. One must immigrate first, using normal immigration quotas and procedures, and -- once they've established an address in the United States -- they can find a recruiter's office and apply for enlistment.

Only Congress has constitutional authority to establish U.S. immigration policy, and fundamental reform requires legislative action. Thus the administration’s recent announcement that deportation will be sought only for undocumented immigrants who have committed crimes in the United States violates the separation of powers and is unconstitutional.

No president, of course, can hope to expel every undocumented person in the United States — they number perhaps upward of 11 million people. Human and financial resources to identify, apprehend, process and promptly deport millions have been lacking for years as has, arguably, the political will to do so. In this environment, immigration enforcement authorities, under administrations of both parties, have performed as best they could given their resources. Still, millions have been deported over the years. And while many had been convicted of serious criminal offenses, most deportees have not been in that category.

The policy that Obama unveiled last month differs fundamentally from the spotty immigration enforcement records of previous presidents. The administration indicated that, henceforth, deportation will be focused solely on illegal immigrants who have criminal records and that no enforcement resources will be expended on those who do not pose a threat to public safety. The effect is that undocumented individuals who have avoided apprehension at the border and not been convicted of a serious offense since arriving to the United States will no longer face the prospect of deportation, the most basic means of immigration enforcement.

This goes far beyond merely prioritizing the use of limited immigration enforcement resources. And it exceeds the president’s constitutional authority by, in effect, suspending operation of the immigration laws with respect to a very large and identifiable class of offenders.

The remarkable program stunned the legal profession and baffled immigration attorneys who say the government bounced their clients’ removal even when expulsion was virtually guaranteed.


Last month Obama implemented yet another system to spare a myriad of illegal immigrants from removal by authorizing—and encouraging—low-level field officers to block deportations by using an outrageously broad list of exemptions. The unprecedented program will allow droves of undocumented immigrants to remain in the U.S. by drastically expanding factors that can be considered to exercise (“prosecutorial discretion.”) That’s when agencies get to decide to what degree they enforce certain laws against particular individuals.


Apparently it was the icing on the cake that pushed several lawmakers to craft legislation to end the madness. Introduced in the House this week, the (Hinder the Administration’s Legalization Temptation Act (HALT Act) would eliminate the president’s widely abused humanitarian parole, temporary protected status and deferred action to spare illegal immigrants from deportation.


The measurer’s sponsor, Texas Congressman Lamar Smith, claims the HALT Act will prevent Obama from abusing his authority to grant illegal immigrants (“mass administrative amnesty,”) which he says is a rejection of Congress’ constitutional rights and shows utter distain towards the wishes of the American people. Smith reminds the president that Americans have called upon Congress to defeat several amnesty bills in recent years.


Not surprisingly, the open-borders movement has expressed outrage and the nation’s most powerful la raza group quickly issued a statement denouncing the proposed law as a (“cheap political stunt.”) The president should use his authority to suspend deportations of “people who pose no risk to public safety” while Congress focuses on “real solutions” to fix the nation’s immigration system, according to the National Council of La Raza (NCLR).


Coincidentally, Obama just spoke at the NCLR’s annual conference in Washington D.C. this week and told the crowd that the idea of reforming the U.S. immigration system on his own(“is very tempting,”) but under the U.S. Constitution, he is unable to do so without Congress. He did promise to enforce “flawed laws in the most humane and best possible way.”

SACRAMENTO –  Illegal immigrants can now apply for state-funded scholarships and aid at state universities after Gov. Jerry Brown announced Saturday that he has signed the second half of a legislative package focused on such students.

AB131 by Assemblyman Gil Cedillo, D-Los Angeles, is the second half of the California Dream Act. Brown signed the first half of the package in July, which approved private scholarships and loans for students who are illegal immigrants.

Under current law, illegal immigrant students who have graduated from a California high school and can prove they're on the path to legalize their immigration status can pay resident tuition rates. The bill would allow these students to apply for state aid.

The contentious second half of the package requires that immigrant students meet the same requirements as all other students applying for financial aid at state universities but specifies that they only qualify for financial aid after all the other legal residents have applied.

"The signing of now both parts of the California Dream Act will send a message across the country that California is prepared to lead the country with a positive and productive vision for how we approach challenging issues related to immigration," Cedillo said.

The bills are different from the federal Dream Act, which includes a path to citizenship for the children of illegal immigrants.

Brown says the bill expands educational opportunities for all qualified students.

"Going to college is a dream that promises intellectual excitement and creative thinking," Brown said. "The Dream Act benefits us all by giving top students a chance to improve their lives and the lives of all of us."

Critics of the bills say it undermines immigration laws and encourages illegal immigration by granting access to state resources reserved for legal residents. Many Republican lawmakers say legal students have had their grants cut in light of recent budget cuts to higher education.
Assemblyman Tim Donnelly, R-Hesperia, said the bill's passage will the biggest mistake the Democratic Party makes.

"The polling indicates that 80 to 90 percent of Californians are against this, and it crosses party lines," Donnelly said. He said he hopes to get a ballot initiative overturning the law started as soon as the bill is officially included in state statutes.

"It is absolutely, fundamentally wrong and unfair and it is an insult to people who have worked and played by the rules, including those who have come to this country legally," he said.

Ginny Rapini, coordinator for the NorCal Tea Party Patriots, said there should be consequences for illegal immigrants and giving them an education funded by California taxpayers isn't fair to the legal residents who can't afford to pay for their own tuition.

"What part of illegal do we not get? When people come here illegally they need to come here with the same rules and regulations that other people came here with," Rapini said.

Supporters argue that children whose were brought to the U.S. illegally by their parents shouldn't be punished.

The state Department of Finance estimates that 1 percent of all Cal Grant funds, the state student financial aid program, will be affected by the legislative package when it goes into effect in January 2013. The department says that 2,500 students would qualify for aid under the bill and estimates the costs to equal $14.5 million of a $1.4 billion program.

LOS ANGELES — With their expectations soaring, young illegal immigrants across the country are preparing to apply for a temporary reprieve from deportation that the Obama administration is offering. For the first time, as many as 1.7 million of them could be allowed to work legally and live openly in this country without fear of being expelled.

Immigrants sought advice on applying for the deportation deferral program at the Coalition for Humane Immigrant Rights of Los Angeles on Saturday.

The program is President Obama’s most ambitious immigration initiative by far, a sweeping exercise of executive authority after Congress failed to pass the Dream Act, legislation he supported that would have given legal status to the young immigrants. It is a major bid by Mr. Obama to win back Latino voters who were souring on him after his administration deported nearly 1.2 million immigrants, most of them Latinos, in the last three years.

The initiative to defer deportations, which Mr. Obama announced in June, officially starts on Wednesday, when a federal immigration agency will begin accepting requests.

Brewer blocks undocumented immigrants from receiving public benefits

Arizona Gov. Jan Brewer on Wednesday ordered state agencies to deny driver's licenses and other public benefits to young illegal immigrants who obtain work authorizations under a new Obama administration policy.

In an executive order, Brewer said she was reaffirming the intent of current Arizona law denying taxpayer-funded public benefits and state identification to illegal immigrants.

Young illegal immigrants around the nation on Wednesday began the process of applying for federal work permits under the Obama administration's Deferred Action for Childhood Arrivals.

The federal policy defers deportations for that group if they meet certain criteria, including arrival in the United States before they turned 16 and no convictions for certain crimes.

After President Barack Obama announced the policy change in June, Brewer labeled it "backdoor amnesty" and political pandering by the Democratic president.

Arizona has been in the vanguard of states enacting laws against illegal immigration.

The U.S. Supreme Court in June overturned parts of the Arizona enforcement law known as SB1070 but ruled that a key provision on requiring police to ask people about their immigration status under certain circumstances can be implemented.

The Obama administration challenged that law in 2010 after Brewer signed it into law.

In the past decade, Arizona voters twice approved laws denying publicly funded services, such as in-state resident university tuition rates, to illegal immigrants unless mandated by the federal government.
Brewer's order said the policy's federal paperwork doesn't confer lawful status on illegal immigrants and won't entitle them to Arizona public benefits.

However, it said the policy change "could result in some unlawfully present aliens inappropriately gaining access to public benefits contrary to the intent of Arizona voters and lawmakers who enacted laws expressly restricting access to taxpayer funded benefits and state identification."

Brewer directed state agencies to start any necessary emergency rulemaking processes to implement her order.

State Rep. Catherine Miranda, who supports the federal program, called Brewer's action mean-spirited.

"She just continues to put obstacles in front of young people in Arizona," the Phoenix Democrat said.

Rep. Martin Quezada, D-Phoenix, said he questioned whether the order would have much practical effect under Arizona's current laws. But he said it served to demonize good kids who should be allowed to get state-issued identification and enter the workforce.
