Title: Verbal threats-- legally, how much weight do they carry?
Post by: haider on August 29, 2013, 11:27:51 AM
Say if an unknown person is harassing you over the phone and you threaten them with bodily harm, can that get you in trouble with the law?

None. They initiated the contact. They'd have to admit wrong doing too, if they sought to make an issue of it. In short nothing will happen, and if they tried to pursue charges, they'd at best be laughed at, at worst, charged themselves.

Why pick up the phone of an unknown person? Screen your calls at all times...

It's more complicated than that...I didn't pick up the phone. it was a scam in progress that I had to intervene, then had some nice words to say  :D I'm calling the cops on his curry ass soon.

what country are you in

in the uk there is a law against malicious phone calls

the threats are more difficult because you have to believe there is a genuine risk of harm which is difficult to prove unless they are phoning you from the hall way while you are cowering under the bed

Unknown??

If they're harrassing you that is an issue (charge). If you threaten them that is a seperate issue. One wrong plus another wrong does not negate the fact a wrong occured.

Doesn't matter who initiated either, that makes no sense UK or US law.

If you're afraid of what you said or did think back and remember the context of why it was said. Someone, called you...did they offer you something (evidence)? Threaten you (defense)? Try to strike a contract with you? Etc. Plenty of ways to turn the tables on what you said and make it relatively jusitified based on the facts.

You might want to look at your state's laws. It varies from State to State. So asking here, will get you nowhere or in trouble.

lol - yeah sure chump.

Haider here you go. Cornell has a great collection of restatements as well as other resources for you to mess around with. You can search statutues by your state.

http://www.law.cornell.edu/statutes.html (http://www.law.cornell.edu/statutes.html)

I wouldn't worry though, don't think anyone shit talking is going to call the police and go through the process of pressing charges; he obviosuly was talking shit for a reason but don't worry about it.

OK - best you don't worry about though. You'll have to sift through; tort actions, stalking actions, criminal actions, transmission actions, etc. etc. A person who wants to lawyer up can come at one through different ways; it's like the game of chess. Until he makes a move you won't know your next move. So I wouldn't worry about it if I were you; we've all said stuff in the heat of the moment (another defense to certain actions).

You made it over the phone so it wasn't imminent, wasn't going to provide a reasonable apprehension of fear, it could have been conditional, could have been a threat of future harm.....no over act with the threat (tort, sometimes crim element)

Best you don't research on it and continue with your day. Searching for law is daunting, it'll screw with your workout, lol.

phew  ;D Thanks for clearing that up. I want to report these guys to the authorities (he was impersonating as an 'officer') but I don't want it biting me in the ass if the conversation was being recorded on the other side.

How does one come to be involved in the plot(s) of curry munching scammers anyway?
;D

No idea where these people get your phone number man. This dude was furious that I laughed off his claim of being a cop and told him to fuck himself. He calls back and complains in his indian accent "YOU fuck *mumbles* FUCK guy you! You don't talk to an officer like that! *shuts phone*" while I'm laughing my ass off  ;D

In California a verbal threat will get u a criminal felony case of criminal threats and terrorist threats both strikes and carries a 10 year prison sentence, in Los Angeles all they need to have to arrest you is a witness and a victim to say you threatened them and they are scared for their life!

Depends on who 8r what you are threatening.

If you tell some one :

Im gonna kick your ass... not a crime.

However if you call them repeatedly and show up at their job. You will probably be arrested on some misdemeanor charge.

If you threaten to shoot up a movie theater again probably some disorderly conduct charge.

If you threaten the president. You are probably looking at federal time.

Kinda: it's criminal threats not terrorist threats (recent change).  You have to be threatened and be afraid of that threat. However, the criminal must be capable of carryIng out the threat too.  For example, a 100 lb downie can threaten to beat up  a 300 lb , no problem.

Also Max punishment is 3 years

Yep, people who kill you dont tend to warn you about it first.
Its like if you get stabbed, you very rarely see the knife beforehand.
People who wave knifes around in front of you dont really want to stab you, its just to frighten you.

more or less true

there are exceptions

eg. when someone is very angry they might want the other person to know whats coming

these are the type of people not to piss off

or it can just be a form of extreme trolling where it can be used to devastating effect  ;)
