How the hell is a foot (kicking a guy down) deemed a deadly weapon?!?

In many states, ADW becomes a catch all term for anything used in an offensive/violent manner. You'll see it a lot in child abuse cases especially, where a belt, shoe, extension cord, etc.... becomes a deadly weapon to upgrade the charges. From the sound of this, it sounds like it when from a simple fight to a Worldstar style stomp out.

Also, the capabilities of the practitioner and the disparities in capabilities are also taken into consideration. I think that being beaten by the fists of a prime Tyson would constitute a deadly assault.
