Taking money from dead people is a legitimate business practice?  Damn... I should have gone into grave robbing YEARS ago, with all that jewelry people are buried with... I'll just get the dude in my avatar to dig em up and pay him in Babe Ruth bars.  If anyone questions me, I'll offer them the option of a free burial plot for 6 months... but NO WAY they are getting that jewelry back.

You are missing the point - its not their responsibility to find out if every member that signs up and then decides not to come to the gym anymore is in fact alife.
Hell every gym has loads of members that sign up 01. Jan every year and never come back after their first workout - Gyms make most of their money with gym tourists.
I mean what do you suggest - they call every member that hasn't signed in after 2 weeks? It was the responsibility of the relatives to make sure that they call the gym the banks and other business of the person that died.

They did... the problem was this dude had a bank account that nobody new about.    The point is this franchise manager/owner/dick should have refunded the money when provided with proof of this guys death... not offer a 6 month membership.  I guess you can't expect much cause he's Puerto Rican... worse than the "You no look!  You BUY!!!" asians at convenience stores...

The point is NOT how the gym continued to withdraw money from his account after he was dead.
The issue here, and has apparently now been resolved, is how the situation was handled ONCE KNOWN the person was dead.

Did he sign a contract, or was it month-to-month?  If, say, a 2-year contract was signed, unless there was a "death" clause in there somewhere, he or his estate would still be responsible for the balance of the contract.
