Megaupload.com Gets Hit By Mega Piracy Indictment

The Justice Department has indicted seven individuals and two companies behind the popular file sharing website Megaupload.com which has been touted by stars will.i.am, Kim Kardashian and Puff Daddy.

The indictment alleges that the website and a shell company associated with the website, Vestor Limited, caused an estimated half-billion dollars in copyright losses and made an estimated $175 million in proceeds. The website was established in 2005 and at one point ranked as the 13th most visited website on the Internet.

The feds indicted the site's founder, Kim Dotcom, aka Kim Schmitz, a 37-year-old resident of Hong Kong and New Zealand. He was arrested in New Zealand by New Zealand authorities.

Also indicted were employees Bram van der Kolk, aka Bramos, 29, Julius Bencko, Finn Batato, Sven Echternach, Mathias Ortmann, and Andrus Nomm. New Zealand authorities arrested Batato, Ortmann and van der Kolk. Bencko, Echternach and Nomm remain at large, officials said.

The indictment accuses the suspects of being members of "the Mega Conspiracy, a worldwide criminal organization whose members engaged in criminal copyright infringement and money laundering on a massive scale."

The case comes a day after internet companies and websites such as Google, WordPress and Wikipedia protested about the Stop Online Piracy Act (SOPA) and the PROTECT IP Act (PIPA).

An hour after the indictment was announced, the Justice Department's website, www.Justice.gov, came under cyberattack with a denial-of-service attack. Anonymous, the hacktivist computer group, is claiming responsibility.

The indictment returned by a grand jury in Virginia alleges, "In exchange for payment, the Mega Conspiracy provides the fast reproduction and distribution of infringing copies of copyrighted works from its computer servers located around the world. Premium users of the site... are able to download and upload files with few, if any, limitations."

Describing the operation of the site and relations with users the indictment noted, "For much of its operation, the Mega Conspiracy has offered an 'Uploader Rewards' Program, which promised premium subscribers transfers of cash and other financial incentives to upload popular works, including copyrighted works, to computer servers under the Mega Conspiracy's direct control and for the Conspiracy's ultimate financial benefit."

The seven suspects have been charged with participating in a racketeering conspiracy, conspiring to commit copyright infringement, conspiring to commit money laundering and two substantive counts of criminal copyright infringement.

If convicted they could face a maximum of 20 years in prison.

Isnt looking good for Megaupload, if you read the 70 page indictment, there's evidences employees looked at illegal films, porn etc that certain uploaders were uploading, then paid them for it through there uploader reward program.

They have internal emails from staff requesting certain illegal files, like copies of tv show Seinfeld, evidence of staff uploading illegal files themselves, and quotes like this gem recovered from internal chat "we're not pirates, we're just providing shipping services [sic] to pirates .".

not in peace time, its call the bill of rights.

Are you kidding yourself?

It doesn't matter whether you are in peace time or not.

Edit: Based off of what I have read in various news journals & media outlets, this is what seems to be brewing by way of new laws (Sources: Guardian UK, CNN, RealClearPolitics.com, Wall Street Journal):

Patriot Act - No right to privacy.  You say, "well not in peace time".  Seeing as we are perpetually always involved in a war, that means there could never technically be a "peace time".  We've been involved in the Iraq war for well over a decade now, still waiting on peace time.  Afterwards, they will justify our having military presence in well over 150 countries as a justifiable reason why we are truly never in "peace time".

National Defense Authorization Act (NCAA) - Signed, seal and delivered.  By this measure, we are practically living in a military dictatorship, whereby anyone directly/indirectly going against the "American Way" can be detained/arrested with no due process by the military.  So, peaceful protesters like those in the occupy Wall Street movement can very well be locked up with no trial, due to their going against the "American Way" and going against capitalism.

Stop Online Piracy Act - Ever wondered how much Chinese people get to enjoy their internet, don't worry, at the rate we are going, we will be experiencing a little of the same.

Protect IP Act (PIPA) - Mainly enforces the above measure.

Note: If any of the following is off, by all means, feel free to correct it.  This is just the bits and pieces that I have gathered as a consumer, active equity trader and personal investor in both domestic and foreign markets.

I remember a great line by George Carlin ~ "And rights aren't rights if someone can take them away. They're privileges. That's all we've ever had in this country, is a bill of temporary privileges."

Here's a little excerpt from that sketch..

"In 1942 there were 110,000 Japanese-American citizens, in good standing, law abiding people, who were thrown into internment camps simply because their parents were born in the wrong country. That's all they did wrong. They had no right to a lawyer, no right to a fair trial, no right to a jury of their peers, no right to due process of any kind. The only right they had was...right this way! Into the internment camps.

Just when these American citizens needed their rights the most...their government took them away. and rights aren't rights if someone can take em away. They're privileges. That's all we've ever had in this country is a bill of TEMPORARY privileges; and if you read the news, even badly, you know the list get's shorter, and shorter, and shorter."

Not to mention that the Bill of Rights was also ironically signed during a time where owning another human being (Slave) was seen as perfectly normal.

They were in peace during those times as well, but certain people were just not deemed human or worthy of rights..

A little excerpt from the American Civil Liberties Union:

"And it was well understood that there was a "race exception" to the Constitution. Slavery was this country's original sin. For the first 78 years after it was ratified, the Constitution protected slavery and legalized racial subordination. Instead of constitutional rights, slaves were governed by "slave codes" that controlled every aspect of their lives. They had no access to the rule of law: they could not go to court, make contracts, or own any property. They could be whipped, branded, imprisoned without trial, and hanged. In short, as one infamous Supreme Court opinion declared: "Blacks had no rights which the white man was bound to respect."

stealing movies and music one one thing. but to have control over such things is where it only begins. how many of you control your finances online? check your bank account, move money ect? you know what they did to egypt when they didnt go what they wanted? they shut off the net, cel phones. they had no access to money, atms, phones ect. this is where it all leads to. so those of you who think it about stealing episodes of sienfeild and downloads of puff daddy, wake the fuck up. i hope anonymous shuts the  all goverment websites down and fuck their shit up! so they can feel their own laws in effect!

One thing is to voice your opinion and overall stance regarding the proposed laws, but another thing is to aggressively employ guerrilla tactics involving online sabotage.

That will only serve as more ammunition for them to present in front of congress if need be as more of a reason to pass SOPA come Tuesday.

Censorship sucks, hence why we all like Yaroni,

Exactly.  In a time when we're facing such issues, it would seem especially unlikely that an anti-censorship group would attempt to use such a tactic.

As a matter of fact, it would seem very likely that such an event would take place only on behalf of persons who would be interested in seeing further laws passed.

Gotta wonder about these things.

Check out Mel Gibson's Odd look a few years back. Had nothing to do with a film. Regardless of what was written. Yet not one person on earth has said it had anything to do with ANON. Except me of course ;) He went on a late night talk show(which I can't find) wearing a musketeer type hat and facial hair like this. I'd bet the house that it was some sort of show of respect to the Hierarchy/ANON movement.
