Johnathon Burns from the Burns Law Firm in St. Louis is the attorney handling the case:
“What we’re arguing is that since he is deceased, those documents revert from being confidential, they revert back into the public sphere,” Burns said. “Missouri common law applies, and under Missouri common law, court records and virtually all other documents are open to the public.”
The teen who was fatally shot earlier this month had no criminal record as an adult, but Johnson claims it was due to the fact that Brown had only recently turned 18. He insists it is important to know the truth about Brown’s past in order to help confirm whether the parent’s statements of him being a “gentle giant” are really true.
“To find out if those police officers are correct requires seeing Brown’s juvenile arrest record, which ought to be freely available given that he is dead and therefore has no right to privacy remaining. Knowing the truth about Brown’s past will help us gauge the credibility of his parents and family who have called him a ‘gentle giant.’”
Johnson claims that the information he is about to obtain from the lawsuit will change everyone’s view of the Michael Brown shooting and reveal how the media “got played” with their coverage of the teen’s death.
It will be interesting to see what comes of all of this. The media from the beginning has attempted to spin the story in order to fit a certain agenda. But if it really comes to light that Brown was a murder suspect, that will be a really inconvenient fact to get past

This matters. Just like people would be jumping all over bad info in the cop's background. Imagine the frenzy if the cop had done something like attend a skinhead rally (or something similar).

It does matter. Suppose it ends up that Brown has a record for attacking women or police or even alcohol abuse treatment.
We'll realize it's more likely he ran into a life/death situation ready to murder someone.
THAT is why it's relevant. If the cop had NO CRIMINAL RECORD, and Brown had numerous run-ins with the law, then yes, we would tend to think Brown probably was the violent, dangerous one in the situation.

It does establishes a pattern of violent behavior. Having said that, I'm very skeptical the information is legitimate at this point. Let's wait and see what comes of it.

Its not going to be released because they are juvenile records. There's no lawsuit that can unseal them. Its makes no difference anyway because that cop isn't going to be indicted by any jury in the world. Still doesn't make it right for him to shoot an unarmed man as he had a number of other options such as his taser at his disposal but he'll have to live with it for the rest of his life.
Perhaps he should shack up with Zimmerman ;D

If the Prosecution attempts to portray the "Gentle Rapist" as a Saint, the door is automatically opened for the Defense to question his character and present evidence to the contrary.
This puts the Prosecution in a tough spot. They want to pander to the baboons rioting in Ferguson, and they certainly don't want to embarrass themselves in front of the DOJ. However, the ballistics don't support the media's talking points. Therefore, in order to get a conviction, they have to convince the jury that the cop provoked the incident and used deadly force when it was unnecessary to do so. This will require, among other things, presenting the character of the "Gentle Rapist" in a positive light.
Classic catch 22.

Agreed. If he has a history of violence, it should be noted. Doesn't 'prove' he attacked the cop, but they should put all the facts on the table.
