For all the "Stand Your Ground, Commando Cowboys" on this board. Please educate yourselves on the language of the law. You cannot shoot someone just because you feel threatened. There has to be a true threat. Furthermore, you will have to prove that point to a jury. This trigger happy cowpoke found out the hard way this morning.

DETROIT (AP) -- A suburban Detroit man was sentenced Wednesday to at least 17 years in prison for killing an unarmed woman who appeared on his porch before dawn.
Theodore Wafer was convicted of second-degree murder in the Nov. 2 death of Renisha McBride, 19. Before getting his sentence, the Dearborn Heights man apologized to McBride's family, saying he killed a woman who was "too young to leave this world."
"I will carry that guilt and sorrow forever," said Wafer, often pausing to control his emotions.
Wafer was convicted last month after a nine-day trial that centered on whether the 55-year-old had a reasonable and honest belief that his safety was in peril. He testified that he was awakened by pounding on his doors and shot McBride because he feared for his life. But a jury rejected his claim of self-defense.
Prosecutors recommended at least 17 years in prison for Wafer, including two years for unlawful use of a gun. Defense attorney Cheryl Carpenter asked for as few as six years in prison.
Noting Wafer's age, Carpenter said at the hearing Wednesday that anything more than 10 years in prison would be a "life sentence."
No one knows why McBride ended up at Wafer's home about 4:30 a.m., though prosecutors speculated she may have been seeking help. She had crashed her car into a parked car about a half-mile away in Detroit around 1 a.m. An autopsy found she was extremely drunk.
Wafer opened the front door and shot McBride in the face, firing through a screen door. He first suggested to police that it was an accident but later admitted to intentionally pulling the trigger.
The jury convicted Wafer of murder, manslaughter and a gun-related charge on Aug. 7. He will be eligible for parole after serving the minimum sentence.
Wafer is white and McBride was black, and some wondered in the aftermath of the shooting whether race may have been a factor, likening it to the shooting of Florida teenager Trayvon Martin. But race was hardly mentioned at trial.

But I was very suspicious before and after. Didn't put that roscoe down until the PD came.

actually there doesnt have to be a true threat, it just has to be decided that it was reasonable to believe that you were in danger of serious bodily harm and in some states that your property is.

You should look at the case with Joe Hendrix in which he shot an elderly man with alzheimers after he had tried to gain entry into his house in the middle of the night. Hendrix went outside after calling the cops and encountered the man on the side of the house. He asked what he wanted, told him to stop and he had a gun but the old man didnt and he was shot and killed.
Hendrix was not charged b/c it was determined that he had reason to believe he was in imminent danger of serious bodily harm...There was never any true threat to him.

Maybe you should re-word your statement to you have to reasonably believe that there is a true threat.
The elderly man posed no true threat to hendrix. It was simply reasonable to believe that he might in the situation.

I agree that any rational person would think it reasonable to believe there was a threat but that doesnt make the threat real.

So let me get this straight, a young woman gets so intoxicated, she crashed her car into a parked car, staggers around highly intoxicated and then approaches a strangers house at 4:30am and bashes on his door and gets her face blown of. Sounds like poetic justice to me. It never ceases to amaze me how irresponsible people often get responsible people in trouble. This man wasn't bothering anybody, just going about his business, sleeping in his own bed in his own house, when some irresponsible individual, one who had just broken the law by driving drunk, crashed her car into some poor strangers vehicle and then violates what is considered common decency everywhere and bashes on the door of his home at an ungodly hour. Sounds to me like the people who should be on trial is the so called victims parents, for raising an uncivilised idiot.
