Auburn-area lottery winner Leroy Fick charged with four firearm-related felonies

BAY CITY, MI — A Williams Township man who appeared on a national television show after winning the lottery two years ago was back on TV today, appearing via a closed-circuit channel in a Bay County courtroom for his arraignment on four felonies.
Bay County District Judge Mark E. Janer arraigned Leroy N. Fick, 60, on two counts of felony firearm and single counts of larceny of a firearm and possession of a firearm by a felon. The charge of felony firearm carries a mandatory minimum sentence of two years in prison, to be served consecutively before any other sentences.
“Your honor, I wasn’t carrying a gun on me when I went in there to get those other ones,” Fick told Janer today, disputing the felony firearm charges.
Bay County Sheriff’s deputies in March were contacted by Fick’s brother, Lorain Fick, who said he had just noticed several rifles and shotguns were missing from their mother’s house in the 3100 block of South Carter Road in Williams Township. Lorain Fick told deputies he last saw the guns in a cabinet in October and theorized Leroy was responsible for their disappearance.
Deputies interviewed Leroy Fick, who denied taking the guns. They later found out he had hocked several firearms at a Bay City pawn shop.
When deputies went back to Fick with this information, he claimed he pawned the weapons because he needed money to keep his electricity on.
Fick in June 2010 won nearly $2 million in the state’s Make Me Rich! lottery. He took a post-tax lump sum of $998,570 and appeared on an episode of the TLC program “Lottery Changed My Life,” chronicling how he and adult son Jeffery Fick were spending their wealth.
The elder Fick sparked controversy when he unapologetically admitted he continued using his Bridge Card after winning the lottery.
Fick’s actions inspired legislators to fashion a new law requiring the Michigan Lottery to notify the Department of Human Services of the name and other information of a winner of a prize of $1,000 or more. DHS is then to apply an asset test when determining eligibility of an individual for food aid, with gambling winnings factored into the asset total.
Gov. Rick Snyder signed the bills into law in April.
This is the latest of Fick’s legal woes. In January, he pleaded guilty to a felony charge of illegal possession of a prescription painkiller in Isabella County Circuit Court, for which he served 45 days in jail. Upon his release, he appeared in Bay County District Court and pleaded guilty to three counts of illegal possession of fireworks, three counts of operating a motor vehicle on a restricted license and single counts of operating a motor vehicle on a restricted license, second offense, allowing an unlicensed person to drive and driving 97 mph in a 55 mph zone.
Judge Dawn A. Klida gave Fick credit for time served, but also placed him on probation, which he is still on.
By the time he pleaded in Isabella County, Fick had squandered his fortune and was living what his attorney John Wilson described as a hand-to-mouth existence. Fick spent his winnings on building a new house, a brand new Chevrolet Camaro, large amounts of fireworks and ill-advised investments recommended to him by his relatives and friends, Wilson said.
Jeffery Fick, now 32, likewise found himself in trouble with the law. Though he fashioned himself a retired gambler turned entrepreneur following his father’s luck with the lottery, the younger Fick was caught by police driving a stolen car on Aug. 2. Fick pleaded guilty to unlawfully driving away a motor vehicle and was sentenced to 180 days in jail. He is on probation until Oct. 31, 2014.
Fick today said he is unemployed, his source of income being an annuity that pays off once a month. He asked Janer to appoint an attorney to his case.
Janer set Fick’s bond at $15,000 cash-surety or 10 percent.

BAY CITY — A Williams Township man who won the lottery less than two years ago is now clear of criminal charges throughout the state, having pleaded guilty this morning to eight misdemeanors and one civil infraction in Bay County.
Leroy N. Fick, 60, on Thursday appeared before Bay County District Judge Dawn A. Klida and pleaded guilty to three counts of illegal possession of fireworks, three counts of operating a motor vehicle on a restricted license and single counts of operating a motor vehicle on a restricted license, second offense, allowing an unlicensed person to drive and driving 97 mph in a 55 mph zone.
“This is the end of a very tumultuous and long road for Mr. Fick,” said his attorney, John Wilson. “We’ve cleaned up all of his files around the state. We’ve taken care to get Mr. Fick back to solid footing in regards to the criminal law situation.”
Fick in June 2010 won nearly $2 million in the state’s Make Me Rich! lottery. Fick took his winnings in a post-tax lump sum of $998,570. Shortly thereafter, he began amassing criminal charges across the state and recently completed a 45-day sentence in the Isabella County Jail for illegal possession of a prescription painkiller.
Fick sparked controversy when he admitted to using his Bridge Card even after winning the lottery. The state Senate today approved a bill preventing future lottery winners from receiving public food assistance.
“This is a very sad story,” Wilson said. “It’s a story that the money he won is essentially gone. He’s living hand-to-mouth again, and it’s very sad to see how he’s been taken advantage of by his family and other people who swooped in.
“He obviously knows things got way out of hand,” Wilson continued, adding that Fick’s son and daughter were largely responsible for their father’s decline. “They’re not coming back to his house, his son or his daughter. He frankly doesn’t have the money to be getting into trouble again.”
The fireworks charges stem from witnesses seeing Fick with Roman candles, mortars and sky rockets at his home on Sept. 5 and 26 and near the intersection of Flajole and West Townline roads on Sept. 27.
Wilson previously said a good portion of Fick’s money went toward purchasing fireworks. When Fick and son Jeffrey Fick appeared on the TLC program “Lottery Changed My Life,” he displayed a pile of fireworks he said he obtained from “the Indians in Mount Pleasant.”
Per Wilson’s request, Klida sentenced Fick to 45 days in jail with credit for time served.
“License restrictions are there for a reason, and you need to comply with that,” Klida told Fick. “Whether you think it’s appropriate or not, that’s the law.”
Fick declined to comment and only spoke throughout the hearing to answer the judge’s yes-or-no questions.

BAY CITY — A self-styled retired gambler who happens to be the son of an Auburn-area lottery winner will be spending the next few months behind bars for stealing an elderly man’s car.
In a noticeably more somber demeanor than he displayed at his August arraignment, Jeffery L. Fick, 31, this morning appeared before Bay County Circuit Judge Joseph K. Sheeran. The judge sentenced Fick to 180 days in jail with credit for 15 days served and an additional 185 days deferred. Upon his release, Fick is to serve three years of probation. He must also pay $970.71 in court costs and restitution.
“I just know I made some serious mistakes,” Fick told the judge. “I apologize to all parties involved. I’m trying to do the right thing. I been through some hard times in my life. I did what I thought I had to do.”
Bay City police arrested Fick Aug. 2 after spotting him driving in a stolen 2005 Chevrolet Malibu. Fick told officers his car was in the shop and he took the Malibu from a Bay City garage a few nights before.
The car belonged a 90-year-old man whom Fick did not know, court records show.
Fick in September pleaded guilty to one count of attempted unlawfully driving away an automobile.
Fick’s father, Leroy N. Fick, in June 2010 won nearly $2 million in Michigan’s Make Me Rich! lottery. Controversy arose when the elder Fick admitted he continued using a Michigan Bridge Card even after winning the jackpot.
At his arraignment, Jeffery Fick said he is a retired gambler and that he trusted his father to take care of him.
Bay County Prosecutor Kurt C. Asbury said today that Jeffery Fick has a lengthy criminal record including two felony and nine misdemeanor convictions.
“What’s going on?” the judge asked Fick. “Why do you do this? You stole an elderly man’s car and left him stranded.”
“I was under a time in my life that I had no vehicle and I had people relying on me to get them transportation,” Fick replied. “I shouldn’t have did it, I know I shouldn’t have did it.”
Fick said he is trying to adjust his behavior by keeping drugs out of his life and seeking employment.
The judge asked Fick to elaborate on the hard times he said plagued his life.
“I just never really had money to get what I needed in my life,” Fick responded.
“Has that changed?” Sheeran asked.
“Not really,” Fick replied.
“Is your father helping you out?”
“He’s doing what he can, sir.”
Leroy Fick is charged with two misdemeanor counts of possession of illegal fireworks in Bay County District Court.
A recently-aired episode of the reality show “Lottery Changed My Life” features the Ficks. The episode is reairing at 6 p.m. Sunday on TLC (Charter channel 41).

BAY CITY, MI — In learning he’s to spend at least the next year in prison, a Williams Township man who won close to $2 million in the lottery two years ago lamented the state of his life and the fortunes he squandered.
“I had so many pressures coming on me from all directions, I snapped, I guess,” said 60-year-old Leroy N. Fick, appearing before Bay County Circuit Judge Joseph K. Sheeran on Monday morning. Fick added that though he quit drinking alcohol a decade ago, he suffers from blackouts and mental problems.
Sheeran sentenced Fick to 13 to 60 months in prison, with credit for two days served. The judge also ordered Fick to pay $1,100 in fines, costs and restitution.
Fick in August pleaded no contest to larceny of a firearm and felon in possession of a firearm. Both charges are five-year felonies.
Though nearly destitute now, Fick in June 2010 won close to $2 million in Michigan’s “Make Me Rich!” lottery. He took a lump, post-tax sum of $998,570 and was later featured alongside his son, Jeffery Fick, on the TLC program, “Lottery Changed My Life.”

With his winnings, Fick demolished his home and built a new one on the same site, purchased a brand new Chevrolet Camaro and spent a significant amount on fireworks. All he has now is an annuity, though the amount he receives isn’t enough to pay the land tax on his house, he told Sheeran.
Hangers-on quickly picked him clean of his cash, Fick said.
“The whole thing just blew up in my face,” he said. “I thought people would love me if I helped them out some. I had the wrong idea, I guess. They all turned on me and that was it.”
Sheeran told Fick he has two felony convictions and 26 misdemeanor convictions dating back to 1969, and that his life didn’t start to unravel when he won the lottery.
Fick was on probation in Midland County on a charge of possession of cocaine when he was arraigned in Bay County in June on the firearm charges, Sheeran said. The firearm counts stem from Fick stealing heirloom rifles and shotguns from his mother, which he then pawned for money he needed to keep his electricity on.
Fick’s troubles began shortly after winning the lottery when he admitted to continuing to use his Bridge Card. The following year, 25-year-old Lincoln Park resident Amanda Clayton won $1 million on “Make Me Rich!” and also continued using her Bridge Card. The conduct of Fick and Clayton prompted legislators to fashion a new law requiring the Michigan Lottery to provide to the Department of Human Services the name and other information of a person who wins $1,000 or more. DHS must then apply an asset test to determine the winner’s eligibility for food aid.
Authorities charged Clayton with welfare fraud, a count to which she later pleaded no contest. Clayton was sentenced to six months of probation in July, but was found dead of an apparent drug overdose in September.
Fick in January appeared in Isabella County Circuit Court and pleaded guilty to a felony charge of illegal possession of a prescription painkiller, for which he served 45 days in jail. Upon his release, he appeared in Bay County District Court and pleaded guilty to three counts of illegal possession of fireworks, three counts of operating a motor vehicle on a restricted license and single counts of operating a motor vehicle on a restricted license, second offense, allowing an unlicensed person to drive and driving 97 mph in a 55 mph zone.
Fortunately for Fick, when he pleaded no contest to the two charges which he is heading to prison for, prosecutors dismissed two counts of felony firearm. That charge requires a mandatory two-year prison stay, which is to be served before any other sentence.
