Jelly Belly sued by woman claiming she didn't know jelly beans contain sugar

A California woman is suing the makers of Jelly Belly jelly beans, claiming she was tricked into believing one of the company's candy products was free of sugar.

The plaintiff, Jessica Gomez of San Bernadino County, first brought the case against the candy company earlier this year, blaming "fancy phrasing" for her confusion over the ingredients

reminds me of the time of I was getting a coffee at mcdonalds, and the fat chick in front of me is bitching to the staff not to put salt on her fries because she is under doctors orders to watch her sodium lol  ::). Like the salds at Mcdonalds probably have 2 grams of hidden sodium

It is sort of dumb, and I guess the girl doesn't mind looking like a moron.  But maybe the manufacturers will include "sugar" in the ingredient they currently refer to as "evaporated cane juice" or something similar (whatever it is).  They refer to it by that name for a reason, and the reason is to mislead (IMHO).

It wouldn't look good for them if this is the only JB product which lists it that way.

Your 'opinion' is 100% correct.  "Evaporated cane juice" IS simple sugar/sucrose.  I've been in the food industry for 30 years.  Label trickery is rampant and part of the game.

It could've been worse, she could have sued saying she didn't know they aren't actually beans.

Yes, same thing.  No matter how you slice and dice it, no denying it is sugar.

So why don't they simply use the right word and everyone's happy.

She's not dumb. You can sue anyone for anything nowadays and win. It's a smart way to make money. They'll probably just settle and she'll be better off.

Everybody knows jelly beans contain sugar.

This woman is milking the system.

And jelly bellys are delicious especially the buttered popcorn.

This is another often used misnomer, the "system" doesnt produce milk

Not important or relevant. Now what's your favorite flavor of jelly belly?

I also like the toasted marshmallow ones.

I have never eaten one jelly bean at a time so have no idea of individual flavours, I eat a hand full at a time.

I don't know, but at most they might send out a limited number of very small refund checks and include the word "sugar" in that ingredient.

Their official site:
http://www.sportbeans.com/

Quote
Sport Beans Energizing Jelly Beans are formulated to help fuel the body during intense exercise. Clinically proven to maximize sports performance, each bean is loaded with carbs for fuel, electrolytes to help maintain fluid balance and vitamins to optimize energy release and protect cells against oxidative damage. Flavored with real fruit juices and other natural flavors, they come in a convenient resealable bag that you will love.

They are trying to make these sound like health food. YMMV, but this sounds intentionally deceptive to me. :-\

is anybody old enough on here to remember this?

In 1992, 79-year-old Stella Liebeck bought a cup of takeout coffee at a McDonald's drive-thru in Albuquerque and spilled it on her lap. She sued McDonald's and a jury awarded her nearly $3 million in punitive damages for the burns she suffered.

-Liebeck sought to settle with McDonald's for $20,000 to cover her actual and anticipated expenses.

- During the case, Liebeck's attorneys discovered that McDonald's required franchisees to hold coffee at 180–190 °F (82–88 °C). At 190 °F (88 °C), the coffee would cause a third-degree burn in two to seven seconds.

- documents obtained from McDonald's showed that from 1982 to 1992 the company had received more than 700 reports of people burned by McDonald's coffee to varying degrees of severity, and had settled claims arising from scalding injuries for more than $500,000.

-The judge reduced punitive damages to $480,000, three times the compensatory amount, for a total of $640,000.

JB may cling to the idea that the stuff with bare traces of molasses in it (evaporated "cane" juice... bamboo cane or what do they mean?) is claimed to have a hint of different flavor.

The FDA won't warn them on this one, since they're joint owners of the FDA.

From the Jelly Bean website:

ingredients: sugar, glucose syrup, maize starch, water, fruit juice from concentrate (apple, orange, pineapple), acids (malic acid, citric acid, fumaric acid), glazing agents (shellac, beeswax, carnauba wax), natural flavourings, acidity regulator (sodium citrate), colours (anthocyanin, titanium dioxide, copper complexes of chlorophyllins, calcium carbonate, curcumin, vegetable carbon, mixed carotenes, paprika extract, lutein, chlorophyll), caramelised sugar, concentrate of spirulina.

The loophole was that the Drive Thru coffee was brewed a few degrees hotter so that it doesn't cool too fast while driving to your destination.  The problem was they never revealed this fact and that is what fucked them in court.

I'm not a big fan of letting companies deliberately lie.  And it has gotten way out of hand.  Any Arby's or Jack in the Box or Taco Bell commercial pictures food that is unrecognizable from what you get there.

And why have any FDA or other oversight of any of this stuff if they are just simply allowed to deceive?

But I guess muscle mags would be about 25 pages thick without the lies.

Like the taco bell commercial that shows a guy eating a burrito holding it with two hands like it's a footlong but in reality it's barely 5 inches long.  No homo.

Evaporated Cane Juice is really dodgy wording on ingredients however what makes it worse is that this product as an exercise supplement.  I have to respectfully disagree with you on this as the company has full liability in listing clearly the ingredients on packaging although I don't believe the lawsuit has any real merit as she could have looked it up the wording.

So she's so misinformed that she didn't know that evaporated cane juice is sugar and too stupid to read the nutrition panel where it says how many grams of SUGAR the product contains? Sounds like she needs to finish kindergarten and learn to read again. Every company, by law, needs to list the amount of sugar in their food product. Jelly Bean company DID, like ALL food producing companies do.

You know the answer. They were intentionally trying to be misleading. The term is used solely to disguise the inclusion of sugar. They would have never have had the balls to market this shit as healthful if they listed sugar as the first ingredient.

Yes, it does. That terminology is used almost exclusively for products that are marketed as healthy or natural and there is no substantive difference between how table sugar and evaporated cane juice are produced. The FDA recommended food producers stop using the term a few years back precisely because it was most commonly used by "health food" marketers who were trying to pass it off as a natural ingredient. Unless you're an idiot, there's no way you can look at that Sport Bean commercial and not see that they're trying to conceal the fact that they are sugar bombs.

What's dumber? That she did not know they contained surgar? Or the fact that bullshit like this was actually made a case by the courts in this country. The real power in this country is those whom can delegate law, twist it to their advantage. While the rest of us just idly move on about our day to day business, watching our once great nation slowly sink into the abyss.

That's 100% correct.  People who buy/eat "Kashi" cereal might as well be eating Captain Crunch.  The same amount of sugar, albeit more vitamin fortified and more fiber.
