That stinks. Usually things like that can be serious in older folks. My grandmother died of an infection sustained when she fell and broke her hip. I wish her a speedy recovery.

Supreme Court Justice Ruth Bader Ginsburg is in the news again. Not for a controversial judicial opinion, but for her ongoing health issues. Last week, Ginsburg had surgery to remove a lobe of her lung as two suspicious lung nodules were found following her recent fall.

Last month, she fell, fracturing three ribs. Presumably, the lung nodules were found by x-ray after her fall. Further imaging likely caused her doctors to recommend removing the nodules.

Interestingly, a week ago, she told a group of admirers, “My health is fine.” Perhaps the Clinton appointed justice is borrowing a page from Bill Clinton, parsing the meaning of “health” and “fine”.

Her surgeon last week removed two malignant nodules. Were they primary lung cancer or metastases from one of her previous cancers?


She had colon cancer in 1999 and pancreatic cancer in 2009, both of which are known to spread to the lungs. The lungs are a common site for metastatic cancer as the entire blood supply flows through the lungs, carrying cancer cells from distant parts of the body.

If these nodules were not metastatic, then she would have primary lung cancer. While possible, having three different types of cancer is unusual. Ginsburg was not a smoker, which makes lung cancer less likely. Occam’s Razor suggests metastatic cancer.

Her lung nodules will be examined microscopically to determine the type of and origin of the malignancy. Until that news is announced, we can only speculate.

If her cancer is indeed metastatic, it is considered to be stage IV, with the worst prognosis. For stage IV colon cancer, the five-year survival is 15 percent. For pancreatic cancer, the five-year survival for stage IV disease is much worse at only 3 percent.


Justice Ginsburg’s fall was fortuitous in that her lung nodules were diagnosed early. While they would eventually be found, they may have grown to the point where surgery was no longer possible.

Why did she fall? Falls are common in the elderly and are a leading cause of injury and death in that age group. Cancer occasionally spreads to the brain, affecting balance, but presumably, her doctors checked for this after her fall. Cardiac issues also cause lightheadedness and falls. Ginsburg had a cardiac stent placed in 2014.

As an 85-year-old, she has had her share of health issues and I wish her and her family well in her recovery. She exercises regularly and her dedication to fitness is commendable and contributory to her ability to bounce back after a succession of major medical issues.

The RBG Workout has been published as a book, another fitness fad. A young Politico writer tried the workout and said, “It nearly broke me.” That’s the unfortunate state of fitness in America when a millennial male can’t keep up with a frail 85-year-old woman in the gym.

What’s next for Justice Ginsburg? She first has to recover from her thoracic surgery and partial lung removal. That alone is no small feat in someone her age. She is at risk for bleeding, infection, respiratory issues, all on top of three broken ribs.

Based on the cancer found in her lungs, further chemotherapy and/or radiation may be needed. As her medical challenges mount, her ability to serve on the nation’s highest court comes into question. Reportedly, she is already back up and working from her hospital bed.

As Justice Ginsburg’s retirement may be sooner rather than later based on her health, President Trump may soon have another court nominee. This time it won’t be a replacement for moderate swing-vote Justice Anthony Kennedy but instead for one of the court’s quintessential liberals.

Expect fireworks far beyond what we saw in the Kavanaugh confirmation hearings. People are already stepping up to donate their lungs to Ginsburg, sacrificing their lives in the pursuit of liberal judicial activism.

WASHINGTON (AP) — Justice Ruth Bader Ginsburg is missing arguments for the first time in more than 25 years as she recuperates from cancer surgery last month, the Supreme Court said.

Ginsburg was not on the bench as the court met Monday to hear arguments. It was not clear when she would return to the court, which will hear more cases on Tuesday and Wednesday, and again next week.

Court spokeswoman Kathy Arberg said the 85-year-old justice is continuing to recuperate and work from home after doctors removed two cancerous growths from her left lung on Dec. 21.


Ginsburg was discharged from a New York hospital on Dec. 25.

Chief Justice John Roberts said in the courtroom Monday that Ginsburg would participate in deciding the argued cases “on the basis of the briefs and transcripts of oral arguments.”

Ginsburg had two earlier cancer surgeries in 1999 and 2009 that did not cause her to miss court sessions. She also has broken ribs on at least two occasions.

The court said doctors found the growths on Ginsburg’s lung when she was being treated for fractured ribs she suffered in a fall at her office on Nov. 7.

After past health scares, Ginsburg has come back to work relatively quickly. In 2009, she was at the court for arguments on Feb. 23, 18 days after surgery for pancreatic cancer.

Weeks after her fall in November, Ginsburg was asking questions at high court arguments, speaking at a naturalization ceremony for new citizens and being interviewed at screenings of the new movie about her, “On the Basis of Sex.”

Her latest surgery was a procedure called a pulmonary lobectomy at Memorial Sloan Kettering Cancer Center in New York. The court said in a release issued the day of the surgery that doctors found “no evidence of any remaining disease” and scans taken before the surgery showed no cancerous growths elsewhere in her body. No additional treatment is currently planned, the court said.

If her cancer is indeed metastatic, it is considered to be stage IV, with the worst prognosis. For stage IV colon cancer, the five-year survival is 15 percent. For pancreatic cancer, the five-year survival for stage IV disease is much worse at only 3 percent.


Justice Ginsburg’s fall was fortuitous in that her lung nodules were diagnosed early. While they would eventually be found, they may have grown to the point where surgery was no longer possible.

Why did she fall? Falls are common in the elderly and are a leading cause of injury and death in that age group. Cancer occasionally spreads to the brain, affecting balance, but presumably, her doctors checked for this after her fall. Cardiac issues also cause lightheadedness and falls. Ginsburg had a cardiac stent placed in 2014.

As an 85-year-old, she has had her share of health issues and I wish her and her family well in her recovery. She exercises regularly and her dedication to fitness is commendable and contributory to her ability to bounce back after a succession of major medical issues.

The RBG Workout has been published as a book, another fitness fad. A young Politico writer tried the workout and said, “It nearly broke me.” That’s the unfortunate state of fitness in America when a millennial male can’t keep up with a frail 85-year-old woman in the gym.

What’s next for Justice Ginsburg? She first has to recover from her thoracic surgery and partial lung removal. That alone is no small feat in someone her age. She is at risk for bleeding, infection, respiratory issues, all on top of three broken ribs.

Based on the cancer found in her lungs, further chemotherapy and/or radiation may be needed. As her medical challenges mount, her ability to serve on the nation’s highest court comes into question. Reportedly, she is already back up and working from her hospital bed.

As Justice Ginsburg’s retirement may be sooner rather than later based on her health, President Trump may soon have another court nominee. This time it won’t be a replacement for moderate swing-vote Justice Anthony Kennedy but instead for one of the court’s quintessential liberals.

Expect fireworks far beyond what we saw in the Kavanaugh confirmation hearings. People are already stepping up to donate their lungs to Ginsburg, sacrificing their lives in the pursuit of liberal judicial activism.

In the meantime, let’s wish Justice Ginsburg a speedy recovery but be sure to get a good seat for the circus when she eventually retires.

Quiet preparations are underway within conservative legal circles and the White House counsel’s office in the event that Supreme Court Justice Ruth Bader Ginsburg retires, two sources familiar with the process tell The Daily Caller.

The 85-year-old Ginsburg did not appear for oral arguments at the Supreme Court on Monday, missing the first session in her 25 years on the court for reasons of ill health. Ginsburg is currently recuperating from recent surgery to remove cancerous nodules from her lungs, marking her third bout with the disease.

“Ginger preparations are underway, not just for Ginsburg but for any SCOTUS retirement,” a source directly involved in the Supreme Court nominations of Justices Neil Gorsuch and Brett Kavanaugh told TheDC.

Another source emphasized to TheDC that the quiet preparations are all that is realistically needed in case of a vacancy on the court because much of the required infrastructure already exists within the White House. Both sources said that the White House counsel’s office and its conservative legal allies have now been through two successful confirmation processes, and that they have developed an intimate and professional feel for how to run the process again, if necessary.

Trump is particularly proud of his handling of the Gorsuch and Kavanaugh nominations, a source close to the White House said, noting that the president views proper handling of the Supreme Court as a necessary part of maintaining the support of his voters.

The opening would be the first under White House counsel Pat Cipollone, who assumed the position after Don McGahn. Cipollone is a longtime Washington lawyer intimately familiar with the conservative legal eco-system.

“By appointing Pat, Trump made sure he has a White House counsel who is both able to handle the investigation and a movement conservative philosophically aligned with the base of the party,” American Conservative Union Chairman Matt Schlapp told TheDC.

Chief Justice John Roberts noted Ginsburg’s absence when the justices took their seats for the second time in the new year.

Repeating what he said Monday, Roberts said Ginsburg is “unable to be present” for the court’s sitting, but will participate in the decisions using transcripts of the arguments and court briefs.

It would not surprise me if the powers that be did something akin to Weekend at Bernies.  I think they did it with the late Rep. Patsy Mink.  She probably "died" days or weeks before she was declared dead (i.e., could have been on a respirator with future medical being deemed futile), but she wasn't declared dead till it was too late to take her name off the ballot.  So we elected a dead woman to Congress.  Governor then appointed her replacement.

The White House is reaching out to political allies and conservative activist groups to prepare for an ailing Justice Ruth Bader Ginsburg’s possible death or departure from the Supreme Court — an event that would trigger the second bitter confirmation battle of President Donald Trump’s tenure.

The outreach began after Ginsburg, 85, on Monday missed oral arguments at the court for the first time in her 25 years on the bench. The justice, who was nominated to the court by President Bill Clinton in 1993, announced in late December that she underwent a surgical procedure to remove two cancerous growths from her lungs.


The White House "is taking the temperature on possible short-list candidates, reaching out to key stakeholders, and just making sure that people are informed on the process," said a source familiar with those conversations, who spoke on background given the delicate nature of the subject. "They're doing it very quietly, of course, because the idea is not to be opportunistic, but just to be prepared so we aren't caught flat-footed."

Ginsburg had a pulmonary lobectomy, the Supreme Court said in a statement, and her doctors said that post-surgery there was “no evidence of any remaining disease.” She has also recovered from several past health scares. But her departure from the Court would allow Trump to nominate a third Supreme Court justice — the most in one presidential term since President Ronald Reagan placed three judges on the highest court during his second term.

The nine-member court is currently divided 5-4 between its conservative and liberal wings. Ginsburg’s departure would allow Trump to create the Court’s strongest conservative majority in decades, a scenario sure to bring intense opposition from Democrats and liberal activists still furious over the October confirmation of Justice Brett Kavanaugh.

"It would be a brutal confirmation,” said John Malcolm, director of the Heritage Foundation's Meese Center for Legal and Judicial Studies. “The first two were not easy at all, but this would be much harder in this respect: When Neil Gorsuch was the nominee, you were replacing a conservative with a conservative. With Kavanaugh, you were replacing the perennial swing voter, who more times than not sided with the so-called conservative wing, so that slightly solidified the conservative wing.”

“But if you are replacing Justice Ginsburg with a Trump appointee, that would be akin to replacing Thurgood Marshall with Clarence Thomas,” Malcolm added. “It would mark a large shift in the direction of the court."

The White House is urging outside allies to be prepared for another bruising confirmation battle should Ginsberg’s health take a sudden turn for the worse, according to four sources with knowledge of the overtures. Outside groups, led by the Federalist Society and the Judicial Crisis Network, played a leading role in helping to confirm Kavanaugh and, before that, Justice Neil Gorsuch.

The groups have advised the Trump team on everything from potential nominees to political and media strategy, producing television advertisements and blitzing reporters with supportive messaging. Together, the conservative groups spent over $7 million on ads supporting Kavanaugh’s nomination.

The White House has quietly pressed them not to rest on their laurels after Kavanaugh’s nationally-divisive confirmation battle amid charges of sexual misconduct.

The White House did not immediately respond to a request for comment.

Though Ginsburg and the Court itself have been tight-lipped about her health, her absence from the bench this week has become a cause of concern because of her remarkable past attendance streak, which persisted through two previous cancer treatments and a number of other health scares. At the outset of oral arguments on Monday, Chief Justice John Roberts said she was “unable to be present” but would participate in the cases nonetheless, reading briefs, filings, and a transcript of the sessions.

Supreme Court appointments are indefinite, and a seat is considered empty only if a justice dies or retires from the court. In the event a judge is unable to perform his or her duties, the only clear recourse is Congressional impeachment.

Ginsburg told an audience in mid-December that she “will do this job as long as I can do it full steam.” As a candidate in July 2016,
Trump tweeted that her “mind is shot — resign!” But after her surgery last month he wished her a “full and speedy recovery."

The White House counsel’s office and senior aides on the Senate Judiciary Committee, now chaired by Sen. Lindsey Graham (R., S.C.), have begun drafting a shortlist of potential court nominees. It features judges the president has considered for previous vacancies along with some new names. Many of them are women, sources say.

They include Seventh Circuit judge Amy Coney Barrett, who was a leading contender for the last Supreme Court vacancy, created by Justice Anthony Kennedy; Sixth Circuit judges Joan Larsen, Amul Thapar, and Raymond Kethledge; Eleventh Circuit judge Britt Grant; and Third Circuit judge Thomas Hardiman; and Neomi Rao, Trump’s current nominee for Kavanaugh’s old seat on the D.C. Circuit Court.

Should Ginsburg’s seat open, it would be the first confirmation battle of White House counsel Pat Cipollone’s tenure. The president’s first White House counsel Don McGahn — who focused heavily on confirming conservative judges to the federal bench — left the White House shortly after he played a central role in Kavanaugh’s October confirmation.

“Outside of war and peace, of course, the most important decision you make is the selection of a Supreme Court judge, if you get it,” Trump said last summer.

As the show came back from commercials, they briefly showed a graphic of Ginsburg with the caption 1933-2019. The image was on screen for only a brief period of time before it was dismissed for Ainsley Earhardt‘s upcoming interview on campus culture.

“We apologize, big mistake,” Earhardt followed.

Mediaite reached out to the network for comment, and a Fox News spokesperson responded: “This was a technical error that emanated from the graphics team.”

Justice Ruth Bader Ginsburg seems by all counts a nice human being: a good wife and mother, a good friend to her opposite, late Justice Antonin Scalia, a very hard worker, in all ways a mensch.

But this isn’t the reason that millions of liberals follow her health with concern, pray every day for her continued survival, and even write in with the offer of one of their kidneys, should the need arise. The concern for her health above that of all others rises, of course, from one special reason: If she dies or retires while Republicans hold the White House and Senate, it would leave the liberals on the Supreme Court on the short end of a six-to-three minority. This would be a huge blow to the pro-abortion agenda that has reigned in the U.S. for the last 40 years.

The blame for their panic is wholly their own. In 1972, when Roe v. Wade was decided in a 7-2 decision, the Court thought it spoke for an emerging consensus, part of a rights-centered wave that swept all before it, against morals and mores. The wave, they believed, traveled only one way.

But in this instance, it failed to occur. A pro-life movement arose to contest it, and 60 percent of the country refused to choose either side, settling on a reluctant "OK" in the first stage of pregnancy, followed thereafter by heavy restrictions and an absolute ban near the end.

As their drive slowed, the Left turned to the courts to deliver their triumphs, and the conservatives followed their lead. By the late 1980s, with Ronald Reagan ensconced as the first pro-life president and the abortion-rights movement an arm of the Democrats, the moment occurred that changed the Senate forever. Reagan named conservative Judge Robert Bork to fill the seat of retiring Justice Lewis Powell, a pro-choice adherent.

Sen. Ted Kennedy dashed to the floor of the Senate and delivered a fierce and alarmist anti-Bork diatribe that stripped the paint from the walls. As Steven F. Hayward assures us, "Bork’s was not the first nomination to fail for political reasons, but the demagogic nature of the campaign against him made it a watershed moment in American politics, permanently deforming the nomination process for the judiciary, with ideological battles extending to the lower courts as well."

We were all better off when abortion was a matter of conscience, not politics, and both parties had healthy pro-life and pro-choice factions. But those days were over, and the new ways have risks. One is that presidential elections are won on war-and-peace and/or pocketbook issues. Either side could lose everything for reasons not of its own doing. There is also no guarantee as to how many justices a president can appoint.

In 2016, both of these traps snapped shut on the Democrats' legs. First, Trump, who lost the popular vote to Hillary Clinton, won the electoral vote by a sizable margin. Second, he got to name two new justices in his first two years in office, with two of the Democrats’ remaining four justices, Ginsburg included, aged 85 or older. Seldom has expedience backfired so neatly on those who contrived it.

I wish Ginsburg well, but the Left gets no mercy, having chosen its own poison so well.

I doubt an 86 year old woman with bouts of colon, lung, and pancreatic cancer has a good chance of a long life.  I hope she fully recovers but she's clearly on borrowed time at this point.

Well there are always outliers, but I doubt you will find statistically significant numbers showing an 86 year old with three different bouts of cancer will live a much longer life.

Filmmaker Michael Moore sounded the alarm for his fellow liberals Friday after news broke that Supreme Court Justice Ruth Bader Ginsburg had completed three weeks of treatment for a malignant tumor this summer.

“First thought:” Moore tweeted. “She was seen at the Yiddish version of 'Fiddler on the Roof' in NYC last week. She’s gonna be fine.”

Moore was apparently fearing that further health problems for Ginsburg could force the 86-year-old associate justice to step down from her lifetime appointment to the nation's highest court -- thereby presenting President Trump with a third opportunity to make a Supreme Court pick.

Trump has already placed conservative justices Neil Gorsuch and Brett Kavanaugh on the Supreme Court, following Senate confirmation for each. A third successful Trump appointee would likely bolster the court's conservative majority for decades to come.

Moore appeared to be reminding liberals that electing a Democrat to the White House in 2020 would be the best defense against Trump making a third pick -- unless Ginsburg happens to step down before the 2020 election.

That appeared unlikely Friday. A court spokesperson said the tumor on Ginsburg’s pancreas was treated “definitively” and there were no other signs of cancer in her body.


Ginsburg has become a bit of a celebrity in the liberal community and Democrats watch the health of "Notorious RBG" very closely.

During a recent performance of “Fiddler on the Roof” in New York City, Ginsburg received a standing ovation.


Ginsburg underwent lung cancer surgery in December and has had two previous bouts with the disease. She had colorectal cancer in 1999 and pancreatic cancer in 2009. While recovering from surgery she missed arguments at the court in January, her first illness-related absence in more than 25 years as a justice.

Feinstien already has questioned Amy Coney Booker regarding her Catholic faith and being a judge.

Ruth Bader Ginsburg misses Supreme Court arguments due to illness

Supreme Court Justice Ruth Bader Ginsburg was absent from oral arguments before the high court Wednesday morning due to an illness.

The court said Ginsburg, 86, remained home because of a stomach bug. While not having the opportunity to question attorneys during the arguments, she will be involved in deciding the cases.

"Justice Ginsburg is unable to be present today. She is indisposed due to illness, but she will participate in the consideration and decision of the cases on the basis of the briefs and the transcripts or recordings of the oral arguments," Chief Justice John Roberts said from the bench.

Those cases are Comcast Corporation v. National Association of African American-Owned Media, et al., and Ritzen Group, Inc. v. Jackson Masonry, LLC.

Ginsburg has had two separate bouts with cancer in the past year. Her recovery from lung cancer surgery caused her to miss court sessions in January. They were her first absences from arguments in a quarter-century as a justice.

She had radiation treatment for a tumor on her pancreas in August.

Supreme Court Justice Ruth Bader Ginsburg underwent non-surgical treatment Tuesday for a benign gallbladder condition, according to a press release from the Supreme Court. She plans to participate in oral arguments from the hospital on Wednesday, according to the release.

In pain on Monday, Ginsburg went to Sibley Memorial Hospital in Washington after hearing the first-ever Supreme Court teleconference of oral arguments. At Sibley, she was diagnosed with acute cholecystitis, a condition in which a gallstone migrates to the cystic duct. She nonetheless participated in arguments from home on Tuesday, but was in enough pain that she went to Johns Hopkins Hospital in Baltimore for treatment of the infected duct later Tuesday.

Doctors not involved in Ginsburg's care said non-surgical treatment typically involves antibiotics and insertion of a tube to drain the infected duct.

Friends said the justice was in good spirits on Tuesday night, and watching the Metropolitan Opera on her iPad.

Ruth Bader Ginsburg has been undergoing chemotherapy to treat recurrence of cancer

Supreme Court Justice Ruth Bader Ginsburg has been undergoing chemotherapy treatment since May because of a recurrence of cancer, the justice said in a statement Friday.

“I have often said I would remain a member of the Court as long as I can do the job full steam,” Ginsburg said. “I remain fully able to do that.”

The announcement comes after being discharged from the hospital earlier this week for another health issue. Her hospitalization this week was unrelated to the cancer treatment, the justice said in the statement. Tuesday's hospital stint was to remove gall stones and treat an infection, the court said. She was discharged one day later.

The liberal justice, 87, has faced a slew of health concerns in recent years. She has previously revealed several bouts with cancer including colorectal, pancreatic and lung cancers.

In Friday's statement, Ginsberg said she began chemotherapy this spring after a periodic scan followed by a biopsy revealed lesions on her liver. The chemotherapy is "yielding positive results," she said, after a July 7 scan indicated a significant reduction of the liver lesions and no new disease.

Ginsberg said she will continue to receive bi-weekly cancer treatment but is able to maintain an "active daily routine."

In May, Ginsburg was hospitalized with an infection caused by a gallstone.

In November, she was admitted to Johns Hopkins Hospital after experiencing chills and a fever.

In 2018, she was hospitalized with three fractured ribs after a fall at her office.

During a White House press conference on Tuesday, a reporter told the president about the most recent hospitalization. “I wish her the best,” President Trump said.

If this is one year ago I think Amy Coney Barrett is without question the pick but this close to the election?

Lagoa is Hispanic and from Florida so in terms of November that would potentially help him out in those 2 categories.

However the conservative base seems to really like Barrett.

My gut tells me he goes with Barrett because they have some history between the two but I would not be shocked in the least if he goes with Lagoa given the circumstances.

“And so I would not vote to confirm a Supreme Court nominee,” she said Friday.

Murkowski said Tuesday she still opposes a Senate confirmation vote this close to an election.

“I do not support this process moving forward,” she said. “Now, having said that, this process is moving forward with or without me.”

Murkowski said she did not know whether she would withhold her vote to protest the timing of the appointment, but she said the quality of the confirmation process would be a factor.

“If I had felt that there was a rush to move this through because you’re up against a deadline that is hard and fast, like an election, and that a nominee had not been thoroughly and fairly evaluated through our process, then I’m going to have to look at that,” she said.

I am a 40-something attorney and mother who lives in a quiet neighborhood with a yard and a garage full of scooters and soccer balls. Like so many other women in the United States, when I learned of Justice Ruth Bader Ginsburg’s passing, my first reaction was not grief but fear. I fear that American citizens are inching closer to living in a theocracy or dictatorship and that the checks meant to prevent this from happening are close to eroding beyond repair.

When Justice Ginsburg died, I knew immediately that action was needed on a scale we have not seen before. Our democracy has become so fragile that the loss of one of the last guardians of common sense and decency in government less than two months before a pivotal election has put our civil and reproductive rights in danger like never before. And, so, I have turned to Satanism.

Members of the Satanic Temple do not believe in the supernatural or superstition. In the same way that some Unitarians and some Jews do not believe in God, Satanic Temple members do not worship Satan and most are atheists.  (CNN)President Donald Trump intends to choose Amy Coney Barrett to be the new Supreme Court justice, according to multiple senior Republican sources with knowledge of the process.

In conversations with some senior Republican allies on the Hill, the White House is indicating that Barrett, a federal appellate judge and Notre Dame law professor, is the intended nominee, multiple sources said.

All sources cautioned that until it is announced by the President, there is always the possibility that Trump makes a last-minute change but the expectation is Barrett is the choice. He is scheduled to make the announcement on Saturday afternoon.

A former law clerk to the late right-wing beacon Justice Antonin Scalia, Barrett would tilt the balance of power on the court further to the right, possibly ahead of a consequential case on health care to be argued the week after Election Day. I fear that American citizens are inching closer to living in a theocracy or dictatorship and that the checks meant to prevent this from happening are close to eroding beyond repair.

When Justice Ginsburg died, I knew immediately that action was needed on a scale we have not seen before. Our democracy has become so fragile that the loss of one of the last guardians of common sense and decency in government less than two months before a pivotal election has put our civil and reproductive rights in danger like never before. And, so, I have turned to Satanism.

Members of the Satanic Temple do not believe in the supernatural or superstition. In the same way that some Unitarians and some Jews do not believe in God, Satanic Temple members do not worship Satan and most are atheists. They are not affiliated in any way with the Church of Satan. Instead, the Satanic Temple uses the devil as a symbol of rebellion.

Just like other faiths, the Satanic Temple has a code that their members believe in deeply and use to guide their lives. Sen. Ted Cruz (R-Texas) predicted on Tuesday that Republicans will have the votes to confirm President Trump's Supreme Court pick, even as a coronavirus outbreak in GOP circles has cast new doubt on the party's ambitious timeline.

"I'm very confident. I believe we have the votes. I believe we'll get it done," Cruz said during a Washington Post Live interview. "As I see it, we have a solid 51 votes right now. And from the conversations in the conference, I don't see that changing."

Cruz's remarks are the latest sign that Republicans are preparing to plow forward, even as three GOP senators have tested positive for the coronavirus and another three GOP senators, including Cruz, have tested negative but are self-isolating. One of the senators who tested positive said he was willing to come to the Senate in a "moon suit" to help confirm Judge Amy Coney Barrett.

Underscoring the risk the coronavirus poses to the GOP's timeline, four of those six senators are on the Judiciary Committee, which is responsible for holding a hearing on Barrett and sending her nomination to the full Senate.

The Senate Judiciary Committee is scheduled to start its hearing on Monday and run through Oct. 15. That will include a day of opening statements, two days of questions and a final day for outside experts.

"I want you to understand we're going to start hearings Oct. 12, safely," Senate Judiciary Committee Chairman Lindsey Graham (R-S.C.) told Fox News on Monday night.

Though Graham and Barrett are expected to attend the hearings in person, senators are being given the option to question Barrett remotely.

Graham has said the panel will vote on Barrett's nomination on Oct. 22. Democrats, according to an aide, will force Republicans to show they have the majority needed for a quorum, setting up a hard date for when Republicans will need all of their members on the panel back.

Republicans are aiming to confirm Barrett before Election Day on Nov. 3.

Cruz, during his Washington Post interview, noted that he asked Graham during a closed-door meeting of Judiciary Committee Republicans about why he wasn't starting the hearing sooner.

"Procedurally, what I think is critical is that the Senate confirm Judge Barrett before Election Day. ... So I wanted to make sure that we would have sufficient timing to get the confirmation completed before Election Day. All of the parliamentary experts we talked to felt confident that no matter what shenanigans [Democrats] pulled that we would have sufficient time to get the job done by Election Day," Cruz said.

Sens. Thom Tillis (R-N.C.) and Mike Lee (R-Utah), based on timelines from their offices, both anticipate being back in the Senate in time for a committee vote on Barrett's nomination. Sen. Ben Sasse (R-Neb.), who is self-isolating but has tested negative, has said he will return on Monday.

Cruz said he would be attending virtually during the first two days of the hearing next week, before switching to attending in person. The Texas Republican was not at the White House event late last month where Trump announced Barrett as his Supreme Court pick. Tillis, Lee and Sasse were all in attendance.

Cruz said he hadn't asked Lee where he believes he contracted the virus. Cruz, however, called the number of cases stemming from individuals at the White House event "disturbing," adding that it "'certainly suggests people caught it there."

Almost certainly. I see 3 most likely scenarios.

A. Collins(Maine) votes "No" and ACB receives 52 votes.
B. Collins votes "Yes" and ACB receives 53 votes.
C. One or two Democrat senators like Doug Jones(Alabama) and/or Manchin(West Virginia) flip and vote "Yes" which puts ACB in the 53 to 55 vote range.
