The lawsuit was filed in July but as of today's decision, it will proceed as a mediation. Court date is set for Oct 8th. BTW, Adam Paz is Kai Greene's business manager.

The attached order denies Pinnacle's application for injunctive relief. It does not dimiss the lawsuit. In fact, the 10/8 preliminary conference will set forth a discovery schedule that could easily take 2-3 years before it is fully complied with. At that point, the case could be placed on the trial calendar where the delay in NY County, where this case is venued, is at least one year. There is no mention of mediation in the order although that is always an option for the parties.
I do not know the merits of the case but one of the grounds that must be established in order to obtain injunctive relief is that there is a "likelihood of success." If you read the order, Justice Bannon is skeptical in this regard although her opinion here is by no means determinative of the ultimate outcome of the case.

It looks that way. If there's interest I can probably post the complaint and the underlying motion papers, which are all publicly available.
I should also point out that the standard for the injunctive relief in this motion is "clear and convincing," which is higher than the "preponderance of the evidence" standard that Pinnacle will have to meet in the underlying suit.

I've been reading the papers in this case. Here are some of the highlights:
Kai describes himself as the #2 bodybuilder in the world and having "numerous lucrative sponsorship contracts and other financially lucrative business deals pending."
Kai claims that Pinnacle told him that it also represented Serena Williams and Justin Bieber, yet Kai also claims that Pinnacle did not have its own office space.
Kai claims that Pinnacle induced him into signing up for, and paying premiums for, a life insurance policy, which named his girlfriend, Shanelle Drew, as the beneficiary. Kai claims Pinnacle told him that if he signed up for this policy, Pinnacle would get him health insurance, which "we [Drew] did want and needed."
Kai passed the physical for the life insurance policy but found the actual language of the policy "overwhelming and confusing."

I am at a loss here though. What does this have to do with MuscleMeds? I thought it was Pinnacle who manages athletes??

"This action for, inter alia, breach of contract, arises out of two purported contracts, one
between plaintiff Pinnacle, a sports and entertainment management company, and defendant
Greene, a top-ranked professional bodybuilder, for sports management services and the other
between Pinnacle and defendant Paz for Paz's employment as Greene's manager. When Paz
and Greene terminated their professional relationships with Pinnacle, Pinnacle moved pursuant
to CPLR 6301 for preliminary injunctive relief enjoining Paz from providing business
management and related services to Greene, based on a provision from the purported
employment contract between Pinnacle and Paz. The motion is denied."
