Title: Important Question
Post by: Prookiesbanana on August 28, 2024, 03:28:34 PM
Brians a cop caller, we have all been witness to that.
I admittedly have made online threats to him and his family. When he calls the police, can i be charged for these threats? I dont care if i am, i just need to prepare myself if the prospect of getting locked up exists.

And yes, everyone has told me he threatened to murder me too. Doesnt matter, i never call cops and would never say he did. Im not that guy. Any lawyers here?

Maybe a lawyer can chime in.

Intent seems pretty important so if you clarified that it was just a joke gone too far just before you enter the state it may harm their case against you.

No, at least in regards to Brian. As long as you don't go to his home or "bump into him", you should be ok. You can say "I'm at xyz come spar if you want, etc...". You can't have an on-going hostile back and forth like you and Brian have, and then claim stalking, self defense, etc....

Similar thing happen with Patrick Tomlinson and Andrew Nadolski -

.

Tomlinson has been trolled for years because he's an asshole. One day Nadolski was in town, and stopped at a bar a few blocks away, and invited him to throw the hands or have a drink. Tomlinson tried the legal route, and the cops and the judge told him to pound sand. The mutual nature of the messages negated any claim of harm.

My BIL is a lawyer and deals with stuff like this.

There isn't a case against you so it's a complete non-issue.

He would have to file a restraining/protective order against you to prevent you from coming near him. At worst you would not be allowed within 500-feet of him or his property. But you could travel freely. Hanky was not allowed to leave the state due to probationary measures tied to his domestic violence cases against his ex.

You haven't done anything material, like physically shown up on his property, etc.

So, it is at best a general harassment charge that would get thrown out.

Hell, Brian is the best resource, as he's been arrested and charged multiple times for aggravated stalking, harassment and violating a protective order.

Online stuff like this never amount to anything, especially with the years of back and forth bullying he's done as well and threats to end your life a hundred times.

I think maybe mentioning the wife and his kid(s) isn't a good thing. Somewhere along this mess there's abuse mentioning the family. I haven't kept up to date but don't think Emily has given anyone crap on here and his boy definitely hasn't.

Generally speaking - when 2 people are committing offenses against each other - the police just shake their heads and walk away - that's what my lawyer told me

He should entirely and clearly disavow any such previously made comments and make clear it was bluster and he had and has zero intention to do anything like that ever.

Do it in each of the threads Briarrhea jumps to.  This is just about bullshit Briarrhea.
