Title: A little lesson on how our legal system works using Rittenhouse as an example.

I think 99% of Americans need a lesson on how our legal system works.  It is not broken.  People crying about why KR didn't get charged for anything need to understand how the system works so here's a breakdown for everyone to understand.

1.  The District Attorney will levy charges against the defendant.  He/she will base the charges on the evidence they have.  This DA was a moron.  Instead of going for a layup and charging him with reckless endangerment etc... he went for the flashy high profile Active Shooter charge.  DAs are legal politicians looking for their next big promotion and he thought this national case can make him the next mayor or congressman.

2. The burden of proof is now on the prosecution to prove he was an active shooter with mal intent.  He didn't win the case of self defense, the prosecution couldn't prove he was there to be an active shooter.  He could have claimed he was there to sell ice cream sandwiches, it doesn't matter.  The defense doesn't have to prove him as being right, they just need to ensure the prosecution is wrong on their accusations.

3. Since they couldn't prove he was an active shooter due to lack of evidence, the jury found him innocent.  Yes he is guilty of shooting 2 people and firing at another but the charges were specific about being an active shooter which they couldn't prove.


So in the end he was found innocent of those charges.  So all of these fucking babies crying about the verdict or saying he was let go because he was white or any other bullshit needs to learn how the legal system works.  It is not broken.  The DA fucked up from the start.  KR would be in jail for 5-15 years if he chose the right charges but failed to do so.  So don't be mad at KR.  Don't be mad at the legal system.  be mad at the DA who was a moron.

They can always add or subtract charges depending on what they think is best.  They can also ask for and convict of "lesser included charges" if those are applicable.

Self Defense is a defense to all.  The prosecution could not prove beyond a reasonable doubt that he did not have the right to defend himself. 

People looking for a way to say "well hey he was wrong and should have been convicted of something" should give it up.

They always go after the highest charge they "believe" is applicable. That's the point.

That's like charging a rapist with assault instead of rape or sexual assault. Why? Because it's easier?

He may not have gotten charged with endangerment. That's just your opinion.

But it "may have been" easier to prove on paper.

The DA was not very good at his job, most of them aren't. That's why you hire good attorney's.

You are correct on a very basic level with this post, but you are definitely not a legal expert. ;D

Our legal system is broken and your post does a good job of showing why.  The system allows smart DA's to game the system.  Depending on how they charge him, he could either go free or do 15 years.  In this case the DA wasn't smart, as you said.  It was an obvious case of self defense.  Muliple attackers were trying to beat him with skateboards, punch and kick him, physically take his lawfully carried weapon, and at least one of them was proven to have pointed a gun at his face.  If he doesn't shoot he ends up like these two.............

In all honesty.  Anyone rioting and looting should be shot on site.  No excuses.  You'd see how quickly the nestle quick colored people would stop this nonsense.

I heard a few legal experts basically said the same thing .
The main idea is that a smart DA and prosecutor would have
made the SAME basic charge on each shooting.

It's a hell of a lot easier to prove some form of manslaughter/ reckless endangerment  then murder.

I think Kyle was guilty of shooting those guys, but, his lawyers did a good job bringing up doubt due to chaotic circumstances.

In the end, it's not what we THINK, it's what gets proved in court.
