In the summer of 2002, Banks was arrested and charged after classmate Wanetta Gibson falsely accused him of dragging her into a stairway at Polytechnic High School (Poly) and raping her. Faced with a possible 41 years to life sentence, he accepted a plea deal that included five years in prison, five years of probation, and registering as a sex offender. Wanetta Gibson and her mother Wanda Rhodes sued the Long Beach Unified School District, claiming the Poly campus was not a safe environment, and won a $1.5 million settlement.[18][19] In March 2011, Gibson contacted Banks on Facebook, met with him, and admitted that she had fabricated the story. Banks secretly recorded Gibson's confession, but she refused to tell prosecutors that she had lied so she wouldn't have to return the money she and her family had won in court. Nevertheless, with Gibson's taped admission and help from California Innocence Project attorneys, Los Angeles County prosecutors overturned Banks' conviction on May 24, 2012.[19]

On April 12, 2013, the Long Beach Unified School District announced it was suing Wanetta Gibson for $2 million in an effort to recoup the $1.5 million she received, along with attorney's fees and punitive damages.[20] On June 14, 2013, the school district won a $2.6 million judgment against Gibson, which includes the $750,000 settlement initially paid to her along with attorney's fees, interest, and $1 million in punitive damages.[21]

Banks now serves as a spokesperson for the California Innocence Project and is working on a documentary about his story.[12]

There surely is some punishment on her way but of course it won't be 6 years in prison.

One giving false testimony should be sentenced in jail. No matter what the testimony concerns. Be it rape, murder, anything.

Those who falsely accuse someone of a crime should get at least the maximum sentence the falsely accused would have gotten if convicted as well as all the other consequences (sex offender list, felon etc.). That is of course in addition to any civil penalties they receive.

I literally just got done with dealing with the exact same thing. I won't say much for legal reasons obviously but long story short it was completely false rape accusations with zero evidence or anything and I was being tried for sex assault. Just got dropped 2 weeks ago. Ridiculous,,,was a legitimate real life nightmare. Fuck women.

I don't have the resources to pursue that so no there won't. Even if I did try to make that happen I don't know if anything would, especially in my county. This whole thing went on over a year and during that course of time it really opened my eyes how things were done and it was pretty scary tbh. Like I was facing state prison time for something that someone was just making up, and the state found that enough to charge and arrest me and completely fuck my life for over a year's time.

I don't know. There's a significant difference between proving the girl lied and simply lack of evidence that it happened.

I don't know how this guy got convicted in the first place. It is shocking that testimonial lies were enough. That's the real problem.

that's why I kept my mouth shut the whole time and I'm saying it now,,,,,because it's dropped and done with,,,

I was charged based on nothing but false testimony, nothing else; there was literally zero case and the state knew that and I was still charged.

My county does this new thing where if you're out on bail you are put on probation no matter what. Even before you are found guilty. Your options are to either stay in jail until your case is done with (at least a year in my county), or you can pay your bail and get out and be put on probation. Monthly meetings and drug testing and all sorts of other guidelines that strip a lot of freedom away, have to pay for your meetings and have to pay for your drug tests that they order you to take. Over $100 every month. That means they roughly made $1500 off of me, they are doing this to thousands upon thousands of people. It's just a scheme to get more money for the county to spend. So they are locking anyone up for anything regardless of how strong the case is. If they know they are going to lose they will just dismiss it at the end after sucking money from you for over a year.

It's a ridiculous unethical scam that makes me sick to my stomach. The whole ordeal taught me A LOT about so many different things, and honestly scared the living shit outta me. Seeing how easy it is for them to take your freedom and just completely fuck you dry. Scary. Be careful getbiggers, seriously.

A coworker years ago got accused by a jealous chick we worked with. She was mad he had no interest in her and she claimed sexual assault in the office. The company fired him immediately. He didn't work for over a year while this went through court just for the whore to admit she made up the story his whole career was fucked and nothing happened to her.

I saw a follow up video a while back and he was playing for the buccaneers or Falcons I forgot,,,or he was at least training with them. I didn't know if it was training camp or actual team practice. Pretty sure he's in the league now though,,,,he ended up getting another chance thankfully is what I'm tryin to say lol
