Motorcyclist, David Holmes, was traveling at 97mph before impact. However, the driver of the car was charged with Careless Driving. Do you agree that this is the fault of the driver of the car?

I agree. But the Judge felt driver of car should have been able to see the motorcycle approaching at high speed, and thus ruled it careless driving for him to make the turn.

Yeah that's kinda absurd because but for the bike traveling excess speed the driver of the car might have had more time to react , same with the bike.

What was the speed limit? If 60, I can see *some* validity blaming the driver. If 30, then not much.

An object approaching head on is near imposible for most to determine the closing speed of a vehicle. Posted speed limit on a road of 35 mph indicates to most experienced drivers whem they can make a turn against oncoming traffic. When a vehicle is near tripling the posted speed, the drivers opposite cannot make accurate judgment. One second the speeding vdhicle appears to be a safe distance to make a turn against traffic, the next second the speeding vehicle is on top of you. This exact same scenario happened in front of my work. The judge ruled against the speeder who died based on an accurate acclunt and study of accident scene. Too bad for the dead speeder but ........play stupid games.......win stupid prizes.

I know this sort of accident well.. As my ex had totaled 3 cars doing the same thing.

Motorcyclist's fault. Like a majority of riders, this twat was travelling too fast, thinking he was a cool mofo. Irresponsible dumbass ate a car.

Wrong wrong wrong wrong wrong wrong wrong wrong. The fault lies in the car driver. There's something cold failure to yield and right-of-way the motorcyclist had the right of way it's the car drivers duty to yield because he was turning. Failure to yield = the car a driver is at fault

Even if the biker were going the speed limit, he still has the right of way and the car failed to yield.

Speed limit are here so you can brake in time when that kind of shit happens. Obviously hes waaaay over. Not saying the other driver isnt at fault too but still.

That looks like it happened in Europe, and the guy wasn't on a sport bike. It was both, biker was speeding, but the driver should have seen the biker.

a good barrister would have tied that judge in knots.
You see a biker in the distance and you have to make an assumption that the biker is travelling at the speed limit and make movements accordingly, bearing in mind the biker was going way in excess then the time to make the movement was eliminated, as such it was the bikers fault.
If the judge is right then the car could never make the turn just in case a bike comes along at 200mph.
careless driving or driving without due care and attention is a shitty law designed to blame the innocent motorist.

Almost every country driver of the vehicle is required to have a eyes and exceeding the oncoming traffic lane requires avoidance of oncoming traffic.. You just can't drive and turn whenever you want, complete blindly. ;D

in bowling green ohi o several years ago. a car was traveling past the speed limit ran a stop sign got hit by a truck traveling at the speed limit and didnt have a stop sign and they charged the driver of the truck with manslaughter and he got like 10 years cuz he had been drinking!! wtf? he had the right of way wasnt speeding didnt have a stop sign. they were speeding and ran a stop sign. unbeleievable!!!

He's an idiot. Going 100 mph on a two lane undivided road. Going 55 mph people turn directly in front of you. Go 100 mph they will always turn directly in front of you.
