By declaring a state of emergency (as he did with C-19) he can ignore the State and US constitutions and use executive orders to create new "laws" and ignore existing ones.

Only time will tell how far he takes it this time.  He destroyed tens of thousands of small business during the C-19 lockdowns, deciding which businesses were essential or non-essential.
