He should have dropped to the ground sooner to make himself a smaller target and given himself some distance and time to aim if he was planning to shoot at the cops and keep them back from shooting him but opening fire on 3 armed guys 10 feet away with no cover is not a good strategy at least fire from a kneeling or better yet prone position at 25-50 yards so they stop coming forward and cant really shoot you either
