If you can figure out the model of opener and program it, I'd chalk it up to no harm, no foul. If really pressed, I'd just let the deposit cover it. A service charge for just a remote sounds like the money will just be pocketed.

In my rentals the garage door opener seems to disappear quite often.

I charge $50 to replace them, since i reprogram them myself.

But in this situation, i'd let them do it for the price of the remote.

Dude is just trying to rip you off.

Which is normal for most rentals.

As a landlord myself, I grow weary over people promising to make up for this or that, giving them the leeway to do it, only for them to not do it.

The high fees for things like this is to make up for the majority of people who don't end up paying, or who cause landlords grief in other ways.

I do think beakdoctor's proposition was reasonable, but if the contract stipulated a $250 fee for this, then that's a binding contract, even if it's a bad deal for beakdoctor.

I would personally let it slide, but place strict terms on everything. I would insist it happen within two days or something, and provide a specific time frame - failing that, I'd ask for the full fee.

Are there any security reasons why it can't be done beakdoctor's way? I don't own any places with garages, and never have. So I can't speak much on this specific problem.

If I had provided an OEM garage opener to a tenant and they lost it, I’d expect it to be replaced with an OEM opener, not some chinesium bullshit off Amazon that’ll probably break after a few weeks.  Why should the landlord be forced to accept an inferior product as a replacement when beakdoctor was the one who lost the opener?

Agreed. I wouldn’t buy a cheap one. I would buy a quality one, I’m not a cheap guy so I would always buy the best version available. I just don’t see the point in paying a company an extra 150 to come do it. But at the same time I’d prob just pay the 210.00 and say fuck it.

I’m torn here. But knowing me I would prob just pay the 210 instead of dealing with the time and bullshit.

This. Whenever you borrow something, bring it back in at least the condition you found it in. Dude is being a prick, but he’s not wrong. He shouldn’t be put out because a tenant lost something. He probably shouldn’t be a landlord either, as this type of shit he’s not equipped to deal with and should turn it over to a property manager.

In my opinion and experiences with tenants - with court orders, missing items etc: I'd say to that landlord, "you got off lightly, pal". Personally, I'd chalk it up to a minor inconvenience and fix it myself.

To answer everyone's questions:

Proud Virgin. The house came with one of the cheaper remotes on the market. Thats one of the reasons I didn't make much of an effort to find it. I don't even think the opener itself is from Portland Overhead. But for argument sake I offered to buy whatever remote he.wanted. He wants one from portland overhead.  OK, thats fine. They're a little more expensive: 30 bucks vs. 10 to 15 bucks for the one that was lost.

2. What he wants me to pay for is someone from Portland Overhead to come out and Program it! Which is not necessary. 
Ive done it myself. Ive dealt with Portland Overhead previously on a property I used to own. The people overthere were actually quite honest when I called. "Yeah, we can do it but we charge a fee of 175 dollars. Its very easy to just do it yourself" Verbatim quote.

SF- Ive been there sonce 2020. In may of 2020 the property management company I signed an agreement with bailed out due to covid. So I worked with the owners. They told me they weren't equipped to be landlords they never managed the property themselves,  they weren't 'handymen' couldn't fix plumbing or landscaping etc... I said ok. Ill work with you but I want my rent locked in for the next 3 years at this rate. They agreed. Never produced a new rental agreement.  Everything by email. As far as incidentals we'll do our best. They were very nice people so I was a very forging tenant.  Ex- heat went out and it took them forever to fix it, came over with a space heater! Whatever Im easy. Hose burst under sink- very easy fix- took 5 days to replace meanwhile I had to do without kitchen sink. Whatever Im easy.

We did the walk through on my last day. Everything is good. Everything is fine. I left them a large tool box and yard tools that I purchased just so I could do landscaping.  When I moved I told this asshole- Im just going to donate this stuff to Goodwill unless you want it, I only bought it for the yard work here. He says sure Ill take it. So give about 300$ worth of yard equipment and a 500 $ toolbox. We shake hands and I leave.

A few days later he calls. Where's the garage door remote? Easy, it's in the toolbox that I gave you. A few days later he calls- its not there. Hmm thats odd, im pretty sure it was. Maybe it was in my old car that I sold awhile back. Uh tell you what those are cheap and easy to replace so I can do that for you or you can get a new one and i'll pay for it.


So I can't just go over and do it myself without his consent. I haven't lived there in a month. If I still did Id just take care of it myself.


A month goes by. Calls asking for 150. Ok. Why is it 150, the remote is 12.95 on amazon.? Im getting one fro. Portland Overhead.  Ok the one from portland overhead (which you dont need) is still only 36.98 at lowes? Don't tell me how to do my job. WHOAH. that escalated. I just want to know what costs 150. Its the service to get the remote from portland overhead AND to have 2 technicians from p.o. come out and program it. Look Ill buy you the .p.o. remote but I can program it myself. Ill replace the remote- even though im not entirely sure i lost it.

Guy is a fucking putz. Even his wife has referred to him as an idiot. So im ok with being cool about it but im not going to be a punk about it. After 3 years I asked to get out 3 weeks early because I found a great deal on a new place that i didn't want to lose.  NOPE. Ok. What if I forfeit the security deposit? Security deposit was a full months rent so its actually MORE than the pro rated 3 weeks? OK.

 Now this a month after moving out.

Sounds like the owner is in the wrong then. There is no agreement about the remotes and you're getting him an equal replacement and even offered to program it. If it is a simple thing to program (like most garage remotes... I did my own after watching a youtube video) then the $175 callout fee from the company should be out of his pocket not yours.

If you wanna press the issue, seek legal counsel.  In my city (chicago) there are all sorts of rules and procedures to follow and failure to do so can result in significant monetary damages.  Example: security deposits have to be in separate account, a receipt of deposit has to be provided, and some trifling amount of interest has to be paid (something like 0.01% … seriously, we’re talking pennies).  My friend got charged $400 for some issues, retained a lawyer and took it to court.  End result?  $7,000 judgement in his favor.

No idea what the legal climate for tenants is in your area but most tenant lawyers offer free consultations and are paid on contingency.  You don’t really have anything to lose by trying

Anyway,  Stephanie had always been cool with me. Its her house and she's the landlord.  Her husband is a cuck. She's openly referred to him as an idiot.  She didn't even take his last name after marriage.  But her family and husband have all said she's too nice. She needs to strictly be a landlord not be friendly with tenants etc. . And she's always been cool. I know they were pissed at her when I got the rent locked in for 3 years. She would've let me lut of lease earlier but family said no causing me to give up the security deposit.

So after telling her husband to get fucked I texted her like 'wtf is goi g on? Am i missing something?' Its not about tgr 150 or 200 bucks... thats chump change but your husband is talking to me like an asshole. He needs to watch his mouth. Im not to be fucked with. Have I told you my personal feelings about disrespect?" And for the first time in 3 years she hasn't responded to me.

Landlord/tenant laws in Portland are notoriously biased toward the tenant. These people hate landlords as much as they hate cops. So thats in my favor. Im sure they are aware of that and that they'll get nowhere without a renewed rental agreement.  So it's over and done with.

Here's a suggestion: Offer to buy the new remote and program it, but also offer to give him the balance of the $210 or whatever it is if it doesn't work to his satisfaction (but make clear that you are not agreeing the balance is necessary and you believe the demand for the balance is very unreasonable).  He'll never let you near the house to program it because it sounds like he's scared and that's why he won't go for the "replacement that you program" suggestion.  So he won't agree and you end up having to pay nothing, his choice, even though he would have got his whole demand.

Also this gives you the high road that he'll refuse but you can always say "hey, I offered to pay you the rest despite it being ridiculously unreasonable"

Based on beakdoctor's long description it doesn't sound like there's any reasonable security issues if they did a walk thru and everything, but I still think the guy doesn't want him anywhere near the house.  With no rental agreement i think the landlord is screwed no matter what and frankly deserves it.

Thats whats really bizarre.  We left on great terms last month after the walkthrough. Hell I gave the prick over 500 bucks worth off yard tools and a husky tool box. I went over there a few times to check the mail for late deliveries.  Which I asked permission to do and he was like 'sure, anytime. '

Now he doesn't even want me going over to check the mail.

Weird, something changed. I don't know what. I guess my only concern is future rentals may require a reference and there's a 3 year gap where I lived there and can't depend on this limp dick. Despite having been a good renter.

I used to own my own house in PDX but sold it just before the pandemic and have been renting ever since. Ill never buy property in Portland again. Place is turning into a shithole haven for homeless drug addicts, femnazi's, self loathing whites and whacky tree hugging, liberal hippie fucks. Can't wait to move out of this fucking state.

Based on what you've detailed you are predominately right on this matter in terms of your proposed course of action, but by way of a possible explanation on landlord's behaviour...

I don't think the landlord sounds overly confrontational, and clearly doesn't want to engage and is aiming to remain reasonably civil, while at the same time attempting to stay firm ,and there could be a couple of explanations for this

1) You mentioned they have no experience as landlords, don't know the ins and outs, and also no handyman knowledge at all. So given this, from their perspective they are likely going to trust a professional company that has given them a quote of sorts - exhorbitant as it is once the callout service fee is included - rather than a now ex-tenant, despite your reasoned rebuttals

2)The second possible factor is more speculative , but there may be some conscious minor level of resentment that has recently set in based on you being able to lock in your rent for 3 years during which time presumably rents increased,thus representing lost income for them in their eyes. This realisation may have only recently crystallized as they are no doubt in the process of working out what they may be able to charge the next renters based on the current market

These everday injustice matters, relatively minor as they are, eat at you I get it 100% ,but it may be worth taking the hit on this given your thoughts on future rental referrals

Guess it's about picking your battles and perhaps contemplating say in a couple of years time what path do you think will best serve your long term interests. But at the same time wouldn't blame you for digging in your own heels

Beak if having this landlord as a reference was a real concern you would have have paid him the asking price for the remote after the second request. At this point you’re not going to use him as a reference, when asked just say you slept in a tent during the pandemic, because you lost your job, until you got back on your feet. That is a much more believable story than I was a good tenant but a month after I moved out I got into a fight with the landlord over a lost garage door opener.

Thanks for the insight. I already know what the price increase is. 800 bucks. From 22 a month to 3 grand. At the end of 3 yrs I was planning on renewing and expecting a reasonable rate increase. I wasn't expecting 800 dollar rate increase. Given that's what they believe they should've been getting for the last year or two I'd guess there is some resentment there.

They have resentment towards you because you paid the agreed rent? Imagine how upset they’ll be when they get a “regular” tenant that won’t care about the property and beat the crap out of it. The extra $800 a month will seem like a curse.

Guy is a fucking putz. Even his wife has referred to him as an idiot. So im ok with being cool about it but im not going to be a punk about it. After 3 years I asked to get out 3 weeks early because I found a great deal on a new place that i didn't want to lose.  NOPE. Ok. What if I forfeit the security deposit? Security deposit was a full months rent so its actually MORE than the pro rated 3 weeks? OK.

 Now this a month after moving out.

The landlord is in the right.

The tennant’s answer of ‘had I known I would have made a greater effort to find it’ is interesting. The easiest solution was to buy replacement remotes beforehand and program them but instead the person implies they couldn’t be bothered because it’s $20 and the landlord can do that.

On the flip side the land lord should be prepared and have a bunch of keys and garage openers as backup for the place because that stuff always gets lost. I paid US$18 for my extra garage remotes and that’s for my castle so US250 to replace (with service fee) is pretty mental. A handyman could do it cheap.

But that's just it, the guy wasn't an asshole even BD seemed to confirm this, something changed.  Were you dealing with the property mostly through the guy's wife?  Is there something there?  Seems strange the wife would be telling you her husband is an idiot.

Other than send in rent payment every month I had very little interaction with either one. Maybe spoke to them 3 times in 3 years. She and my wife spoke more often, got along pretty good so they had a bit of a rapport.

Iron Grip- I hear you. I was thinking about that very notion earlier today. It seems as though people in general are becoming less intelligent.  More self centered. More full of shit. Less trustworthy. I don't know when it happened or how it happened but it seems people,  generally speaking,  used to be more good natured....people are just so self absorbe today. I think it has to do with their online lives, their obsession with social media. They're all the star of their very own live t.v. show. Just no compromise,  no self reflection,  no humility, only out for themselves. I mean look at Bhanks,  perfect example but in the 20 to 40 year old age brackets those types are the rule and not exception.
