Onetime top football prospect exonerated after rape accuser recants

LONG BEACH, Calif. –  The kidnap-rape conviction of a once-promising prep football star was dismissed Thursday following a recantation by his accuser.

Brian Banks collapsed in sobs on the counsel table during a court hearing where a prosecutor quickly conceded the decade-old case and moved for the dismissal.

In the summer of 2002, Banks' future looked bright: He was a 17-year-old high school football star being heavily recruited by a number of colleges. But in a single day that changed with the accusations of kidnapping and rape by a female student.

He maintained there was no rape and their sexual contact was consensual, but his lawyer urged him to plead no contest rather than risk a sentence of 41 years to life in prison if convicted. He followed the advice and went to prison for six years, shattering his dreams of gridiron glory.

Lawyers for the California Innocence Project were prepared Thursday to argue he should be exonerated.

In a strange turn of events, the woman who accused him a decade ago friended him on Facebook when he got out of prison. Wanetta Gibson explained she wanted to "let bygones be bygones."

According to documents in the case, she met with Banks and said she had lied; there had been was no kidnap and no rape and she offered to help him clear his record.

But she subsequently refused to repeat the story to prosecutors because she feared she would have to return a $1.5 million payment from a civil suit brought by her mother against Long Beach schools.

She was quoted as telling Banks: "I will go through with helping you but it's like at the same time all that money they gave us, I mean gave me, I don't want to have to pay it back."

Justin Brooks, a lawyer who heads the innocence project, said that Banks has remained on probation, under electronic monitoring, has had to register as a sex offender and has had trouble getting a job.

He said Banks continues to train for what he hopes will be a future chance at a football career.

RENTON, Wash. –  Brian Banks will get a crack at the NFL, even if it's simply a tryout.

The Seattle Seahawks confirmed Wednesday they will hold a tryout for Banks, a former high school football star who was exonerated last week in a California rape case in which he was falsely accused.

Seattle coach Pete Carroll did not speak following the Seahawks' offseason workout on Wednesday, but the team confirmed that Banks will work out for the team on June 7.

"This is what I have dreamed about my entire life," Banks said in a statement from the California Western School of Law, home of the California Innocence Project. "I am ready to show the NFL what I am capable of doing. I want as many opportunities with as many NFL teams who are willing to give me a shot."

Seattle may not be the only team. The statement says a half-dozen NFL teams have gotten in contact withBanks, and ESPN.com reported some of those include the Kansas City Chiefs, Washington Redskins and Miami Dolphins.

Banks' attorney, Justin Brooks, head of the California Innocence Project, could not be immediately reached for comment.

The 26-year-old Banks pleaded no contest 10 years ago on the advice of a lawyer after a childhood friend falsely accused him of attacking her on their high school campus. Last Thursday, a judge threw out the conviction that sent Banks to prison for more than five years.

It's not surprising Carroll and the Seahawks appear to be the first ones willing to give Banks a shot.

Before the charges, Banks was a star middle linebacker at Long Beach Polytechnic High School and was attracting interest from college football powerhouses such as USC, Ohio State and Michigan. He gave a verbal commitment to USC to play for Carroll.

Then, a teenage girl Banks had known since childhood claimed he had raped her. He was arrested and, on advice of counsel, pleaded no contest to rape and an enhancement of kidnapping in order to avoid a possible life sentence if tried by a jury.

Banks served five years and two months in prison, but in a strange turn of events, the woman, Wanetta Gibson, later recanted her claim and offered to help Banks clear his name after he was out of jail. Banks was on probation and was wearing an electronic monitoring bracelet at the hearing last week where he was completely exonerated.

At the press conferences that followed the court hearing, Brooks appealed to NFL teams to give Banks a chance. He said Banks has been training six days a week to get in shape for the career he wants.

"He has the speed and the strength. He certainly has the heart," Brooks said. "I hope he gets the attention of people in the sports world."

Brian Banks just did a tryout for the Seattle Seahawks and 6 more teams are wanting him to try out.  He's kept himself in top shape so he'll be playing very soon

A hidden camera confession helped exonerate Brian Banks, a former California high school football star, after he served five years in prison for a rape he did not commit, NBCLosAngeles.com reported.

In an exclusive interview with the NBC4 I-Team, Private Investigator Freddie Parish divulged how he pulled off the stunning confession that freed the 6-foot-2, 239-pound linebacker who was being courted by top schools, including the University of Southern California, when accusations were brought against him ten years ago.

The former football star, from Long Beach, had received a friend request on Facebook from his accuser Wanetta Gibson, who told Banks she wanted to “let bygones be bygones.”

Parish devised a plan to see if Gibson would admit she fabricated her 2002 accusation that Banks raped her in a stairwell at school.

“There was no doubt in my mind that this young man was innocent,” said Parish, who has known Banks since his son, Freddie Parish IV, played football with Banks at Long Beach Polytechnic High in 2002.

Gibson’s family received a $1.5 million settlement from the school district, and Banks took a plea bargain that sent him to prison for five years, and then faced another five years on parole, shackled with a GPS tracking device on his ankle.

'One chance to get the goods'
In an attempt to elicit a confession, Parish wired his office with hidden cameras and microphones and suggested that Banks invite Gibson to the office to talk about their past.

“There’s only one chance to get the goods,” Parish said. “I mean, you gotta make it right the first time.”

Wanetta Gibson accepted Banks’ invitation, and showed up, by bus, at the private investigator’s Signal Hill office for a chat with her old high school crush.

“It just wasn’t true at all,” Gibson said about her rape accusation while hidden cameras were rolling.

California high school football star cleared of rape 10 years later

Banks then asked Gibson for help in clearing his name, so he could move on with his life.

Gibson said she was willing to help, but didn’t want to lose the $1.5 million settlement her family received from the Long Beach School District.

“I will go through with helping you, but all that money they gave us, I don’t want to have to pay it back, because that would take a long time,” she said on the video.

With Gibson on board, Parish was ready to execute the second part of his plan: He had Banks ask Gibson to return the next day to meet with the investigator.

“I needed to get her basically to recant everything she said Brian did ten years ago,” Parish told the NBC4 I-Team. “If I let this man down, I would have to live with that the rest of my life.”

'Did he rape you?'
The next day Gibson returned to Parish’s office; hidden cameras were rolling. Parish then asked the critical questions about the 2002 incident between Banks and Gibson.

Parish: “Did he rape you?”
Gibson: “No, he did not rape me.”
Parish: “Did he kidnap you?”
Gibson: “No.”

When Gibson made the stunning confession that she’d fabricated her rape accusation, Parish thought to himself: “Wow. I got it.”


That confession was evidence that lawyers from the California Innocence Project needed to go back to court on Banks’ behalf.

Armed with the video confessions, lawyer Justin Brooks got Brian Banks' rape conviction overturned on May 24.

Advertise | AdChoices“The videotape is a slam dunk, in the sense that she’s recanting her testimony,” said Brooks, head of the California Innocence Project at California Western School of Law.

Now, Banks is able to finally pursue his dream of a career in pro football, thanks in large part to the work of a private investigator.

“I had a chance to make a difference in a man’s life,” Parish said.

On Thursday, Banks participated in a tryout with the NFL’s Seattle Seahawks.
