House moving to hold Holder in contempt

The House of Representatives is moving forward with proceedings to hold Attorney General Eric H. Holder Jr. in contempt of Congress — a major escalation in the separation-of-powers battle over "Fast and Furious," the Obama administration's botched gun-walking operation.

Rep. Darrell E. Issa, California Republican and chairman of the House Oversight and Government Reform Committee, said his panel will take up the contempt issue next week, and the move has the blessing of House Speaker John A. Boehner, Ohio Republican.

"The Justice Department is out of excuses," Mr. Boehner said in a statement Monday morning. "Either the Justice Department turns over the information requested, or Congress will have no choice but to move forward with holding the Attorney General in contempt for obstructing an ongoing investigation."

Both Mr. Holder and President Obama have acknowledged the operation — which allowed guns to be sold to straw purchasers in the U.S. with the knowledge they were being sent across the border to Mexican cartels — was wrong. But they said the operation was handled entirely by Bureau of Alcohol, Tobacco, Firearms and Explosives employees, with little oversight at the Justice Department.

Mr. Issa, though, is investigating who in the Justice Department knew of the operation's tactics. He has obtained sealed affidavits supporting wiretaps that he says indicate top Justice officials knew the tactics.

His committee issued a subpoena for documents in October, and Mr. Issa said Monday that the Justice Department still is withholding information in violation of that.

"Specifically, the Justice Department has refused to turn over critical documents on the grounds that they show internal Department deliberations and were created after February 4, 2011 — the date Justice issued a false denial to Congress. Contempt will focus on the failure to provide these post February 4th documents," Mr. Issa said.

Mr. Issa said the Justice Department hasn't asserted any valid reasons to withhold information.

Last week, Mr. Holder told another House panel he would be willing to sit down with Mr. Boehner, Mr. Issa and other House Republican leaders to try to work out a solution.

This would be the first time the Obama administration has faced contempt of Congress proceedings.

House Democrats approved a contempt resolution against former White House adviser Karl Rove in 2008, seeking an interview with him on his role in the firing of U.S. attorneys. Mr. Rove refused an on-the-record sworn interview with congressional investigators.

The House voted 223-32 to hold him in contempt, with most Republicans boycotting the vote.

In 2009, after President George W. Bush left office, Democrats and former Bush officials reached an agreement to produce documents and on-the-record testimony.

House Committee and Oversight and Government Reform Chairman Darrell Issa told BuzzFeed today that he expects 31 Democrats will join Congressional Republicans in finding Attorney General Eric Holder in contempt of Congress for failing to turn over documents relating to a botched gun-running investigation.

Issa, who has risen to national prominence as the point of the Republican spear in investigating alleged Obama administration wrongdoing, called for a committee vote on contempt next week in advance of a full House vote on Holder's conduct in the so-called "Fast and Furious" operation, in which a federal agent was allegedly killed with a gun the Bureau of Alcohol, Tobacco and Firearms allowed to be trafficked.

"The real question is, we’re opening up the data that we have to all the members, so as they start reading specifics of what we know was known and was hidden from Congress, and what we’d like to know and been denied, how many of the Democrats will vote with us," Issa said after speaking at the Personal Democracy Forum in New York. "I expect we’ll have about 31 Democrats with us."

Issa said under normal circumstances he'd expect the vote to pressure Holder to turn over the documents, but that now he's hoping the president intercedes on Congress' behalf.

"After Thursday’s hearing with the Attorney General, no, I don’t expect it, but I would hope that the president would second-guess the man that he says he has full faith and confidence in, and tell him that it’s time to deliver reasonable documents," Issa said.

Issa compared the growing scandal to Iran Contra and Watergate, saying the cover-up is far worse than the "dumb" operation.

"This is like Iran Contra, like Watergate, and other embarrassments over the years," Issa said. "The major embarrassment is the delay in being honest and open about it. It’s not about something really dumb got done. Dumb things happen in government. But when the GSA did dumb things, once it became public we saw a pretty quick change, certainly Secret Service we saw an even quicker change."

Asked whether his committee would hold hearings to investigate White House leaks, Issa said that while he has jurisdiction to investigate, his committee currently has no plans to.

"We have a very busy schedule, and we will coordinate with the other committees [to investigate]," he said, noting that the House and Senate intelligence committees would likely take the lead.

Just hours after it was reported that the House Oversight Committee will hold a vote next week on whether contempt charges will be brought against U.S. Attorney General Eric Holder, White House Press Secretary Jay Carney responded during a briefing, criticizing Republicans for playing “politics.”
 
Carney also said President Obama has “absolute confidence” in the attorney general. The press secretary then praised Holder’s department for giving “substantial cooperation” to investigators, including 7,600 documents and hours of testimony.

Asked by Fox News‘ Ed Henry for the White House’s “view” on the contempt charges, Carney started (seemingly sarcastically), “The White House view….”
 
The response got a good laugh from other reporters in attendance at the White House briefing.
 
Carney then hastily rattled off a pre-prepared answer:
 

“As you know Ed: Fighting criminal activity along the southwest border including the illegal trafficking of guns to Mexico remains a priority of this administration. The attorney general has also made clear that he takes the allegations that have been raised very seriously and that is why he asked the inspector general to investigate the matter.”
 
“I can only refer you to the Republican House Judiciary member who recently conceded, uh, that this investigation is quote, ‘politics,’” Carney said, not identifying the congressman he was referring to.
 
The latest round of rumored contempt charges against Holder are the result of the attorney general’s failure to provide documents relating to operation Fast and Furious requested under subpoena on Oct. 12, 2011, lawmakers say.

Depending on its level of importance and how many times he was briefed, he may not remember.  It's not uncommon for senior level officials to get tons of briefings in one day.

But, somewhere on the chain of command is somebody who was briefed regularly and thoroughly and authorized this fuck up.

The best way to have handled it, would have been to say person X was the senior responsible party...person X is now out of a job.

Hiding shit, not cooperating, not giving them the data....somebody's being protected (I would guess), and that just makes it worse.

Alberto went out of his way to somehow not remember shit from weeks ago - things he had been prepped to testify about.  Methinks the top lawyer in the land has the ability to remember something something from 14 days ago that his team has been in crisis control mode in for months lol.

But, Holder will develop the same kind of amnesia.  He and AG should be cellmates.

Issa, Boehner decline ‘Fast and Furious’ meeting with Holder until DOJ satisfies document subpoena

Attorney General Eric Holder publicly asked House Speaker John Boehner, House oversight committee Chairman Darrell Issa and Sen. Chuck Grassley during a Tuesday morning hearing to meet with him one-on-one about Operation Fast and Furious. But the leading congressional investigators said a House subpoena from October 2011 is still pending and the ball is in Holder’s court.
 
“I want to make it very clear that I am offering to sit down, by myself, offering to sit down with the Speaker, with the chairman, with whomever, to try to work our way through this in an attempt to avoid a constitutional crisis and come up with way — creative ways, perhaps — in which we can make this material available,” Holder told Grassley on Tuesday. “But I’ve got to have a willing partner. I’ve extended my hand and I’m waiting to hear back.”
 
Later in the hearing, Holder amended his characterization of the DOJ’s standoff with Congress as a potential “constitutional crisis,” saying he should have called it a “constitutional conflict” instead.
 
Boehner spokesman Michael Steel told The Daily Caller on Monday that Boehner is willing to meet with Holder, but only after the attorney general first complies with congressional demands for documents related to the gunwalking scandal.
 
“The Speaker will meet with the Attorney General when the Attorney General complies with the reasonable, specific requests in the May 18 letter from House leaders and Chairman Issa,” Steel said in an email.
 
Issa’s spokesman Frederick Hill told TheDC that Holder’s public request for a meeting is a stonewalling tactic.
 
“As the committee has sought to accommodate the Justice Department’s concerns about documents that would affect ongoing prosecutions,” Hill said, “the attorney general needs show the same good faith by indicating what documents he is prepared to make available as a compromise and whether he is now prepared to drop his objections to delivering documents that do not affect prosecutions.”
 
“Discussions about Fast and Furious have been ongoing for nearly a year and a half,” Hill continued. “The Justice Department, however, did not express interest in reaching a workable solution until after the committee announced it had obtained detailed wiretap applications from a source and scheduled a vote on contempt. The Justice Department needs to demonstrate its interest in doing more than reciting old talking points.”
 
Grassley began his questioning of Holder on Monday by asking him about those wiretap applications. Issa and many other members of Congress have said they believe the documents prove several high-ranking officials in Holder’s inner circle were aware of gunwalking tatics used in Operation Fast and Furious, and gave approval of their use.
 
Holder and Rep. Elijah Cummings, the ranking House oversight committee Democrat, have said they don’t think the wiretap applications documents show that.
 
But Grassley countered Monday that during closed-door testimony in July 2011, former Acting ATF Director Kenneth Melson testified that those documents laid out gunwalking tactics in “alarming” detail. Grassley said that after Melson reviewed them in March 2011, “he immediately sent an email warning others, ‘back off the letter to Sen. Grassley in light of the information in the affidavits.’”
 
Grassley revealed Monday that congressional investigators asked Holder to turn over that Melson email in “July of 2011.”
 
The letter that was the subject of that email was a Feb. 4, 2011 statement to Grassley in which the DOJ said the Obama administration had never permitted guns to “walk” across the Mexican border. That statement was false; the DOJ withdrew the entire letter in December 2011.
 
But Melson’s secret deposition indicates that he knew the statement was false nine months earlier.
 
“We need to see it [the email] to corroborate his [Melson’s] testimony,” Grassley pressed Holder during Monday’s hearing. “But the Department is withholding that email along with every other document after Feb. 4, 2011. On what legal ground are you withholding that email? The president can’t claim executive privilege to withhold that email, is that correct?”
 
Holder maintained that “there is a basis for withholding these documents if they deal with the deliberative process” involved with ongoing prosecutions.
 
“But not on executive privilege?” Grassley asked.
 
“No,” Holder responded. “The tradition has always been that members of the Justice Department, whether they were led by Republicans or Democrats, withhold deliberative material,” Holder said.
 
Holder spokesperson Tracy Schmaler did not answer when The Daily Caller asked Monday whether Holder will turn over Melson’s email to congressional investigators.
 
In a statement released after Tuesday’s hearing, Grassley said that Holder “sounded willing to negotiate over releasing documents. That’s fine if the offer isn’t hollow,” he said. “We’ve been talking for a year and a half.”
