Not an incredibly interesting read but it is a concept that will probably continue to become more common.  I could see it affecting this board sometime in the future - as there are many statements and theories thrown out due to free speech here.

One thing that does totally appeal to me though, is the idea of being named as WTFPWNED_69LOLROFL in an article.  I can see it now...

"The poster, WTFPWNED_69LOLROFL claimed that muscletech's products were not 1060% more synergistic than regular "over the counter" alternatives.  In related news, the Goatboy is still on the run and wanted in 3 states for slander "

I really don't think that sort of thing would ever apply to what you typically see on this board. Obvious satire involving public figures is not the same thing as false factual statements regarding a publicly-traded company. Likewise, opinions, predictions, or questions, no matter how nasty, are not factual statements, and therefore cannot be construed as slander.

Muscletech did sue elite fitness IIRC and sued or threatened to sue bb.com.

GoatGirl....very good.....public figures can almost never sue on defamation via public statements.......as Goatboy pointed out-even if they do turn out to be false.....See New York Times v. Sullivan..............opinions cannot give rise to a claim of defamation either......Goatboy-have you been to law school?


Otherwise........That  is a very good understanding of free speech/defamation issues for a lay person..... ;D

Muscletech did sue elite fitness IIRC and sued or threatened to sue bb.com.

Internet posting boards are absolutely immune from prosecution for defamatory statements posted on their web sites (AOL Case, will have to find it), per federal law. So BB.com, Getbig.com and all others similarly situated have no fear of getting civilly prosecuted for a defamatory statement.


Lawsuits and lawyers are for pussies. I think we should bring back the duel of honor.

Then why did Elitefitness delete all MT bashing posts after the lawsuit? Can't recall all the specifics but no MT bashing threads were allowed.

I have no idea.....maybe they don't know the law.......the people posting can be held liable- but the web site itself is completely immune from lawsuit.......

I told him spend the money on his legal defense next year.

i done essay on this 4 my law degree. basically defamation on message boards constitute defamation on a book or newsletter etc.

cases have gone to court and damages paid etc over in uk. seems these are growing. and as technological correspondence inscreases so will these lawsuits.
