Good question... Also, in Texas the age of consent is 17, and the "victim" is 17 if I'm reading the article right.

A lot of states have laws regarding teacher / student relationships. Not age based.
My assumption is that Texas probably has one of those.

Even if the child is 18, no relationship can exist between a teacher and student in the state of texas. I believe that is the law.

Per the article, it does have such a law, but still, Texas State Law ends at the borders of the State of Texas. Another article on the topic, however, makes it clear that she allegedly had sex with students while in Texas as well.

In this case, it makes sense. Cant have a teacher and student (if the student is 18 and still in highschool) in a relationship. May lead to grade inflation, cheating, etc. Teacher may give the student answers to state wide tests if she has access, etc.

But even if the law helped advanced a state interest, is said interest compelling enough to justify regulating the private conduct of consenting adults? I'm not a big proponent of "slippery slope" type arguments but in this case that's what it boils down to: either we draw the line at the government regulating private sexual relationships between consenting adults, or we just need to file form F-1938 in triplicate before we can initiate flirtation.

Certainly I understand what you are saying, but it's like me arguing against seat belt laws and it having zero impact on their implementation.

Well, it doesn't prevent that, but like you said, its the whole "slippery slope" thing. There is probably a greater chance that a teacher would engage in unethical behavior (grade inflation) if she was dating the student, as opposed to a strict teacher-student relationship. In fact, we know that intimate relationships often entail more intimate acts of disclosure and trust (youre more likely to trust a best friend or a parent than your boss or stranger). As such, there is a greater likelihood that a teacher would engage in more intimate acts of disclosure (I am going to give you the answers to the test because I trust you) if she dated the student, as opposed to not dating him or her.
Personally, I don't think any teacher should date a student (even an 18 year old) if the student is being directly taught by the teacher.

The company isn't forcing me to work for them - I choose whether to do so. And if I choose to, and then violate he rules then the worse that can happen is that I lose my job.
The government, on the other hand, passes a law and enforces it using its monopoly on force, and if I choose to violate a law I face the prospect of losing my freedom.

I have a question since you never see the "victims" in these cases, but does anyone know if it's a disproportionate number of black boys? I don't think I've ever seen it be anything other than a white teacher, but I was wondering the race of the victim.
