thats just isnt it

I was in rehab with that store owners cousin last November, said he was arrogant and a dick to everyone, especially family
-
This is an outrage!

;D

So you can't protect your business and your family. This was in Washington. I'm sure the justification of this sentencing was as justified as SEATTLE's 9 circuit "Muslim Ban".
-
so, the message to "would be" stick up men is that if its not going to plan after you have pulled a gun on someone simply turn your back on them and leave, you are then protected by the law.
-
someone taking cigarettes you let him.
smoking will eventually kill him anyway.

Pretty much. I suspect the reason he got 8 years was becausing the guy was fleeing. I believe you cannot shoot someone who is fleeing because they are no longer considered a threat. But perhaps one of our resident getbig lawyers can step in and provide information.
-
Shame.
Another question that needs to asked is what happened to this -
http://komonews.com/news/local/run--kick--punch-little-girl-thwarts-abduction-attempt-11-21-2015 .
He also had another robbery charge in 2015. he's out there kidnapping and robbing folks in 2014 and 2015, but he's still out to cause this poor guy trouble in 2016? Makes no sense.
-
So I take it no one noticed there were two stories.

Is it just me, or is there a GetBig member missing from this thread right now?
You just know he is sweating, shaking and biting his quivering lips as he holds back his right index finger from pushing send on his flip phone to regale us with yet another story of heroics and pulp fiction level criminality in order to relate to the OP's story

Hahaha ;D
Thankfully in most states you can still justify shooting someone as their back is turned, especially if they're still in possession of a weapon.
-
Worth the 8 years if you ask me.An animal tries to steal from me I would shoot him dead as well.Defijitely not right and that guy should get a fucking award for ridding the earth of that filth. But either way at the end of the day I would have a smile on my face for doing my job of killing this fucking scum that plagues the earth.

It's not like Jakeel Rashon Mason was going to re-create Beethoven's 9th symphony.

And we are all, are we not, collectively trembling in anticipation. . .Oh ESFruitness, where are thou? A schmoe by any other name would, well, still be a schmoe. 'n' sheit.

Only Beethoven can write Beethoven's symphonies.

I feel for the guy. I heard a report that his wife had been shot in the stomach by one of these rich and vibrant yoots just prior to this.
It's a fine line between self defense and murder. Hope he gets out early.

It's a fine line between self defense and murder
It shouldn't be though

It shouldn't be though
The people who make the laws largely have no idea what's it's like to have their wife shot, their life threatened, and end up in a gun fight.
I think society should always err on the side of the law abiding citizen when some dindu brings the fight to him.
No way to prove it but this chinaman probably saved lives by taking this scumbag out.
-
I had an investor buddy come by the gym one day to have a chat, & the fella points out to us that the new security cameras we were having installed that day would be useless in court if we were ever broken into because we didn't have any signs posted stating "hey thief! you are on camera" or something to that effect. So apparently if somebody smashed our window at night, entered the gym, waved to the camera, and even drove their truck inside the gym with their license plate clearly on camera, we could not use that tape in court to prosecute the thief. I was no longer interested in buying the place so I kept that little bit of information to myself & didn't mention it to the then owner. Lol

idiot.
Your signage has to be appropriate and in line with the Data Protection act.
"CCTV is in operation and is used for security and crime prevention."
By the way, if you put up CCTV signage and you are not filming/recording you can be prosecuted for that.
-
So you can't protect your business and your family. This was in Washington. I'm sure the justification of this sentencing was as justified as SEATTLE's 9 circuit "Muslim Ban".
The store owner was the one who plead guilty.....did you expect the judge to kiss him on the cheek and send him away??? ::)

Yep, great post!
-
Especially when protecting business and family
how do you protect your family.. a when they're not there and b when the person is running away from you?
this dindu was a giant pile of garbage and deserved death but should have left that up to tyrone or another homeboy
-
What about this then:
The homeowner, who is not being named, is not being charged because he 𝐚𝐜𝐭𝐞𝐝 𝐢𝐧 𝐬𝐞𝐥𝐟 𝐝𝐞𝐟𝐞𝐧𝐬𝐞.
He clearly shot them in the back while they were fleeing.
-
It take a while before I realize that the video in that page have nothing to do with the story.. ;D
Regardless the video, here is what really happen: "While he was outside, 21-year-old Jakeel Rashon Mason can be seen attempting to steal cigarettes from behind the counter of Kim’s store.
The footage shows Kim and Mason subsequently engaging in a fight. Ultimately, according to Q13 Fox, Kim can be seen shooting Mason in the back as he flees.". So he shot fleeing shoplifter after the fight was over and threat was gone. Wonder why he got 8 years from that kind of self-defence..
-

so, if we take this to its conclusion then a guy can walk into a store and unload his gun at the store owner, then as long as he turns his back and walks away while he reloads his gun the store owner cannot shoot the robber until he turns around and becomes a threat (in law) again.
Go and watch a few cops in Brazil dealing with store stick up artists who are fleeing, they just unload into them , head shots being a favourite

From a guy who's never owned, much less run a business.
When I want you british interpretation of American laws as they pertain to a business in California. You'll be the last to know.

so it was black vs. Asian
and the Asian came out on top
gaywon must be proud

shoot someone in the back, go to jail, thats pretty much the message the court is sending out.
Harley Brite would claim his client was fleeing and trying to take bullets out of his gun when the wicked shop owner mercilessly gunned him down.

So where this has happen? Not in this case where this Asian bloke got 8 years. You guys are bit fast to make conclusions, because as I say at he page 1, the video at the page with the news isn't from this case. ;D

Is this really so hard to understand? "While he was outside, 21-year-old Jakeel Rashon Mason can be seen attempting to steal cigarettes from behind the counter of Kim’s store.
The footage shows Kim and Mason subsequently engaging in a fight. Ultimately, according to Q13 Fox, Kim can be seen shooting Mason in the back as he flees.". So he shot fleeing shoplifter after the fight as a revenge when fight was over and threat was gone. Still wonder why he got 8 years from that kind of self-defence..

so someone can walk up to you in the street and sucker punch you in the face and then turn his back and walk away, so, in law the threats now gone and if you go and grab him then you are the aggressor and will be prosecuted as such?
-

no that scenario in the US would probably be classed as "mutual combat" as the other person willingly started the fight with you. in the UK police/CPS would use discretion, if you got arrested for assault you would make a counter claim of assault and the case would never go anywhere.
the case in question the shopkeeper used lethal force which is only legal to do in the face of a credible threat of death or grievous bodily harm. when the thief is running out of the door away from you it's very difficult to argue that you were facing such a threat.
common sense really.

Well, if your act of self defence is instead of immediate reaction but with delay of 5 seconds, 10 seconds or 5 minutes, where exactly it stops to be self defence by the law?
-

It depends on the state. Every state has different laws.

the jury decides, just like they decide what "reasonable force" is

In the real world it isn't. In the world of internet morons we could argue this to the end of the world, but the truth is that act of self defence has to be immediate. I bet that you cannot present any case where delayed act of self defence isn't judged to be murder/manslaughter with years of jail time.

https://en.wikipedia.org/wiki/Gary_Plauche
Leon Gary Plauche (November 10, 1945 – October 20, 2014)[1] was a native of Louisiana, known for the 1984 killing of Jeff Doucet, who had kidnapped and sexually assaulted his son, Jody Plauche. The killing occurred on Friday, March 16, 1984, and it was captured on camera by a news television crew. Although Plauche shot and killed Doucet, he was given a 7 year suspended sentence with five years probation and 300 hours of community service for the shooting and received no jail time. The case received wide publicity because many people questioned whether Plauche should be charged with murder or be let off. Plauche claimed to believe until his death that he was in the right, and that those in a similar position would have done the same thing

that guy did not argue self defence. he was found guilty of manslaughter. he obviously got such a light sentence due to "mitigating circumstances".
it's obvious from this and the harley dude thread that you don't have much understanding of how the legal system works.
the shopkeeper in this thread no doubt got a lighter sentence than usual for 2nd degree murder also due to mitigating circumstances.

and its you that seems never to realise they are having the piss taken out of them...
Top tip, never take anything I write in G&O without a liberal dose of salt.
try going back and responding to the post you made which I told you you were wrong if you want to do something constructive.

so predictable. every time you're proved wrong "oh yeh well i was only trolling"
and who exactly is taking the p1ss out of who? i come on forums to shoot the sht. for the likes of you internet forums are basically your entire life. look how many posts you've racked up between here and ukm before you got banned there. and god knows how many gimmick accounts you're running! esfitness is probably the most important person in your life currently. ;D
you wanna do something constructive. go get a job or something and stop wasting your life

Its odd that you are not such an arse on UKM as you are on here, is it that you are as afraid of the mods on there as much as you were afraid of Gee?

Why do you think he had a gun in the first place? To protect himself from the white, latte drinking, liberals in Seattle? LOL!

so are you saying... asians>>>>>>whites
Mr. Kim ftw ???
search YouTube for the cali riots back in the early 90s there's some funny clips of some asian pot bellied toads firing their rifles at the looting blacks
wonder if ESfitness was involved in any of this action ???

it's usually pretty easy proving you wrong but then you just say you were only trolling. so it's pointless.
re ukm, i'm sure you've heard the phrase "when in rome" (?)
quick question for you. you got 20k posts here , you had near 20k posts on your ukm handle in a couple years....when you factor in your gimmick accounts you got to be probably posting in the region of 100 times a day...
you're only in your early 50s and still obviously fit and able bodied...why don't you have any gainful employment?
serious question just out of curiosity. i understand scum like ND and sht mac's little minds are too fked up and warped to function normally IRL. but what's the deal with you? you actually seem like an OK guy underneath all the trolling bs...
what is the reason for you living on the internet ?

The reason garbage like him are out in the street is because the jails are already filled to capacity with garbage like him.
You regularly hear black activists going on about reparations. Hell, we already pay reparations on a daily basis having to deal with pieces of shit like this.

I was not arguing whether or not it was an understandable action. Only trying to determine if his actions are deemed legal or illegal in the eyes of the law.
I deal with difficult people all the time at Sears/Roebuck!!

I was not arguing whether it was an understandable action. Only trying to determine if his actions are deemed legal or illegal in the eyes of the law.
I'm no expert on the laws in that particular jurisdiction, but if he shot the Dindu while he was running away, it's almost certainly illegal.
That said, it's also certainly a case where the court should show leniency to this man and instead of giving him a jail sentence he and his family should be given an all expense paid trip to Disneyland.
