Maybe you are confused because the media often treats people as being guilty until proved innocent. The media has no legal power and therefore cannot send people to prison.
The only "research" I did was to check Nevada law regarding bail and Brinton's net worth. The rest of my post is common knowledge among educated people.

Or he was never formally arraigned on the charges and the police obtained an arrest warrant.
