In Portland he probably will go to jail even though he was in the right. Vehicles are considered deadly weapons (in normal red ran cities, counties and states). Security gave him multiple commands and instead of complying he tried to hit the guard. We don’t know the backstory
Correct, for the most part.
Being a security guard instead of a cop will probably work in his favor IF this goes to trial. Cops, being agents of the government, are required to try to de-escalate and not precipitate force. A prime example is standing in front of a car then claiming you're in fear of your life to justify shooting when you could have simply moved out of the way.
I don't know that a private security guard is trained or required to de-escalate.
In Portland a sworn police officer in this exact same scenario would probably be totally fucked. The security guard will probably lose his job but he may es ape prosecution.
The D.A. in Portland, actually Multnomah County, is anxious for the opportunity to convict a cop. It's no secret despite failing/refusing to charge 99% of theoffenses that come into his office. Of all the charges the D.A. dropped against the rioters he DID charge a cop with assault for what was merely a push with his baton. The DA argued that it was a 'head strike' so he charged the officer criminally. Its a total joke/farce a witch hunt.
Further as much as Portland is anti-police there's rarely any outrage when the police here shoot a white guy. But if it's a black guy- regardless of the circumstances, they will crucify the cop.
So in this case it's a security guard and not a cop and the dead guy (i assume) is white. I wouldn't be surprised if this doesn't register much attention in Portland at all.
