Chased home: Mob attacks man in his house

ABOUT 11 P.M. on Sept. 9, dozens of youths with bats and pipes descended on a tidy residential area of Port Richmond looking for white teens who allegedly had attacked an African-American kid at Stokely Playground a couple of hours earlier.
Two fearful white teens spotted Mark LaVelle on Indiana Avenue near Belgrade Street and asked for help. Suddenly, the mob appeared. LaVelle, who said that he didn't know the two kids, who looked to be 13 or 14, ran with them into his nearby house.
" 'We got you, you white mother-------!' " LaVelle said he heard someone yell in the "mob" of black and Hispanic youths.
Inside his house, LaVelle, 37, called to his wife, Kim, 30, to go to their bedroom with their twin 13-month-old boys, Mark and Mason, and to call police. He also ordered his two other sons, 11 and 17, and his nephew, 7, to stay upstairs.
With the two teens hiding in the house, LaVelle, 5 feet 10, 220 pounds, a well-known sports-league organizer and coach in the community, went outside to try to calm the angry mob.
They were standing on his steps. One shouted, " 'Something's going to happen now!' " LaVelle recalled in an interview Friday at his house. LaVelle got nervous and went back inside, locking his door with a deadbolt.
But the attackers pounded on his front windows and kicked his wooden door so hard, it flew open and some of them entered his house.
"The first guy hits me with a pipe. The second guy knocks me in the face. All I'm hearing is my wife and kids screaming," said LaVelle, who feared that the next time they saw him, he would be in a casket.
He said that he was able to push the attackers out the door, but then a third man - who had a gun - tried to extend his arm. LaVelle grabbed onto the gunman's lower arm and shoulder so he couldn't raise the weapon. Then, police sirens screamed in the neighborhood, and the mob turned and ran.
LaVelle was able to identify three of the people from the melee. He said he did not know if they had been chasing the white teenagers, or if they were just trying to find someone to attack.
Police arrested Bergson Morin, 21, of Rosehill Street near Wyoming Avenue, Feltonville, as the man with the gun. They arrested Enrique Delgado, 32, of Rockland and C streets, Feltonville, as the man who hit LaVelle with the pipe. And they arrested a 17-year-old juvenile as the one who punched LaVelle in the face, giving him a black eye.
LaVelle said that the next day the mother of the juvenile came back with some other people, banging on his door, screaming. LaVelle, who was at a charity sports event, was called back to the house by one of his sons.
When he got home, LaVelle said, the mother yelled at him, " 'You white mother------, you got my kid locked up! You got my son locked up because he's black, you're white!' " The mother claimed that her son had been "a witness," not an attacker. To that, LaVelle said if that were true, it would come out in court.
But the mother, according to LaVelle, then yelled: " 'If you make it to court! I know where you live!' "
Police public affairs could not confirm yesterday if the mother has been arrested for making threats.
Patty-Pat Kozlowski, president of the Port Richmond on Patrol and Civic Association, said that police told her that the attack on LaVelle stemmed from the incident at Stokely Playground, Indiana Avenue and Thompson Street, a few blocks from LaVelle's house.
She heard that an African-American "kid got knocked off his bike or fell off" and white kids were laughing at him. The group of African-Americans and Hispanics came back for retaliation, Kozlowski believes.
She said she didn't know any of the people involved in the playground incident or in the attack on LaVelle. LaVelle said he also did not know anyone involved.
Morin and Delgado, who face charges of aggravated assault, conspiracy, burglary, weapons and related offenses, face a preliminary hearing in Municipal Court today. They are both in custody. Their family members could not be reached for comment.
Freddy Godoy, Delgado's attorney, said yesterday that someone Delgado knows "was probably related to the child" who was attacked in the playground. But he contends that Delgado was not one of the people who attacked LaVelle.
Richard Patton, Morin's attorney, declined comment yesterday.
Kozlowski, a legislative aide to City Councilwoman Joan Krajewski and a lifelong Port Richmond resident, wrote about the attack in The Spirit community newspaper, which serves the river wards. Since then, the story has created a lot of buzz in the predominantly white neighborhood.
Kozlowski and Maryann Trombetta, president of the Port Richmond Town Watch, both recalled the murder of Sean Daily, a white teen who was beaten and shot by bat-wielding youths, mostly Latino, in May 1989.
They don't believe that the attack on LaVelle started as a racial incident, but believe that there was a racial element to it when the mob "called him a white mother------" and when the juvenile's mother allegedly threatened LaVelle.
LaVelle, who runs sports leagues composed of youths and adults of different races, said he doesn't want any retaliation on the people who attacked him. But the attack has instilled fear in him and his family, and he hopes that there will be more of a police presence in the neighborhood.
His wife is afraid to stay at home, and "every time I hear a car, I'm looking out the door," he said.
"It's not a good way to live."

ISTANBUL (AP) — About a week ago, Iranian President Mahmoud Ahmadinejad declared to the United Nations that most people in the world believe the United States was behind the terrorist attacks of Sept. 11, 2001.
To many people in the West, the statement was ludicrous, almost laughable if it weren't so incendiary. And surveys show that a majority of the world does not in fact believe that the U.S. orchestrated the attacks.
However, the belief persists strongly among a minority, even with U.S. allies like Turkey or in the U.S. itself. And it cannot be dismissed because it reflects a gulf in politics and perception, especially between the West and many Muslims.
"That theory might be true," said Ugur Tezer, a 48-year-old businessman who sells floor tiles in the Turkish capital, Ankara. "When I first heard about the attack I thought, 'Osama,' but then I thought the U.S. might have done it to suppress the rise of Muslims."
Compassion for the United States swept the globe right after the attacks, but conspiracy theories were circulating even then. It wasn't al-Qaida, they said, but the United States or Israel that downed the towers. Weeks after the strikes, at the United Nations, President George W. Bush urged the world not to tolerate "outrageous conspiracy theories" that deflected blame from the culprits.
However, the subsequent wars in Iraq and Afghanistan provided fodder for the damning claim that the U.S. killed its own citizens, supposedly to justify military action in the Middle East and to protect Israel. A 2006 survey by the Pew Global Attitudes Project found that significant majorities in Egypt, Indonesia, Jordan and Turkey — all among the most moderate nations in the Islamic world — said they did not believe Arabs carried out the attacks.
Two years later, a poll of 17 nations by WorldPublicOpinion.org, an international research project, found majorities in nine of them believed al-Qaida was behind the attacks. However, the U.S. government was blamed by 36 percent of Turks and 27 percent of Palestinians.
Such beliefs have currency even in the United States. In 2006, a Scripps Howard poll of 1,010 Americans found 36 percent thought it somewhat or very likely that U.S. officials either participated in the attacks or took no action to stop them.
Those who say the attacks might have been an "inside job" usually share antipathy toward the U.S. government, and often a maverick sensibility. Besides Ahmadinejad, high-profile doubters include Cuba's Fidel Castro and Venezuelan President Hugo Chavez. Former Minnesota governor and pro wrestler Jesse Ventura has questioned the official account. Conspiracy theorists have heckled former President Bill Clinton and other prominent Americans during speeches.
Controversy over U.S. actions and policies, including the widely discredited assertions that Saddam Hussein had weapons of mass destruction, reinforced the perceptions of conspiracy theorists. Iranians dug deeper into history, recalling the U.S.-backed coup in their country in 1953.
"Initially, I was doubtful about the conspiracy theories. But after seeing the events in later years, I don't have any doubt that it was their own operation to find a pretext to hit Muslim countries," said Shaikh Mushtaq Ahmed, a 58-year-old operations manager in a bank in Pakistan. "It's not a strange thing that they staged something like this in their own country to achieve a big objective."
In March, an editorial in The Washington Post harshly criticized Yukihisa Fujita, a lawmaker with the ruling Democratic Party of Japan, for saying in an interview that some of the Sept. 11 hijackers were alive and that shadowy forces with advance information about the plot played the stock market for profit. Fujita said the article contained factual errors.
The record shows that al-Qaida agents on a suicide mission hijacked four American passenger planes and crashed them into the World Trade Center towers, the Pentagon, and a field in Pennsylvania, killing nearly 3,000 people. The evidence is immense: witness accounts, audio recordings, video and photographic documentation, exhaustive investigations and claims of responsibility by al-Qaida.
Yet every fact and official assertion only feeds into alternative views that become amplified on the Internet, some tinged with anti-Semitism because of the close U.S.-Israeli alliance. They theorize that a knowing U.S. government stood by as the plot unfolded, or that controlled demolitions destroyed the Twin Towers, and the Pentagon was hit by a missile.
"All this, of course, would require hundreds if not thousands of people to be in on the plot. It speaks volumes for the determination to believe something," said David Aaronovitch, the British author of "Voodoo Histories: the role of Conspiracy Theory in Modern History."
"This kind of theory really does have a big impact in the Middle East," he said. "It gets in the way of thinking seriously about the problems in the area and what should be done."
A U.S. State Department website devotes space to debunking conspiracy theories about Sept. 11, in the apparent belief that the allegations must be addressed forcefully rather than dismissed out of hand as the ruminations of a fringe group.
"Conspiracy theories exist in the realm of myth, where imaginations run wild, fears trump facts, and evidence is ignored. As a superpower, the United States is often cast as a villain in these dramas," the site says.
Tod Fletcher of Petaluma, California, has worked as an assistant to David Ray Griffin, a retired theology professor, on books that question the Sept. 11 record. He was cautious about the Iranian president's comments about conspiracy theories, suggesting Ahmadinejad may have been politically motivated by his enmity with the U.S. government.

WHEREAS, the Banking Commissioner is charged with the administration of Chapter 672a of the Connecticut General Statutes, the Connecticut Uniform Securities Act (the “Act”) and Sections 36b-31-2 et seq. of the Regulations of Connecticut State Agencies (the “Regulations”) promulgated under the Act;
WHEREAS, Euro Pacific Capital, Inc. (“EPC”) of 10 Corbin Drive, Darien, Connecticut is a registered broker-dealer under the Act;
WHEREAS, the Commissioner, through the Securities and Business Investments Division (the “Division”) of the Department of Banking, has conducted an examination of EPC’s records pursuant to Section 36b-14(d) of the Act and 36b-31-14f of the Regulations, and an investigation of EPC’s activities pursuant to Section 36b-26 of the Act to determine whether EPC had violated, was violating or was about to violate any provision of the Act or any regulation or order under the Act; WHEREAS, the Commissioner, as a result of such examination and investigation, alleges that
1) EPC violated Section 36b-16 of the Act by effecting transactions in securities that were not registered under Sections 36b-17, 36b-18 or 36b-19 of the Act nor the subject of an exemptive claim or claim of covered security status under Section 36b-21 of the Act; and 2) in contravention of Section 36b-14(d) of the Act and Section 36b-31-14f(b) of the Regulations, EPC failed to promptly provide records to the Division when requested;
WHEREAS, EPC has represented to the Division that in an effort to enhance its supervisory procedures, it has increased its Operations and Compliance staff to five people, four of whom have passed the Series 24 examination;
WHEREAS, EPC has also represented to the Commissioner that its inability to promptly provide records to the Division was attributable to the relocation of the firm’s main office during the relevant time frame;
WHEREAS, the foregoing allegations of the Commissioner would support the initiation of administrative proceedings under Section 36b-15 of the Act to suspend or revoke EPC’s broker-dealer registration under the Act or to restrict or impose conditions on the securities activities that the firm may perform in this state; and/or proceedings under Section 36b-27 of the Act seeking the entry of an order to cease and desist and/or an order imposing an administrative fine against EPC
WHEREAS, an administrative proceeding under Sections 36b-15 and 36b-27 of the Act would constitute a “contested case” within the meaning of Section 4-166(2) of the Connecticut General Statutes;
WHEREAS, Section 4-177(c) of Chapter 54 of the Connecticut General Statutes provides that “unless precluded by law, a contested case may be resolved by stipulation, agreed settlement, or consent order or by the default of a party”;
WHEREAS, Section 36b-31(a) of the Act provides, in part, that: “The Commissioner may from time to time make, amend and rescind such . . . orders as are necessary to carry out the provisions of Sections 36b-2 to 36b-33, inclusive [of the Connecticut Uniform Securities Act]”;
WHEREAS, without holding a hearing and without trial or adjudication of any issue of fact or law, and prior to the initiation of any formal proceeding, the Commissioner and EPC reached an agreement, the terms of which are reflected in this Consent Order, in full and final resolution of the matters described herein;
WHEREAS, EPC, without admitting or denying any of the Commissioner’s allegations or findings, expressly consents to the Commissioner’s jurisdiction under the Act and to the terms of this Consent Order; and
WHEREAS, EPC, through its execution of this Consent Order, represents and agrees that none of the violations alleged in this Consent Order shall occur in the future;
CONSENT TO WAIVER OF PROCEDURAL RIGHTS
WHEREAS EPC, through its execution of this Consent Order, voluntarily waives the following rights:
1. To receive prior written notice within the meaning of Sections 36b-15(f), 36b-27(a), 36b-27(d) and 4-177(b) of the Connecticut General Statutes;
2. To present evidence and argument and to otherwise avail itself of Section 4-177c(a) of the Connecticut General Statutes;
3. To present its position in a hearing in which it is represented by counsel;
4. To have a written record of the hearing made and a written decision issued by a hearing officer; and
5. To seek judicial review of, or otherwise challenge or contest, the matters described herein, including the validity of this Consent Order; CONSENT TO ENTRY OF FINDINGS
WHEREAS, EPC, through its execution of this Consent Order, accepts and consents to the entry of the following Findings by the Commissioner:1. That the entry of this Consent Order is appropriate, in the public interest and consistent with the purposes fairly intended by the policy and provisions of the Act;
2. That EPC violated Section 36b-16 of the Act by effecting transactions in securities that were not registered under Sections 36b-17, 36b-18 or 36b-19 of the Act nor the subject of an exemptive claim or claim of covered security status under Section 36b-21 of the Act; and
3. That in contravention of Section 36b-14(d) of the Act and Section 36b-31-14f(b) of the Regulations, EPC failed to promptly provide records to the Division when requested;
CONSENT TO ENTRY OF SANCTIONS AND REMEDIAL MEASURES
WHEREAS, EPC, through its execution of this Consent Order, consents to the Commissioner issuing an order imposing on it the following sanctions and remedial measures:
1. Within sixty (60) days from the date this Consent Order is executed by the Commissioner, EPC shall hire an independent consultant sufficiently experienced in securities regulatory and compliance issues and not unacceptable to the Division Director to (a) conduct a review of EPC’s internal supervisory and compliance procedures to ensure compliance with the Act and the Regulations, including agent registration requirements under Connecticut law and oversight of the firm’s agents’ activities; (b) prepare a written report on the adequacy of such supervisory and compliance procedures, which report shall include an outline of improvements needed and current deficiencies identified; and (c) ensure implementation of revised procedures in accordance with this Consent Order and applicable law. The report shall be completed and submitted to the Division Director within ninety (90) days from the date this Consent Order is executed by the Commissioner, and shall include a copy of the consultant’s written report, together with a summary of those recommendations which have been implemented, an implementation timetable for those recommendations not yet implemented and, if any recommendations were not or will not be implemented, the reasons therefor. Once assessed by the Division Director, the report and implementation summary shall be returned to EPC to be maintained at EPC’s principal office and available for future inspection by the Division upon request;
2. EPC, its officers, directors, representatives, agents, employees, affiliates, and successors in interest shall cease and desist from engaging in conduct constituting or which would constitute a violation of the Act or any regulation or order under the Act, either directly or through any organizational or other device;
3. No later than the date this Consent Order is entered by the Commissioner, EPC shall remit to the department by check made payable to “Treasurer, State of Connecticut” the sum of seven thousand, five hundred dollars ($7,500), one thousand dollars ($1,000) of which shall represent reimbursement for the Division’s cost of conducting its examination of EPC and six thousand five hundred dollars ($6,500) of which shall constitute an administrative fine;
NOW THEREFORE, the Commissioner enters the following:
1. The Findings, Sanctions and Remedial Measures set forth above be and are hereby entered;
2. Entry of this Consent Order by the Commissioner is without prejudice to the right of the Commissioner to take enforcement action against EPC, its officers, directors, agents, employees and representatives based upon a violation of this Consent Order or the matters underlying its entry if the Commissioner determines that compliance is not being observed with the terms hereof or if any representation made by EPC and reflected herein is subsequently determined to be untrue;
3. This Consent Order shall become final when entered.
