How is America a police state?  It's legal to smoke pot in Washington and Colorado. Gay marriage is legal in many states as is marrying your cousin.  You can also ride a motorcycle without a helmet and in some states the speed limit on trucks 75 mph.  I've lived in states where it's legal to carry a gun in a restaurant or bar. 

Every state has it's own laws.  If you don't like the laws in your state you can try to get them changed or you can move to another state.  As an American I don't feel like I live in a police state.
